We hereby announce a conditional general competitive bidding as follows, in accordance with Article 167-6, Paragraph 1 of the Local Autonomy Act (Cabinet Order No. 16 of 1947) and Article 3 of the Kumamoto City Contract Administration Regulations (Showa 39, Ordinance No. 7), as applied mutatis mutandis by Article 2 of the Kumamoto City Water and Sewerage Bureau Contract Administration Rules (Heisei 24, Bureau Ordinance No. 8; hereinafter referred to as 'Rules'). Matters for Competitive Bidding: (1) Service Contract Name: Asbestos Content Analysis and Other Services for Kumamoto City Water Facilities (Unit Price Contract). (2) Purpose and Outline: In response to the legal requirement for pre-investigation and analysis of asbestos-containing materials due to the partial amendment of the Air Pollution Control Act in June 2020, a unit price contract will be implemented to conduct analysis surveys for renovation work, etc., of Kumamoto City water facility buildings. (3) Performance Location: Within Kumamoto City. (4) Performance Period: From the contract date until February 26, Reiwa 9 (2027). 2. Type of Bidding Procedure: This project will be conducted using a method where qualifications required for participants in conditional general competitive bidding (hereinafter referred to as 'Competitive Bidding Qualifications') are confirmed before bidding, and the successful bidder is determined based on the results of bids submitted by those recognized as having Competitive Bidding Qualifications. 4. Competitive Bidding Qualifications: All of the following conditions must be met. (1) The applicant must have submitted the Kumamoto City Service Contract, etc., Competitive Bidding Participation Qualification Review Application Form and be registered in the list of participants stipulated in Article 5 of the Kumamoto City Service Contract, etc., Competitive Bidding Participant Qualifications, etc., Guidelines (Heisei 20, Notice No. 731), OR be registered in the list of participants stipulated in Article 7 of the Kumamoto City Water and Sewerage Bureau Service Contract, etc., Competitive Bidding Participant Qualifications, etc., Guidelines, AND be registered under the industry category "(⑥-7) Other Inspection Services". (2) The applicant must not fall under any of the provisions of Article 167-4, Paragraph 1 of the Local Autonomy Act. (3) If an application for commencement of rehabilitation proceedings under Article 17 of the Corporate Reorganization Act (Law No. 154 of 2002) or an application for commencement of rehabilitation proceedings under Article 21 of the Civil Rehabilitation Act (Law No. 225 of 2011) has been filed, a decision approving the rehabilitation plan or reconstruction plan must have been made, respectively. (4) The applicant must not fall under the provisions of Article 3, Item 1 of the Kumamoto City Guidelines for Exclusion of Violence Groups, etc., from Contracts Concluded by Kumamoto City (Heisei 18, Notice No. 105) and Article 3, Item 1 of the Kumamoto City Water and Sewerage Bureau Guidelines for Exclusion of Violence Groups, etc., from Contracts Concluded by the Bureau. (5) The applicant must not be within the period of bid suspension under the Kumamoto City Guidelines for Measures such as Suspension of Designation for Purchase Contracts and Service Contracts, etc., Concluded by Kumamoto City (Heisei 21, Notice No. 199) or the Kumamoto City Water and Sewerage Bureau Guidelines for Measures such as Suspension of Designation for Purchase Contracts and Service Contracts, etc. (hereinafter referred to as 'Suspension Guidelines'). (6) The applicant must not be in arrears of consumption tax, local consumption tax, or city taxes. (7) The applicant must be engaged in the business related to the contract subject to this competitive bidding as a profession. (8) The applicant must not be deemed unsuitable as a contract counterparty by the Kumamoto City Water and Sewerage Business Administrator (hereinafter referred to as 'Administrator') due to violations or dishonest conduct in contracts with the city within the past 3 years. (9) The applicant must comply with the Kumamoto City Public Contract Ordinance (Reiwa 7, Ordinance No. 54), such as by submitting a pledge of compliance based on Article 8 of the ordinance. (10) The applicant must not be in arrears of Kumamoto City water charges and Kumamoto City sewage usage fees. (11) The applicant must have a head office or branch office, etc., within Kumamoto City. (12) The applicant must have experience in asbestos analysis services, as a direct contractor, for national or local governments, with work completed since fiscal year 2016 (Heisei 28). (13) If a business cooperative (as defined in Article 3 of the Small and Medium Enterprise Cooperative Act (Law No. 181 of 1949); hereinafter the same) submits a competitive bidding participation qualification review application form, its members cannot submit a competitive bidding participation qualification review application form as individual entities. If participating as a business cooperative, the member responsible for the work must also meet all requirements of (5), (8) through (12). 5. Application Procedures, etc.: (1) Application Form, Specifications, etc., Distribution Period and Method: From July 17, Reiwa 8 (Friday) to July 31, Reiwa 8 (Friday). Available for download on the Kumamoto City website and the Kumamoto City Water and Sewerage Bureau website. Also available for distribution at the department in charge (item 2) upon request (excluding city holidays as defined in Article 1 of the Kumamoto City Ordinance on Special Provisions for Holidays and Deadlines (Heisei 1, Ordinance No. 32)). Distribution by mail or electronic transmission (fax, email, etc.) is not provided. Distribution at the department in charge is from 9:00 AM to 5:00 PM. Furthermore, if the submitted documents in (a)(e) do not allow for confirmation of similar service experience, the applicant will not be recognized as having the experience. (c) When participating as a business cooperative, also fill in the section for "Name of Member Responsible for Work" in Form No. 2 (Competitive Bidding Participation Qualification Review Sheet). If it is difficult to identify the member responsible for the work, multiple candidate member names may be listed. In this case, if even one member does not meet the requirements stipulated in 4(13), the applicant will be deemed to not have Competitive Bidding Qualifications. (3) Confirmation of Competitive Bidding Qualifications: Confirmation of Competitive Bidding Qualifications will be made as of the deadline for submitting application forms, etc. The results (including reasons if deemed not to have Competitive Bidding Qualifications) will be notified in writing. 6. Explanation of Reasons for Those Deemed Not to Have Competitive Bidding Qualifications: (1) Those who receive notification of not having Competitive Bidding Qualifications may request an explanation of the reasons in writing (free format) to the Administrator within 7 days (excluding holidays) from the day after the notification date. (2) When an explanation is requested, the Administrator will respond in writing to the requester within 5 days (excluding holidays) from the day after the final day for requesting the explanation. 7. Bidding Briefing Session: Not conducted. 8. Questions Regarding Specifications, etc.: (1) If there are questions regarding specifications, etc., submit a question form as follows: a. Measures When There is Only One Bidder: If there is only one bidder, a new announcement will be made and the submission deadline for application forms, etc., will be extended. In this case, the competitive bidding qualifications or performance period for the project may be changed as necessary. 10. Bidding and Bid Opening, etc.: (1) Those confirmed to have Competitive Bidding Qualifications by the notification in 5(3) shall participate in the bidding according to the following method. Submit in person or by mail. Submission by electronic transmission (fax, email, etc.) is not accepted. If a bid agent submits in person, a power of attorney must be submitted separately. If submitting by mail, use a method that leaves a delivery record, such as general registered mail or certified mail. Mail sent by methods that do not provide a delivery record will not be accepted. a. In Person: (a) Bid Date and Time: 11:00 AM on August 26, Reiwa 8 (Wednesday). (b) Bid Location: Kumamoto City Water and Sewerage Bureau, Annex 1F, Bidding Room, 6-2-45 Suizenji, Chuo Ward, Kumamoto City. b. By Mail: (a) Submission Deadline: Must arrive by August 25, Reiwa 8 (Tuesday). Loss or delay due to unforeseen accidents will not be considered. (b) Sending Method: The bid form shall be in a double envelope (inner and outer). Place the bid form in the inner envelope, seal it, write "Bid Form", "Service Contract Name", "Bid Opening Date and Time", and "Bidder Name" on it, and place it in the outer envelope. Write "Bid Form Enclosed", "Service Contract Name", "Bidder Name", and "Personal" on the outer envelope and send it to the following address. If a re-bid is anticipated, place the re-bid form and the third re-bid form (only if a third bid is anticipated) in separate inner envelopes, seal them, write "Service Contract Name" and "Bidder Name" on them, and enclose them in the outer envelope marked "Re-bid Form Enclosed" (or "Third Re-bid Form Enclosed"). (2) The bid amount shall be the unit price per sample for asbestos content analysis costs [including qualitative analysis (JIS A 1481-1), sample collection, and report preparation costs]. For the determination of the contract unit price, the amount obtained by adding 10% of the amount stated in the bid form to that amount (if there is a fraction of less than 1 yen, that fraction will be rounded down) will be the contract unit price. Therefore, bidders, regardless of whether they are taxable or exempt from consumption tax and local consumption tax, must write the amount equivalent to 110/100 of the estimated contract unit price in the bid form. (3) The number of bid execution rounds will be up to 3 (subsequent rounds will be conducted consecutively). If a re-bid form is not submitted, the bidder will be deemed to have withdrawn from the re-bid (the same applies to a third re-bid). (4) After submitting the bid form, it cannot be exchanged or canceled, regardless of whether it is before or after the bid opening. (5) If it is recognized that one bidder has made multiple bids, the bids will be opened once for confirmation, and all bid forms will be invalidated. (6) In addition to Article 7 of the Kumamoto City Construction Competitive Bidding Rules (Heisei 2, Notice No. 107), bids submitted with false information in the application forms, etc., will be invalidated, and if the successful bidder was one who submitted an invalid bid, the successful bid determination will be canceled. Furthermore, even if confirmed to have Competitive Bidding Qualifications, if the applicant no longer meets the Competitive Bidding Qualifications stipulated in 4 at the time of successful bid determination, they will be deemed to not have Competitive Bidding Qualifications. (7) Invalid bid forms will not be returned. (8) The bid forms will be opened immediately after the bidding at 11:00 AM on August 26, Reiwa 8 (Wednesday). In this case, if the bidder is not present at the bid opening, an official not involved in the bidding procedures will be present. 11. Method of Determining the Successful Bidder: (1) The bidder who submits the lowest price within the limit of the estimated price will be the successful bidder. (2) If there are two or more bidders who submit the same lowest price, the successful bidder will be determined by lottery. (3) Minimum reserve price is not set.
