Special requirements for the subject of procurement: In order to fulfill mobilization tasks under martial law, introduced by Decree of the President of Ukraine dated February 24, 2022 No. 64 "On the introduction of martial law in Ukraine", and in accordance with subparagraph "g" of subparagraph 195.1.2 of paragraph 195.1 of Article 195 of the Tax Code of Ukraine, the Cabinet of Ministers of Ukraine issued Resolution No. 178 dated March 2, 2022 "Some issues of VAT taxation at a zero rate during martial law" (hereinafter - Resolution of 02.03.2022 No. 178).
Paragraph 1 of Resolution of 02.03.2022 No. 178 establishes that until the termination or cancellation of martial law, operations for the supply of goods for refueling (refueling) or maintenance of vehicles of the Armed Forces, National Guard, Security Service, Foreign Intelligence Service, State Border Guard Service, Ministry of Internal Affairs, State Emergency Service, State Security Administration, State Service for Special Communications and Information Protection, other military formations formed in accordance with laws, their formations, military units, subdivisions, institutions or organizations funded by the state budget, for the needs of defense of Ukraine, protection of public safety and state interests are subject to VAT at a zero rate.
Supply of goods (transport and other costs) to the Customer is carried out at the expense of the Supplier in Sumy and/or in Ukraine.
The participant, as part of the proposal, must provide a certificate of ownership of its own oil depot for responsible storage within the Vinnytsia region.
The participant must document the legality of using a trademark or brand.
As part of its tender proposal, the participant provides confirmation of its ability to uninterruptedly supply the Goods under martial law in case of emergency power outages. For this, the Participant must submit a certificate in any form about the availability of relevant equipment (generators, etc.) that will be used to ensure the refueling of Goods (petroleum products) into the Buyer's containers (car tank, canisters, metal barrels, and other containers) during power outages, and confirmation letters from the owners of the oil depot.
2. Warranty obligations: not less than 365 days.
3. Delivery times (performance of works, provision of services): no later than 10 days from the date of contract conclusion.
4. Payment terms: no later than 3 banking days from the date of goods delivery. Payment is made from the general fund of the state budget.
5. Place of delivery (performance of works, provision of services): Main Directorate of the National Police in Sumy Oblast: Sumy.
6. The contract is concluded in accordance with the requirements of the current legislation of Ukraine, taking into account the Decree of the President of Ukraine of 24.02.2022 No. 64 "On the introduction of martial law and extension of martial law in Ukraine", and paragraph 12 of the specifics of public procurement of goods, works and services for customers provided for by the Law of Ukraine "On Public Procurement", for the period of the legal regime of martial law in Ukraine and within 90 days from the date of its termination, approved by Resolution of the Cabinet of Ministers of Ukraine of 12.10.2022 No. 1178 (as amended).
