Original language: bgПоръчката се възлага на основание чл.79 ал.1, т.3 б."в" от Закона за обществените поръчки - поръчката може да бъде изпълнена само от определен изпълнител , поради наличие на изключителни права. Съгласно действащото законодателство в областта на енергетиката, електроразпределителната мрежа, през която се извършва пренос и разпределение на електрическа енергия, се експлоатира и управлява от електроразпределителни предприятия при наличие на валидна лицензия за разпределение на електрическа енергия, издадена от Комисията за енергийно и водно регулиране за съответната обособена територия – чл.39, ал.1, т.3 от ЗЕ. Разпоредбата на чл.43, ал.2, т.1 от ЗЕ гласи, че за една обособена територия на страната се издава само една лицензия, като цените за достъп и/или пренос през електроразпределителната мрежа подлежат на регулиране от КЕВР. Видно от данните в публичния регистър на издадените лицензии за дейностите в енергетиката, поддържан от КЕВР и достъпен и чрез интернет страницата на комисията „Електроразпределение Юг” ЕАД, ЕИК 115552190, със седалище и адрес на управление: гр. Пловдив, ул. „Христо Г. Данов”№37, притежава лицензия за разпределение на електрическа енергия №Л-140-07/13.08.2004г., издадена от Комисията за енергийно и водно регулиране за срок от 35 години. От публичния регистър на издадените лицензии за дейностите в енергетиката е видно, че КЕВР е издала в полза на „Национална електрическа компания“ ЕАД, лицензия № Л-140-07/13.08.2004 г., изменена с Решение № И1-Л-140/06.06.2011 г., Решение № И2-Л-140/19.12.2011 г. и Решение № И3-Л-140/09.12.2013 г. за извършване на дейността „разпределение на електрическа енергия“, за срок от 35 (тридесет и пет) години, на обособена територия обслужваща следните области: Бургас, Кърджали, Пазарджик, Пловдив, Сливен, Смолян, Стара Загора, Хасково и Ямбол. Лицензията е вписана под № 149 в публичния регистър на издадените лицензии, поддържан от КЕВР, на интернет адрес: http://portal.dker.bg/registri/litsenzii .
