If the tender participation qualification is "failed," participation in the tender is not possible.

Not falling under the provisions of Article 70 of the Budget, Settlement and Accounting Order. Minors, persons under guardianship or assistance, who have obtained the necessary consent for concluding a contract, are considered to fall under cases with special reasons in the said article.
Not having filed for commencement of rehabilitation proceedings under the Corporate Rehabilitation Act (Act No. 154 of 2002) or for commencement of reconstruction proceedings under the Civil Reconstruction Act (Act No. 225 of 1999). However, those who have filed for commencement of rehabilitation proceedings under the Corporate Rehabilitation Act or for commencement of reconstruction proceedings under the Civil Reconstruction Act, and have subsequently obtained re-certification of competitive participation qualifications, are exceptions.
Not being a party who has violated a contract with the contracting officer of this bureau, or who, after becoming the successful bidder of a tender conducted by the said contracting officer, has refused to enter into a contract without justifiable reason, or has engaged in fraudulent or dishonest acts in tenders or other business of this bureau, and is deemed unsuitable as a contract counterparty.
Must be able to assign a supervising engineer or chief engineer (hereinafter referred to as "supervising engineer, etc.") exclusively to the construction site for the construction industry law permit category corresponding to the contracted work.
