(3) Have obtained a construction business permit in accordance with the provisions of Article 3 of the Construction Business Act (1947, Act No. 100) (in the construction business types and permit classifications indicated in the Order Outline). (4) Have undergone a business performance evaluation in accordance with the provisions of Article 27-23 of the Construction Business Act on or after the business year end immediately preceding the date one year and seven months prior to the contract signing date, for the construction business types indicated in the Order Outline. (5) Not have been subject to a bid suspension measure by Kazuno City from the deadline for submission of the competitive bidding qualification confirmation application form to the bid award decision date. (6) Have a business office in the location indicated in the Order Outline among the business offices prescribed by Article 3 of the Construction Business Act. (7) The supervisory engineer or chief engineer (hereinafter referred to as "supervisory engineer, etc.") to be assigned to this construction must be assigned as follows: ① When a full-time supervisory engineer, etc. is required by the Order Outline: Must be able to assign full-time a person who meets the qualifications of the planned engineer indicated in the Order Outline (limited to those who have had a direct and continuous employment relationship with the bidder for three months or more prior to the deadline for the bid qualification confirmation application. Furthermore, such person must not be a so-called manager responsible for business operations as prescribed in Article 7, Item 1 or Article 15, Item 1 of the Construction Business Act, or a full-time engineer at a business office as prescribed in Article 7, Item 2 or Article 15, Item 2 (regardless of the permitted business type)). ② When a chief engineer not requiring full-time assignment is required by the Order Outline: Must be able to assign as the chief engineer for this construction a person who has had a direct and continuous employment relationship with the bidder for three months or more prior to the bid qualification confirmation application date. (However, this excludes persons assigned full-time or on-site to other construction projects during the contract period of this construction.) (8) Not be a party for whom a petition for commencement of rehabilitation proceedings under the Corporate Reorganization Act (2002, Act No. 154) or a petition for commencement of civil rehabilitation proceedings under the Civil Rehabilitation Act (1999, Act No. 225) has been filed (excluding those for whom a decision to commence proceedings has been made). (9) Regarding organized crime groups, must not fall under any of the following: ① Being recognized as an organized crime group as defined in Article 2, Item 2 of the Act on Prevention of Unjustifiable Acts by Organized Crime Group Members (1991, Act No. 77; hereinafter referred to as "Organized Crime Group Act"). ② Being recognized as an organized crime group member as defined in Article 2, Item 6 of the Organized Crime Group Act (hereinafter referred to as "organized crime group member"). ③ Being recognized as using an organized crime group or organized crime group member for the purpose of obtaining unjust profits for oneself, one's company, or a third party, or for the purpose of causing damage to a third party. ④ Being recognized as cooperating with or being involved in the maintenance or operation of an organized crime group, directly or actively, by providing funds or benefits to an organized crime group or organized crime group member. ⑤ Being recognized as having a socially reprehensible relationship with an organized crime group or organized crime group member. ⑥ Being recognized as unfairly utilizing an organized crime group, an organized crime group member, or a person falling under any of items (3) to (5) while knowing that they are such. (12) Other bidding qualification requirements are as described in the Order Outline. 4. Bid Qualification Confirmation Application, etc. (1) Distribution of necessary documents for bid application: Check the Kazuno City website or the electronic bidding system. (2) Submission of bid qualification application form: Bidders wishing to participate in the bidding must submit the competitive bidding qualification confirmation application form and bid qualification confirmation documents to the Contract and Inspection Office via the electronic bidding system by the deadline indicated in the Order Outline. (3) Confirmation of bid qualification: Confirmation of bid qualification will be conducted after the bid opening, in principle, for bidders who need to be confirmed to be the successful bidder (hereinafter referred to as "successful bidder candidates"); confirmation will not be conducted for others. (4) Withdrawal from bidding: A bidder who has submitted a bid qualification confirmation application form and subsequently becomes ineligible to bid before the successful bidder is determined must promptly submit a bid withdrawal notice before the bid opening, or a notice to that effect after the bid opening. (5) Inspection and borrowing of design documents, etc.: ① The method of inspection and borrowing of design documents, specifications, drawings, etc. (hereinafter referred to as "design documents, etc.") related to this construction shall be in accordance with the provisions of the "Handling Procedures for Inspection and Borrowing of Design Documents, etc." (2015, Administrative Order No. 102). ② The period for inspection, etc. shall be as indicated in the Order Outline. (6) Questions and answers regarding design documents, etc.: The method for questions and answers regarding design documents, etc. shall be in accordance with the provisions of the "Handling Procedures for Inspection and Borrowing of Design Documents, etc." (2015, Administrative Order No. 102), and the deadline for questions and answers shall be as indicated in the Order Outline. (2) Contract deposit: Not less than 1/10 of the contract amount. (However, for construction projects with a design cost of less than 5 million yen, the contract deposit is generally waived.) The method of payment, etc. shall be in accordance with the provisions of the Kazuno City Financial Regulations (1999, Kazuno City Ordinance No. 12; hereinafter referred to as "Financial Regulations"). 6. Bid Execution Location, Date and Time, and Submission of Bids, etc. (1) Submission method: Submit via the electronic bidding system by the deadline indicated in the Order Outline. However, those who have difficulty using the electronic bidding system (limited to cases approved by the bid executor in accordance with Article 8 or Article 9 of the Kazuno City Public Works Electronic Bidding Operation Standards) may use the paper bidding method. (2) Amount to be stated on the bid form: ① For bid award determination, the contract amount will be the amount stated on the bid form plus 10% of that amount. Therefore, bidders must state the amount equivalent to 100/110 of their estimated desired contract amount, regardless of whether they are a taxable or non-taxable business with respect to consumption tax. ② The bid amount shall be in units of one thousand yen. (3) Submission of bid breakdown: For bids where the estimated price is publicly announced in advance or announced afterward, a bid breakdown corresponding to the amount stated on the first bid form must be submitted. Method of Determining the Successful Bidder (1) The bidder who submitted a bid within the limit of the estimated price (or, if a minimum reserve price is set, the bidder who submitted a bid at or above the minimum reserve price within the limit of the estimated price) and has the lowest bid price will be the successful bidder candidate. In this case, if there are two or more bidders with the lowest bid price, the order will be determined by drawing lots, and the top-ranked bidder will be the successful bidder candidate. (2) After confirming the bid qualification of the successful bidder candidate in (1), if the qualifications are confirmed and the bidder does not fall under any of the following, the successful bidder candidate will be the successful bidder. ① When it is recognized that the contract cannot be performed in accordance with its terms due to the bid price of the successful bidder candidate. ② When it is recognized that concluding a contract with the successful bidder candidate would disrupt the order of fair trade and is significantly inappropriate. (3) If a successful bidder is not determined under (2), the bidder who submitted a bid within the limit of the estimated price (or, if a minimum reserve price is set, the bidder who submitted a bid at or above the minimum reserve price within the limit of the estimated price) and has the next lowest bid price after the successful bidder candidate (if there are two or more such bidders, the top-ranked bidder will be determined by the method described in the latter part of (1). (7) In the case of bids subject to the low bid price investigation system, if the lowest bidder's bid price falls below the investigation standard price, the successful bidder candidate (if there are two or more, the top-ranked bidder determined by drawing lots) will have their bid qualification confirmed in accordance with the "Kazuno City Low Bid Price Investigation System Implementation Guidelines" (2001, Kazuno City Administrative Order No. 31) and the "Kazuno City Low Bid Price System Operation Manual" (2001, Kazuno City Administrative Order No. 32). If the qualifications are confirmed, the successful bidder candidate will be the successful bidder. Furthermore, if the successful bidder candidate is determined to be unqualified, the provisions of (5) and (6) shall apply. 8. Invalid Bids Bids falling under any of the following categories shall be deemed invalid: (1) Bids submitted by persons who do not have the right to participate in the competition (persons other than those who have obtained the right to participate in the bidding). (2) Bids submitted by persons who have not paid or provided security in lieu of the prescribed bid bond (excluding those who have been exempted from the entire bid bond). (3) Bids lacking the name and seal. (4) Bids with altered amounts. (5) Bids where the intention is unclear due to misspellings, omissions, etc. (6) Bids that are clearly deemed to be collusive. (7) In bids where the estimated price is publicly announced in advance, bids with an amount exceeding the estimated price. (8) In bids where a minimum reserve price is applied, bids with an amount below the minimum reserve price. (9) Other bids that violate the conditions related to bidding. 9. Assigned Planned Engineers (When Full-time Assignment of Supervisory Engineers, etc. is Required) (1) The successful bidder must assign the planned engineer(s) stated in the bid qualification confirmation application form, etc. to the site of the construction. (2) If a bidder becomes unable to assign the planned engineer(s) stated in the bid qualification confirmation application form, etc. due to having been awarded another contract, they must promptly report this to the contracting authority. (3) If a bidder who has been awarded a contract becomes unable to assign an engineer to this construction, their bid shall be deemed invalid. 10. Other (1) When registering to participate in bids with the city, if you have delegated bidding/contracting authority to a branch office, etc., please apply from the delegated branch office, not the head office/main office. If the delegated office has difficulty bidding electronically and the head office/main office will bid, please submit an electronic bidding power of attorney. (2) Bid explanation meetings and site explanation meetings will not be held. (3) Hearings regarding bid qualification will not be held. However, explanations may be requested if deemed necessary. (4) The completion deadline may be changed due to circumstances. (5) Bidders must be thoroughly familiar with the design documents, etc., and must comply with the bidding instructions and points to note when bidding. (6) When the low bid price investigation system is applied according to the Order Outline, the operation of the system shall be in accordance with the "Kazuno City Low Bid Price Investigation System Implementation Guidelines" (2001, Kazuno City Administrative Order No. 31) and the "Kazuno City Low Bid Price System Operation Manual" (2001, Kazuno City Administrative Order No. 32), as well as the following: ① Bidders must cooperate with the smooth implementation of the investigation if they are subject to the low bid price investigation. ② When a contract is concluded after a low bid price investigation, and the work is subcontracted, consideration must be given to ensure that the low price received does not lead to undue burden on the subcontractor. (7) When the minimum reserve price system is applied according to the Order Outline, the operation of the system shall be in accordance with the "Kazuno City Construction Minimum Reserve Price System Implementation Guidelines" (2009, Kazuno City Administrative Order No. 82). (8) The date of the successful bid decision may be changed due to circumstances. (9) If the successful bidder fails to meet the requirements listed in 3 from the date of the successful bid decision to the date of contract conclusion, the contracting authority may not conclude the contract with the successful bidder. (10) If the successful bidder does not conclude the contract (or provisional contract for contracts requiring the approval of the assembly as stipulated in Article 121 of the Financial Regulations) within five days from the date of the successful bid decision, the successful bid shall lose its validity. However, if there are unavoidable circumstances that prevent the conclusion of the contract, this period may be extended with the prior consent of the contracting authority. (11) Matters not stipulated in this announcement shall be governed by the Local Autonomy Act, the Local Autonomy Act Enforcement Regulations, the Local Autonomy Act Enforcement Rules, the Kazuno City Financial Regulations, and the Kazuno City Procedures for Competitive Bidding, etc.
