2/15 Common Matters for General Competitive Bidding of Goods 1. Requirements for Bidders (1) Not a person falling under Article 167-4 of the Order and Article 2, Paragraph 1 of the Okayama City Contract Regulations (Showa 63, City Ordinance No. 63; hereinafter referred to as "Regulations"). (2) Must have been determined to have general competitive bidding qualifications based on "Matters Concerning Okayama City Competitive Bidding Qualifications and Examinations, etc." (Showa 61, City Announcement No. 120) and be listed in the list of qualified persons under Article 4 of the Regulations for "Goods (including raw materials)". (3) Must not be under suspension or deferral of designation (hereinafter referred to as "suspension, etc.") based on the city's suspension criteria at the time of bid opening announced. (4) Must have acquired an IC card (a card storing an electronic certificate usable with the Okayama Prefecture Electronic Bidding Joint Use System (hereinafter referred to as "Electronic Bidding System")) and completed user registration in the Electronic Bidding System by the bidding acceptance deadline. 2. Bid Submission Procedures (1) The number of bids is two. (2) Bidders shall submit their bids by registering their bid amount using the Electronic Bidding System between the bidding acceptance start date/time and the bidding acceptance deadline for the registered work. (6) For the determination of the successful bidder, the bid price will be the amount registered in the bid form (or the amount stated on the written bid form for written participants), plus 10% of that amount (rounded down to the nearest yen if there are fractions of less than one yen). Therefore, bidders, whether they are taxable or non-taxable for consumption tax, should register the amount equivalent to 110/100 of their estimated contract desired amount in the Electronic Bidding System (or state it on the written bid form). (7) In the case of (2), bidders using the Electronic Bidding System shall enter any three-digit number in the lottery number field when registering the bid amount. In the case of (3), bidders participating in writing shall enter any three-digit number in the lottery number field of the bid form ("000" cannot be entered). If no number from "001" to "999" is entered in the lottery number field, it will be considered as if "999" was entered. (8) Submitted bids cannot be corrected, exchanged, or withdrawn. However, bids that are recognized as erroneous by the city upon submission of a prescribed Bid Error Notification Form to the Contract Division by the scheduled bid opening date will be invalidated. 3/15 (9) Bid withdrawal after bid submission will not be permitted unless there are particularly justifiable reasons. However, this does not apply to withdrawal during the period between the bid opening of the first round and the submission of bids for the second round (re-bidding). Bid Opening Procedures, etc. (1) Bids will be opened at the date and time and location specified in the announcement. (2) If there are written participants as prescribed in 2(3), the bid opening will be conducted after the written bids are registered in the Electronic Bidding System at the date, time, and location specified in the announcement. If, as a result of the bid opening, it becomes clear that a bidder's bid falls under any of the following items (1) to (12) without needing to confirm their qualifications under item 7 below, that bidder's bid will be invalidated. (3) If there are no bidders who have submitted bids excluding those invalidated under (2) above, the bidding will be considered unsuccessful. (4) In the first round of bidding, if there is one or more bidder who submitted a bid at or below the pre-tax acceptable price (hereinafter referred to as "valid bid") after excluding bids invalidated under (2), the determination of the successful bidder will be postponed, and if there are no valid bids, re-bidding will be conducted. (5) In the re-bidding, if there is one or more bidder who submitted a valid bid, the determination of the successful bidder will be postponed, and if there are no valid bids, the bidding will be considered unsuccessful. (6) If the determination of the successful bidder is postponed under (4) or (5) above, the bidder who submitted the lowest valid bid (hereinafter referred to as the "lowest bidder") will be subject to qualification confirmation (hereinafter referred to as "qualification confirmation") and will be designated as the "confirmed bidder". (7) When ranking valid bids based on (6) above, if two or more bidders have submitted the same bid amount (hereinafter referred to as "same amount bidders"), the order will be determined by electronic lottery. The lottery method is as follows: ① For each of the same amount bidders, assign numbers from 0 in the order of bid arrival (server reception time order in the Electronic Bidding System). ② For each of the same amount bidders, calculate the sum of the registered lottery number and the last three digits of the milliseconds of the server reception time (hereinafter referred to as "determined lottery number"). For written participants prescribed in 2(3), the lottery number will be the number entered on the bid form, and the arrival milliseconds will be the time when the bid price is registered in the Electronic Bidding System by the city official. ③ The number obtained by dividing the sum of the determined lottery numbers of the same amount bidders by the number of same amount bidders, and the number assigned in ①, will determine the first-ranked confirmed bidder. For other bidders, the order will be assigned sequentially from the number of the first-ranked confirmed bidder in increasing order, and after those are exhausted, the remaining bidders will be assigned in increasing order of their assigned numbers. (8) If an investigation is conducted based on a report of collusion, or if collusion is suspected, the bidding may be suspended, postponed, or the successful bidder determination may be postponed. (9) If it is determined that procedures using the Electronic Bidding System cannot be performed due to a failure in the city's computer or the Electronic Bidding System, the bidding may be postponed or suspended, or changed to postal bidding. (10) In addition to (9), if the Mayor deems it particularly necessary, the bidding may be postponed, suspended, or canceled. (11) If bidding is suspended or canceled based on (9) and (10), the bids, applications, and other documents submitted by the bidders for the relevant bid will be invalidated.
