Bidding Method The bidding procedure for this contract will be conducted through the electronic bidding system. Bid Participation Qualifications (1) Those eligible to participate in the bid must meet all of the following requirements: ① Not falling under the provisions of Article 167-4 of the Local Autonomy Act Enforcement Regulations. ② Possess registration in accordance with the provisions of the Cabinet Order, etc., as specified in the "Outline of Commissioned Work by Work Type" (hereinafter referred to as "Outline"). ③ Not have been subject to a suspension of bidding by Kazuno City from the deadline for application for confirmation of bid participation qualifications to the date of award decision. ④ Not be a party for whom an application for commencement of rehabilitation proceedings under the Corporate Reorganization Act (Act No. 154 of 2002) or an application for commencement of civil rehabilitation proceedings under the Civil Rehabilitation Act (Act No. 225 of 1999) has been filed (excluding those for whom a decision to commence proceedings has been made). ⑤ Regarding organized crime groups, not falling under any of the following: a. Recognized as an organized crime group as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Members of Organized Crime Groups (Act No. 77 of 1991; hereinafter referred to as the "Organized Crime Group Countermeasures Act"). b. Recognized as a member of an organized crime group as defined in Article 2, Item 6 of the Organized Crime Group Countermeasures Act (hereinafter referred to as "organized crime group member"). c. Recognized as cooperating with or being involved in the maintenance or operation of an organized crime group, directly or indirectly, by supplying funds or providing conveniences to an organized crime group or its members. e. Recognized as having a socially reprehensible relationship with an organized crime group or its members. f. Recognized as using an organized crime group, its members, or persons falling under any of items c to e above, in an unjust manner, while knowing that they fall under such categories. ⑥ Not be in arrears with taxes. ⑦ Other bid participation qualification requirements shall be as described in the Outline. (2) Requirements specified by work type shall be as described in the Outline. 4. Application for Bid Participation Qualifications, etc. (1) Distribution of necessary documents for bid participation application can be checked on the electronic bidding system or within the electronic bidding system. (2) Submission of Bid Participation Qualification Application Form: Those wishing to participate in the bid must submit one copy of the application for confirmation of bid participation qualifications and the bid participation qualification confirmation documents to the Contract and Inspection Office via the electronic bidding system by the deadline specified in the Outline, in accordance with the Outline. (3) Confirmation of Bid Participation Qualifications: Confirmation of bid participation qualifications will be conducted after the bid opening, in principle, for the prospective successful bidder (hereinafter referred to as the "prospective successful bidder"); confirmation will not be conducted for others. (4) Withdrawal from Bid Participation: Those who have submitted the application for confirmation of bid participation qualifications may withdraw from the bid by submitting a withdrawal notice before the bid opening, or a notification stating such fact after the bid opening, promptly, if they lose their bid participation qualifications after submitting the application and before the award decision. (5) Inspection, etc., of Design Documents, etc.: ① The method of inspection and borrowing of design documents, specifications, drawings, etc. (hereinafter referred to as "design documents, etc.") related to this contract shall be in accordance with the "Handling Procedures for Inspection, etc., of Design Documents, etc." (Kazuno City Administrative Order No. 102 of 2015). ② The period for inspection, etc., shall be as indicated in the Outline. (6) Questions and Answers regarding Design Documents, etc.: The method for asking questions and receiving answers regarding design documents, etc., shall be in accordance with the "Handling Procedures for Inspection, etc., of Design Documents, etc." (Kazuno City Administrative Order No. 102 of 2015), and the deadline for questions and answers shall be as indicated in the Outline. 5. Bid Security and Contract Security Bid security and contract security are waived. 6. Bid Execution Location, Date and Time, and Submission of Bids, etc. (1) Submission Method: Bids must be submitted through the electronic bidding system by the deadline specified in the Outline. However, those who have difficulty using the electronic bidding system (limited to cases approved by the bid execution authority in accordance with Article 8 or 9 of the Kazuno City Public Works Electronic Bidding Operation Standards) may use the paper bidding method. (2) Amount to be Stated in the Bid Form: ① For the award decision, the successful bid amount will be the amount stated in the bid form plus an amount equivalent to 10% of that amount. Therefore, bidders must state in their bid form an amount equivalent to 100/100 of their estimated contract desired amount, regardless of whether they are a taxable or non-taxable business with respect to consumption tax. ② Bid amounts shall be in units of one thousand yen. (3) Other: ① If there is no bidder who should be awarded the contract, re-bidding will be conducted. ② Bidding will be conducted even if there is only one bidder. 7. Method of Determining the Successful Bidder (1) The prospective successful bidder shall be the bidder who submitted a bid within the limit of the estimated price (or within the limit of the minimum restriction price if set) and has the lowest bid price. If there are two or more bidders with the lowest bid price, the order will be determined by drawing lots, and the highest-ranked bidder will be the prospective successful bidder. (2) After confirming the bid participation qualifications of the prospective successful bidder under (1), if they are confirmed to be qualified and do not fall under any of the following, that prospective successful bidder will be determined as the successful bidder: ① When it is recognized that the contract cannot be performed in accordance with its content due to the bid price of the prospective successful bidder. ② When it is recognized that concluding a contract with the prospective successful bidder would disrupt the order of fair trade and is significantly inappropriate. (3) If a successful bidder is not determined under (2), the bidder who submitted a bid within the limit of the estimated price and has the next lowest bid price after the prospective successful bidder (if there are two or more such bidders, the highest-ranked bidder will be determined by the method in the latter part of (1). However, if the prospective successful bidder was determined by drawing lots, the next ranked bidder in the drawing will be used) will be the prospective successful bidder, and the confirmation under (2) will be conducted. (4) The above methods will be repeated sequentially until a successful bidder is determined. (5) If the Mayor determines that a bidder is not qualified under (2), the Mayor shall notify the prospective successful bidder of the qualification confirmation result notice, clearly stating the reason for disqualification. (6) The recipient of the notice under (5) may request an explanation in writing from the Mayor regarding the reason for disqualification within two days (excluding city holidays as defined in Article 1, Paragraph 1 of the Ordinance on Kazuno City Holidays (Ordinance No. 23 of 1990)) from the day following the date of the notice. 8. Invalid Bids Bids falling under any of the following shall be invalid: (1) Bids submitted by persons not eligible to participate in the competition (persons other than those who have obtained the right to participate in the bid). (2) Bids submitted by those who have not paid or provided the prescribed bid security or substitute collateral (excluding those for whom the entire bid security has been waived). (3) Bids lacking signatures and seals. (4) Bids with corrected amounts. (5) Bids with unclear expressions of intent due to typos, omissions, etc. (6) Bids clearly recognized as being collusive. (7) Bids with amounts below the minimum restriction price when the minimum restriction price is applied. (8) Other bids that violate the bidding conditions. 9. Other (1) When registering for bidding with the city, if you have delegated the authority to bid and contract to a branch office or other business location, please apply from the delegated branch office or business location, not the head office/main branch. If the delegated party has difficulty bidding electronically and the head office/main branch will bid, an electronic bidding delegation form must be submitted. (2) No briefing session will be held for the bid. (3) No hearing will be held regarding bid participation qualifications. However, explanations may be requested if deemed necessary. (4) The performance deadline may be changed due to circumstances. (5) Bidders must be thoroughly familiar with the design documents, etc., and comply with the bidding instructions and precautions for bidding. (6) The award decision date may be changed due to circumstances. (7) If the successful bidder no longer meets the requirements set forth in Section 3 during the period from the award decision date to the contract conclusion date, the Mayor may not conclude the contract with the successful bidder. (8) The successful bidder must conclude the contract (or a provisional contract for contracts requiring the approval of the assembly as stipulated in Article 121 of the Financial Regulations) within five days from the date of the award decision, otherwise the bid award will lose its effect. However, if there are unavoidable circumstances that prevent the conclusion of the contract, this period may be extended with the prior consent of the contracting authority. (9) Matters not stipulated in this notice shall be governed by the Local Autonomy Act, the Local Autonomy Act Enforcement Regulations, the Kazuno City Financial Regulations, and the Kazuno City General Competitive Bidding Procedures Manual.
