CONSTRUCTION CONTRACT AGREEMENT Project Name: Nara Women's University (Kita-Uoya) Lifeline Regeneration (Transformation Substation Equipment) Renovation Work Contract Amount: JPY (including JPY for consumption tax and local consumption tax) Employer: National University Corporation Nara National University Organization, President: Hiroyuki Sakaki, and Contractor: , hereby conclude a contract for the above construction work at the above contract amount, and shall perform it faithfully in accordance with the following terms and conditions.
Article 1: The contractor shall complete the work based on the attached design documents.
Article 2: The work shall be carried out at Kita-Uoya Nishi-machi, Nara City, Nara Prefecture (within the Nara Women's University Kita-Uoya Housing Complex).
Article 3: The commencement date shall be Month Day, Reiwa 8.
Article 4: The completion deadline shall be Friday, February 26, Reiwa 9.
Article 5: The security deposit shall be JPY . However, it may be substituted by the provision of securities or a guarantee from a financial institution or guarantee company. Furthermore, the security deposit will be waived if a performance guarantee bond or a performance guarantee insurance contract is provided.
Article 6: The contractor shall conclude an assembly insurance contract for the work and materials.
Article 7: The contract price (including advance payment and interim advance payment) shall be paid within 3 installments upon the contractor's valid request.
Article 8: An advance payment of up to JPY shall be made. This payment shall be made within 14 days from the date of receipt of the invoice and the guarantee company's guarantee certificate.
Article 9: An interim advance payment of up to JPY shall be made. This payment shall be made within 14 days from the date of receipt of the invoice and the guarantee company's guarantee certificate.
Article 10: Invoices for the contract price (including advance payment and interim advance payment) shall be sent to the Facilities Division of the National University Corporation Nara National University Organization.
Article 11: The completion notice shall be sent to the Facilities Division of the National University Corporation Nara National University Organization.
Article 12: Article 37 of the attached Nara National University Organization Construction Contract Standards shall be read as follows.
Article 37: The contractor shall not use the advance payment for any payments other than necessary expenses related to material costs, labor costs, equipment rental fees, equipment purchase costs (limited to the amount corresponding to depreciation for this work), power costs, shipping costs, repair costs, temporary construction costs, workers' accident compensation insurance premiums, and guarantee fees for this work. However, for advance payments for work for which a new contract is concluded on or after April 1, Reiwa 28, advance payments exceeding 25/100, excluding interim advance payments, may be used for payments related to site management costs and general administrative costs, etc., for this work.
Article 13: General provisions concerning this contract shall be in accordance with the attached Construction Contract Standards.

(Scope of Application) Article 2: The handling of contract administration by the Organization shall be governed by these regulations, in addition to laws and regulations and other rules.
(Scope of Contracts that Budget Responsibility Officers Can Conclude) Article 3: The scope of contracts that budget responsibility officers, as defined in Article 3, Paragraph 3 of the National University Corporation Nara National University Organization Budget Regulations, can conclude is limited to the purchase of goods such as books and consumables where the contract amount is less than JPY 1 million and the price per item is less than JPY 500,000, and service contracts where the contract amount is less than JPY 500,000 (excluding service acts handled by the Facilities Division).
2. Budget responsibility officers shall comply with these regulations and other related regulations stipulated by the Organization.
(Execution of Contracts) Article 4: Contracts shall be concluded by the President. However, the authority to conclude certain contracts may be delegated to other officers and employees (hereinafter referred to as "officers and employees").
2. The officers and employees to whom delegation may be made and the scope of contracts shall be determined separately.
(Establishment of Committees) Article 5: The following committees shall be established as necessary to handle contract administration.
(1) Specification Development Committee for developing specifications for the procurement of large-scale equipment, etc. (2) Model Selection Committee when model selection is necessary for procurement contracts for goods. (3) Contract Review Committee for reviewing important matters related to contracts. (4) Other committees deemed necessary by the President. 2. The duties, composition, and other necessary matters of the committees prescribed in the preceding paragraph shall be determined separately.
Chapter 2 Qualifications of Competitive Bidders (Qualifications of Competitive Bidders) Article 6: The qualifications of persons wishing to participate in competition as defined in Article 32, Paragraph 2 of the Accounting Regulations shall be applied mutatis mutandis to the unified qualifications of all ministries and agencies of the national government (qualifications for competitive participation, etc., of the Ministry of Education, Culture, Sports, Science and Technology).
However, for construction contracts, the general competitive (designated competitive) participation qualifications for construction work and the general competitive (designated competitive) participation qualifications for design and consulting services of the Ministry of Education, Culture, Sports, Science and Technology shall be applied mutatis mutandis.
2. When conducting general competitive bidding based on the classification of general competitive bidders' qualifications in the preceding paragraph (grades based on contract type, range of estimated prices for participation in competition, etc.), if it is recognized that the number of bidders with qualifications in that grade is scarce, bidders with qualifications in the grade one or two levels higher, or one level lower than the grade of qualifications for construction work may be added.
3. The provisions of the preceding two paragraphs shall apply mutatis mutandis to the qualifications of participants in designated competitive bidding.
(Persons Who Cannot Participate in Competition) Article 7: When conducting general competitive bidding for sales, leases, contracts, and other contracts as stipulated in Article 37 of the Accounting Regulations, the following persons cannot participate in the competition.
(1) Minors, persons under guardianship, persons under assistance, and persons under adult guardianship (excluding those who have obtained consent necessary for contract conclusion).
(2) Bankrupt persons who have not had their rights restored. (Persons Who May Not Be Allowed to Participate in Competition) Article 8: Persons falling under any of the following categories may be prohibited from participating in competition for a period not exceeding two years. The same shall apply to persons who employ such persons as agents, managers, or other employees.
(1) When intentionally performing work or manufacturing in a shoddy manner, or engaging in fraudulent acts regarding the quality or quantity of goods during contract performance.
(2) When obstructing fair competition, or colluding to harm fair prices or obtain unjust profits.
(3) When preventing a successful bidder from concluding a contract or a contractor from performing a contract.
(4) When obstructing the execution of duties by staff during supervision or inspection.
(5) When failing to perform a contract without justifiable reason.
(6) When employing a person who is prohibited from participating in competition under the provisions of this paragraph (excluding item (5)) as an agent, manager, or other employee during contract conclusion or performance.
2. Persons who employ individuals falling under the provisions of the preceding paragraph as bidding agents may be prohibited from participating in competition.
Chapter 3 Public Notice, etc., and Competitive Bidding (Public Notice of Bidding) Article 9: When intending to conduct general competitive bidding as stipulated in Article 37, Paragraph 1 of the Accounting Regulations by means of bidding, public notice shall be given by posting or other means at least 10 days prior to the bidding date. However, if urgent, the period may be shortened to 5 days.
(Matters to be Announced in Bidding) Article 10: The public notice provided for in the preceding article shall be for the following matters.
(1) Matters concerning competitive tender (2) Matters concerning qualifications required for competitive bidders (3) Location where contract terms are available (4) Location and date of bid execution (5) Matters concerning bid bond and security deposit (6) Other necessary matters. 2. The public notice shall clearly state that bids submitted by persons who do not meet the qualifications required for competitive bidding as specified in item (2) of the preceding paragraph, or bids that violate the conditions related to bidding, will be considered invalid.
(Notification of Designation in Designated Competitive Bidding) Article 11: When conducting designated competitive bidding, the matters listed in Article 10, Paragraph 1, items (1) and (3) to (6) shall be notified in writing to the designated persons.
2. The provisions of the preceding paragraph shall apply mutatis mutandis to the notification of designation in the preceding paragraph.
(Bid Bond) Article 12: When intending to conduct competitive bidding, participants shall be required to deposit a bid bond of at least 5/100 of their estimated contract amount.
2. The deposit of the bid bond in the preceding paragraph shall be made by transferring funds to a financial institution designated by the Organization by a date determined separately.
(Waiver of Bid Bond) Article 13: In the following cases, the bid bond may be waived in whole or in part, notwithstanding the provisions of the preceding article.
(1) When the competitive bidder has concluded a bid bond insurance contract with an insurance company, etc., in which the Organization is the insured.
(2) When it is recognized that there is no risk of the bidder failing to conclude a contract, and the bidder meets the qualifications specified in Article 6.
(Bid Explanation Meeting) Article 14: If it is deemed necessary to provide supplementary explanations for matters that are difficult to describe in writing, such as the contract details and bidding conditions indicated in the public notice, designation notice (hereinafter referred to as "public notice, etc.") and tender documents, or matters that may cause errors, a bid explanation meeting may be held.
(Preparation of Estimated Price) Article 15: When intending to conduct competitive bidding, the estimated price shall be prepared in writing (hereinafter referred to as "estimated price document") based on the specifications, design documents, etc., of the matter for which the contract is to be concluded.
2. The estimated price document shall be sealed and placed at the bid opening location at the time of opening the bids.
(Method of Determining Estimated Price) Article 16: The estimated price shall be determined for the total price of the matters to be put out for competitive bidding. However, for contracts involving continuous manufacturing, repair, processing, sales, supply, use, etc., for a certain period, the estimated price may be determined on a unit price basis.
2. The estimated price shall be determined appropriately by considering the actual market price, demand, difficulty of performance, quantity, duration of performance, etc., for the goods or services that are the object of the contract.
(Execution of Bids) Article 17: When executing competitive bidding, bid forms containing the following matters shall be submitted by the competitive bidder or their agent (hereinafter referred to as "competitive bidder, etc.").
(1) Project name (2) Bid amount (3) Address, name, and seal of the competitive bidder (for a corporation, its name or trade name and the name of its representative) and seal. (4) If an agent is bidding, the address, name, and seal of the competitive bidder (for a corporation, its name or trade name and the name of its representative), indication that the person is an agent, and the name and seal of the agent. (Prohibition of Bid Withdrawal, etc.) Article 18: When executing a bid, competitive bidders or their agents shall not be allowed to withdraw, change, or cancel their submitted bid forms.
(Correction of Bid Forms) Article 19: Prior to the bid, competitive bidders, etc., must be informed that any corrections made to the matters entered in the bid form must be initialed by the competitive bidder, etc.
(Bidding by Agent) Article 20: When an agent bids, a power of attorney must be submitted by the competitive bidder, etc., in advance.
(Opening of Bids) Article 21: Bids shall be opened in the presence of competitive bidders, etc., at the location and date of bid execution indicated in the public notice, etc.
If competitive bidders, etc., are not present, staff not involved in the bid execution shall be present.
(Restrictions on Entry and Exit from Bid Room) Article 22: Persons other than competitive bidders, etc., staff involved in bid execution (hereinafter referred to as "bid-related staff"), and staff present as stipulated in the preceding article shall not be allowed to enter the bid room.
2. After the commencement of bidding, competitive bidders, etc., shall not be allowed to enter the bid room.
3. Except in cases deemed absolutely necessary, persons who have entered shall not be allowed to leave.
