Замовник укладає договір з переможцем відбору не пізніше ніж через п’ять календарних днів з дня оприлюднення повідомлення про намір укласти договір. У разі обґрунтованої потреби строк укладення договору може бути продовжений до 10 календарних днів. Договір між замовником та переможцем відбору укладається відповідно до вимог законодавства.
Умови договору не можуть відрізнятися від умов, визначених замовником у запиті пропозицій постачальників шляхом заповнення електронних форм з окремими полями та у проекті договору, що є складовою частиною запиту пропозицій постачальників, та/або пропозиції переможця відбору, крім випадку зменшення ціни договору без зміни обсягу або перерахунку ціни та обсягів товарів у бік зменшення за умови необхідності приведення обсягів товарів до кратності упаковки, або приведення умов договору у відповідність з умовами, визначеними у запиті пропозицій постачальників шляхом заповнення електронних форм з окремими полями в електронній системі закупівель, якщо такі умови відрізняються у проекті договору.
