Original language: ukДо уваги! Замовник є платником податку на додану вартість (далі- ПДВ), план закупівель оприлюднено з урахуванням ПДВ. З метою єдиного підходу до оцінки тендерних пропозицій Учасників процедура відкритих торгів оголошена без врахування ПДВ, щоб не допустити переплати і недоотримання Замовником податкового кредиту у випадку визначення переможцем неплатника ПДВ.
Під час заповнення форм Учасник зазначає ціну тендерної пропозиції в гривнях без врахування ПДВ. У разі, якщо Учасником процедури закупівлі є платник ПДВ, при укладанні договору про закупівлю сума ПДВ буде додаватися до «остаточної пропозиції» без врахування ПДВ відповідно до законодавства України. Остаточна цінова пропозиція Учасника, подана без ПДВ, повинна бути тотожною сумі Договору без ПДВ. Механізм оголошення процедури без ПДВ застосовується з врахуванням правової позиції Верховного Суду (справа №915/105/18). Ті ж Учасники, які не є платниками ПДВ, повинні в ціні тендерної пропозиції, яку будуть зазначати в електронній системі закупівель та в інших документах пропозиції, враховувати всі податки та збори (обов’язкові платежів), адже для такого Учасника ціна пропозиції не буде коригуватись (зокрема, ціна пропозиції не буде збільшена на суму єдиного податку).
