2. Qualifications Required to Participate in the Tender
(1) The applicant must possess tender participation qualifications based on Article 1 of the Regulations on Qualifications for Participation in Competitive Tenders for Procurement, Repair, Purchase, or Lease of Goods (Saga Prefecture Public Notice No. 129 of 1966) at the time of submission of the bid form.
(2) The applicant must not fall under the provisions of Article 167-4 of the Local Autonomy Act Enforcement Order (Cabinet Order No. 16 of 1947).
(3) The applicant must not be a company for which commencement of rehabilitation proceedings or commencement of civil rehabilitation proceedings has been filed under the Corporate Reorganization Act (Act No. 154 of 2002) or the Civil Rehabilitation Act (Act No. 225 of 1999).
(4) The applicant must not have had two or more dishonored checks or bills at a financial institution, etc., during the period from six months prior to the bid opening date to the bid opening date.
(5) The applicant must not be subject to a suspension of designation or a suspension of tender participation qualification measures for contracts ordered by Saga Prefecture.
(6) The applicant, its officers, etc., must not fall under any of the following, and persons listed in b through g below must not be substantially involved in its management.
a. Yakuza (Bōryokudan) (meaning the Bōryokudan as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Bōryokudan Members, etc. (Act No. 77 of 1991). The same applies hereinafter.)
b. Bōryokudan member (meaning a Bōryokudan member as defined in Article 2, Item 6 of the Act on Prevention of Unjust Acts by Bōryokudan Members, etc. The same applies hereinafter.)
c. A person who has not been a Bōryokudan member for less than five years.
d. A person who uses Bōryokudan or Bōryokudan members for the purpose of obtaining unjust profits for themselves, their company, or a third party, or for the purpose of causing damage to a third party.
e. A person who directly or actively cooperates with or is involved in the maintenance and operation of Bōryokudan by providing funds or benefits to Bōryokudan or Bōryokudan members.
f. A person who has a socially reprehensible relationship with Bōryokudan or Bōryokudan members.
g. A person who uses Bōryokudan or Bōryokudan members while knowing that they are Bōryokudan or Bōryokudan members.
(7) The applicant must have submitted a tender participation notification.
3. Method of Application to Obtain Tender Participation Qualifications
(1) Applicants who do not meet the qualifications in 2.(1) and wish to participate in the competitive tender must fill out the prescribed "Tender Participation Qualification Certification Application Form" with the necessary information and submit it in person by 12:00 PM on Monday, August 3, Reiwa 8.

4. Obligations Required of Tender Participants
Applicants wishing to participate in the tender must submit a "Tender Participation Notification" and "Business Overview" to the General Affairs Division, Saga Prefectural Ceramics Research Institute, by 5:00 PM on Monday, August 10, Reiwa 8 (must arrive by the same deadline), either in person or by mail. If you decide not to participate in the tender after submitting the "Tender Participation Notification," etc., please submit a withdrawal notification stating the reason in writing.

6. Other
(1) Bid Security and Contract Security
a. Bid Security: Exempt in accordance with Article 103, Paragraph 3, Item 2 of the Saga Prefecture Financial Regulations (Reiwa 4 Saga Prefecture Ordinance No. 35).
b. Contract Security: Exempt in accordance with Article 115, Paragraph 3, Item 3 of the Saga Prefecture Financial Regulations.
(2) Invalid Bids: Bids submitted by any of the following shall be invalid.
a. A person who does not have the qualifications to participate.
b. A person who has committed fraudulent acts in the tender.
c. A bid form with omissions or illegible entries in the amount or name.
d. A bid form with entries made in a way that can be easily erased.
e. A bid form with a corrected amount.
f. A bid form with unclear intent due to typos or omissions.
g. A bid form that can be revoked under Article 95 (Mistake) of the Civil Code (Act No. 89 of 1896).
h. A person who submitted two or more bids.
i. An agent who does not have the necessary qualifications.
j. In addition to the above, any person who violates the conditions of the tender.
(3) Suspension of Bidding: Bidding will be suspended if any of the following occur. Any damages incurred in such cases shall be borne by the tender participants.
a. When it is determined that fair execution of bidding is impossible due to collusion among tender participants or disturbances.
b. When bidding or bid opening cannot be conducted due to natural disasters or other unavoidable reasons.
(4) Requirement for Contract Creation: Yes.
(5) Method of Determining the Successful Bidder: The bidder who submitted the lowest valid bid within the limit of the planned price will be the successful candidate. Immediately thereafter, their tender participation qualifications will be confirmed, and if they possess the qualifications, they will be declared the successful bidder.
a. If the successful candidate does not possess tender participation qualifications, the next highest bidder will be considered the successful candidate, and the confirmation process will be repeated until a successful bidder is determined.
b. If there are two or more bidders who submitted the same lowest bid price, lots will be drawn immediately to determine the successful bidder. In this case, if any of these bidders are absent or refuse to draw lots, an official not involved in the tender execution procedures will draw lots on their behalf.
c. If there is no successful bidder after the first bid opening, a second bid will be held immediately (limited to two times including the first bid).
