Закупівля здійснюється згідно постанови Кабінету Міністрів України від 11.11.2022 № 1275 «Деякі питання здійснення оборонних закупівель на період дії правового режиму воєнного стану» зі змінами. Обов’язкова наявність АЗС на території областей: Вінницька, Волинська, Житомирська, Київська, Львівська, Одеська, Рівненська, Харківська, Чернігівська області. Якщо АЗС, через які здійснюватиметься реалізація пального не є власністю Виконавця, то Виконавець повинен мати діючі договори (або інших правочинів) з терміном дії не менше ніж до 31.12.2026, які підтверджують можливість використання АЗС. Талони повинні мати термін дії не менше 12 місяців з моменту їх отримання (передачі) згідно Акту приймання-передачі та повинні діяти на всіх АЗС Виконавця, що зазначені вище та з можливістю обміну на нові талони з новим строком дії при їх закінченні без врахування коливання ціни. Замовник керується нормами чинного законодавства України, а саме умовами Постанови Кабінету Міністрів України від 02.03.2022 № 178 «Деякі питання обкладення податком на додану вартість за нульовою ставкою у період воєнного стану» встановлено, що до припинення чи скасування воєнного стану операції з постачання дизельного палива в талонах обкладаються податком на додану вартість за нульовою ставкою.
