26 Contract Security: The party intending to conclude the contract must pay contract security of an amount not less than 10/100 of the contract price or contract amount, or provide collateral in the form of securities or a guarantee from a bank, financial institution recognized as reliable by the Mayor, or a guarantee company (a guarantee company as defined in Article 2, Paragraph 4 of the Act on Guarantee Business for Advance Payment of Public Works) to guarantee the payment of damages arising from breach of obligation.
However, the security may be waived if any of the following apply:
① If a public works performance guarantee insurance contract is concluded to guarantee the performance of obligations under this contract.
② If a performance guarantee insurance contract is concluded to cover damages arising from breach of obligations under this contract.
