(7) This work is subject to the obligation to implement separate demolition and recycling of construction materials, and recycling of specified construction material waste, based on the "Law Concerning the Recycling of Materials in Construction Work" (Law No. 104 of 2000). (8) This work is designed to secure the contractor's construction system and construction materials, and includes a buffer period until November 1, Reiwa 8. No engineers are required to be assigned during the buffer period. Furthermore, if the construction system and construction materials are secured within the buffer period, construction may commence through consultation with the supervisor. (9) Regarding the handling of the full-time chief engineer, if the work has unity or continuity with the work subject to construction, or if mutual coordination is required during construction, and if the construction sites are located in close proximity, within approximately 10 km in a straight line or about 60 minutes of travel time, and the same contractor performs the construction, then according to Article 27, Paragraph 2 of the Order for Enforcement of the Building Business Act, the same full-time chief engineer can manage these construction works. In this case, the number of works that the same chief engineer can manage, including works requiring full-time assignment, shall generally be around two. However, this does not apply to supervising engineers. 2. Eligibility for Competition (1) Persons who do not fall under the provisions of Article 70 and Article 71 of the Order for Expenditure, Budgets, and Accounts (Imperial Ordinance No. 165 of 1947; hereinafter referred to as "Yoyaku-rei"). Minors, persons under guardianship, or persons under assistance who have obtained the necessary consent for contract conclusion fall under the case of special reasons in Article 70 of Yoyaku-rei. (2) Persons who have been certified with general competitive participation qualifications for civil engineering works of Grade C or D (for Grade D, with qualification points of 800 or more) in the Hokkaido Regional Forest Office for Reiwa 7 and 8. (For companies undergoing rehabilitation proceedings based on the Corporate Reorganization Act (Law No. 154 of 2002) or reconstruction proceedings based on the Civil Rehabilitation Act (Law No. 225 of 1999), re-certification of general competitive participation qualifications based on procedures separately determined by the Director of the Hokkaido Regional Forest Office after the decision to commence proceedings is required.) (For joint ventures, the track record of a constituent member with an investment ratio of 20% or more will be recognized as that member's track record.) (5) A chief engineer or supervising engineer who meets all of the following criteria can be assigned to the work based on the Building Business Act (Law No. 100 of 1949). However, for work prescribed in Article 26, Paragraph 3 of the Building Business Act, they can be assigned full-time. For work prescribed in Article 26, Paragraph 2 of the Building Business Act, a full-time supervising engineer can be assigned. For supervising engineers, a person who meets all criteria except for (3) below, who assists the supervising engineer in their duties, can be concurrently assigned to up to two construction sites. Furthermore, for the period until commencement of site construction and the period after completion of construction until the completion of inspection and only administrative procedures and cleanup remain, the full-time assignment of a chief engineer or supervising engineer is not necessarily required. ① Must be a Grade 1 Civil Engineering Construction Management Engineer, Grade 2 Civil Engineering Construction Management Engineer, or possess equivalent or higher qualifications. ② Must have experience in the work described in (4) within the 15 years from April 1, Reiwa 3 to March 31, Reiwa 8. If the work was ordered by a Regional Forest Office Director, etc., and the construction performance evaluation score is less than the score specified in the tender documents, the experience will not be recognized. ③ For supervising engineers, must possess a supervising engineer's license and a certificate of completion of supervising engineer training, or equivalent. (6) The applicant must not have been subject to a suspension of bidding order from the Director of the Hokkaido Regional Forest Office based on the "Procedures for Handling Suspension of Bidding Orders for Construction Contracts, etc." (Notice No. 59-Rinya-Kei-156 dated June 11, Reiwa 59) from the submission deadline of the application for confirmation of competitive participation qualifications (hereinafter referred to as "Application") and confirmation documents (hereinafter referred to as "Documents") until the opening of bids. (7) If there is a track record of similar work ordered by the Director of a Forest Management (Branch) Office within the Hokkaido Regional Forest Office jurisdiction, completed and delivered between April 1, Reiwa 5 and March 31, Reiwa 8, the average performance evaluation score for such work must be 65 points or higher. (8) The applicant must not be a contractor who received design services for the work described in item 1 above, or a construction company with a capital or personnel relationship with such a contractor (refer to the tender documents). (9) There must be no capital or personnel relationship between the applicants (excluding cases where all parties with such relationships are members other than the representative of the joint venture) (refer to the tender documents). (10) The head office, branch office, or business office based on the Building Business Act must be located within the jurisdiction of the Hokkaido Regional Forest Office (within Hokkaido). If applying as an ongoing construction joint venture, the head office location of the joint venture listed in the qualified contractor roster must be within the said area. (11) The applicant must not be a construction company that is effectively controlled by a gangster, or equivalent, and has been requested to be excluded from projects ordered by the Ministry of Agriculture, Forestry and Fisheries by the police authorities, and such a state continues. (12) The applicant must not be a construction company that has not filed the following notifications (excluding those not obligated to do so): ① Notification under Article 48 of the Health Insurance Act (Law No. 70 of 1922). ② Notification under Article 27 of the Employees' Pension Insurance Act (Law No. 115 of 1954). ③ Notification under Article 7 of the Employment Insurance Act (Law No. 116 of 1974). 3. (4) Invalid Bids: ① Bids submitted by persons who do not meet the eligibility requirements stated in this notice, bids with false statements in the application or supporting documents, and bids that violate the conditions of bidding are invalid. ② If a successful bidder is found to have submitted an invalid bid, the award decision will be revoked. ③ Even if a person is confirmed to be eligible by the authorized officer for expenditure, if they do not meet the qualifications listed in item 2 at the time of bid opening, they will be considered ineligible. ④ In the case of ① above, a bid suspension order under Article 1, Paragraph 1 of the "Procedures for Handling Suspension of Bidding Orders for Construction Contracts, etc.", or a written or verbal warning or caution under Article 10 may be issued. (5) Method of Determining the Successful Bidder: The successful bidder will be the one who submits the lowest valid bid within the scope of the estimated price prepared in accordance with Article 79 of Yoyaku-rei, among those whose eligibility for competition has been confirmed. However, for works with an estimated price exceeding 10 million yen, if it is determined that the bid price of the intended successful bidder is unlikely to ensure the fulfillment of the contract in accordance with its content, or if it is deemed significantly inappropriate because concluding a contract with that person would disrupt the order of fair trade, another bidder who submitted a bid within the scope of the estimated price, with the lowest bid price, may be selected as the successful bidder.
