The country of origin of the goods cannot be the Russian Federation/Republic of Belarus/Islamic Republic of Iran. To confirm this requirement, the Supplier indicates this information when filling out the Specification (Appendix No. 1 to the Agreement) in the Country of Production column.

Signing of the agreement:
In accordance with the provisions of Resolution of the Cabinet of Ministers of Ukraine No. 187 dated 03.03.2022 "On ensuring the protection of national interests in future claims of the state of Ukraine in connection with the military aggression of the Russian Federation", Resolution of the Cabinet of Ministers of Ukraine No. 1178 dated 12.10.2022 "On approval of the peculiarities of public procurement of goods, works and services for customers provided for by the Law of Ukraine "On Public Procurement", for the period of the legal regime of martial law in Ukraine and within 90 days from the date of its termination or cancellation", Resolution of the Cabinet of Ministers of Ukraine No. 822 dated 14.09.2020 "On approval of the Procedure for forming and using an electronic catalog" in order to prevent the purchase of medical materials originating from the Russian Federation/Republic of Belarus/Islamic Republic of Iran, goods that are in illegal circulation and in order to timely supply goods in the required quantity and quality, within 5 (five) days after signing the Agreement, the Supplier provides the original document (Certificate) on the origin of the goods, by which the manufacturer or representative of the manufacturer (whose authority is confirmed by documents from the manufacturer of the goods) guarantees that the goods (to be supplied to the Customer) are not in illegal circulation, do not originate from the Russian Federation/Republic of Belarus/Islamic Republic of Iran and will be delivered on time. The certificate must be addressed to the Customer and contain the following information: name and identification/registration code of the Supplier; name of the procurement item; procurement identifier; name and quantity of goods to be supplied; country of origin of the goods.
To confirm the quality of the goods, within 5 (five) days after signing the Agreement, the Supplier must provide the Customer with supporting documents of the quality of the proposed goods, by providing for each product/each batch of goods, quality certificates and/or declarations of conformity certified by the manufacturer.
When signing the Agreement, the Parties sign a Register of documents from manufacturers (or representatives), which will confirm the quality and origin of the goods during the execution of the Agreement, which is an integral part of the Agreement (Appendix No. 2 to the Agreement).
Failure to provide the specified documents and failure to sign the Register of documents will be considered a refusal to fulfill the Agreement.

Bank guarantee:
The Supplier, to ensure the fulfillment of its obligations under the Agreement to the Customer, provides the latter, at the time of signing the Agreement, with the original bank guarantee for the fulfillment of the Agreement in the currency of payment – hryvnia (hereinafter – the bank guarantee). The bank guarantee must be issued with monetary coverage. To confirm the availability of monetary coverage, a certificate from the bank on the balance of funds in the Participant's account is provided.
Return of the guarantee:
The Customer returns the Security after the Supplier has fulfilled its obligations under this Agreement without violations, or by court decision on the return of the Security in case of recognition of the procurement results as invalid or the procurement agreement as void, or in case of termination of the Agreement by mutual consent of the parties and provided that the parties have no claims against each other, or in cases provided for by paragraph 21 of the Peculiarities of public procurement of goods, works and services for customers provided for by the Law of Ukraine "On Public Procurement", for the period of the legal regime of martial law in Ukraine and within 90 days from the date of its termination or cancellation, approved by the Resolution of the Cabinet of Ministers of Ukraine dated 12.10.2022 No. 1178, or in accordance with the terms specified in this Agreement, within 5 (five) banking (operational, bank working days) days from the date of occurrence of the specified circumstances.
