(4) For the permitted business category specified in the Tender Outline, the business year ending after the day immediately following the end of the business year 1 year and 7 months prior to the contract conclusion date must have undergone a management performance review in accordance with Article 27-23 of the Construction Industry Act. (5) Must not be subject to a suspension of bidding by Kazuno City from the submission deadline of the application for confirmation of bidding eligibility to the bid award date. (6) Must have a business office in the location specified in the Tender Outline among the business offices prescribed by Article 3 of the Construction Industry Act. (7) The supervising engineer or chief engineer (hereinafter referred to as "supervising engineer, etc.") to be assigned to this work must be assigned as follows: ① When a専任 (full-time) supervising engineer, etc. is required by the Tender Outline: Must be able to assign a person with the qualifications of the planned engineer specified in the Tender Outline (limited to those who have had a direct and continuous employment relationship of 3 months or more with the bidder prior to the deadline for application for confirmation of bidding eligibility. Application for Bidding Eligibility, etc. (1) Distribution of materials required for bidding application: Check the Kazuno City website or the electronic bidding system. (2) Submission of application for bidding eligibility: Those who wish to participate in the bidding must submit the application for confirmation of competitive bidding eligibility and the confirmation documents for bidding eligibility to the Contract and Examination Office via the electronic bidding system by the deadline specified in the Tender Outline. (3) Confirmation of bidding eligibility: Confirmation of bidding eligibility will be conducted after the bid opening, in principle, for bidders who need to be confirmed to be the successful bidder (hereinafter referred to as "successful bidder candidates"). Confirmation will not be made for others. (4) Withdrawal from bidding: If a bidder who has submitted an application for confirmation of bidding eligibility subsequently becomes ineligible to participate in the bidding before the successful bidder is determined, they must promptly submit a withdrawal notice before the bid opening, or a notification stating such after the bid opening. 3 (5) Inspection, etc. of design documents: ① The method for inspecting and borrowing design documents, specifications, drawings, etc. (hereinafter referred to as "design documents, etc.") for this work shall be in accordance with the "Handling Procedures for Inspection, etc. of Design Documents, etc." (Reiwa 27 Kazuno City Administrative Notice No. 102). ② The period for inspection, etc. shall be as specified in the Tender Outline. Bid Security and Contract Security (1) Bid security is waived. (2) Contract security shall be an amount not less than 1/10 of the contract amount. (However, for works with a design cost of less than 5 million yen, contract security is generally waived.) The payment method, etc. shall be in accordance with the Kazuno City Financial Regulations (Heisei 11 Kazuno City Regulations No. 12; hereinafter referred to as "Financial Regulations"). 6. Place and Date of Bidding, and Submission of Bids, etc. (1) Submission method: Submit via the electronic bidding system by the deadline specified in the Tender Outline. However, those who have difficulty using the electronic bidding system (only when permitted by the bidding executive in accordance with Article 8 or Article 9 of the Kazuno City Public Works Electronic Bidding Operation Standards) may use the paper bidding method. (2) Amount to be entered on the bid form: ① When determining the successful bid, the contract amount will be the amount entered on the bid form plus 10% of that amount. Therefore, bidders, whether they are taxable or tax-exempt for consumption tax, must enter the amount equivalent to 100/110 of their estimated contract desired amount. ② The bid amount shall be in units of one thousand yen. (3) Submission of bid breakdown: For bids where the estimated price is publicly announced in advance or announced afterward, a bid breakdown corresponding to the amount entered on the first bid form must be submitted. Method of Determining the Successful Bidder 4 (1) The bidder who submitted a bid within the limit of the estimated price (if a minimum reserve price is set, the bidder who submitted a bid at or above the minimum reserve price) and whose bid price is the lowest will be the successful bidder candidate. In this case, if there are two or more bidders with the lowest bid price, the order will be determined by lot, and the highest-ranked bidder will be the successful bidder candidate. (2) After confirming the bidding eligibility of the successful bidder candidate in (1), if they are confirmed to be eligible and do not fall under any of the following, the successful bidder candidate will be the successful bidder. ① When it is recognized that the contract cannot be performed in accordance with its content due to the bid price of the successful bidder candidate. ② When it is recognized that it is significantly inappropriate to conclude a contract with the successful bidder candidate, as it would disrupt the order of fair trade. (3) If a successful bidder is not determined under (2), the bidder who submitted a bid within the limit of the estimated price (if a minimum reserve price is set, the bidder who submitted a bid at or above the minimum reserve price) and whose bid price is the next lowest after the successful bidder candidate (if there are two or more such bidders, the highest-ranked bidder will be determined by lot as described in the latter part of (1). (7) In the case of a bid to which the low bid price investigation system is applied, if the lowest bid price is below the investigation standard price, the successful bidder candidate (if there are two or more, the highest-ranked bidder determined by lot) will be confirmed for bidding eligibility, and if confirmed eligible, that successful bidder candidate will be the successful bidder, in accordance with the Kazuno City Low Bid Price Investigation System Implementation Guidelines (2001 Kazuno City Administrative Notice No. 31) and the Kazuno City Low Bid Price System Operation Manual (2001 Kazuno City Administrative Notice No. 32). If the successful bidder candidate is determined to be ineligible, the provisions of (5) and (6) shall apply. 8. Invalid Bids Any bid falling under any of the following shall be deemed invalid: (1) Bids submitted by persons ineligible to participate in the competition (persons other than those who have obtained the right to participate in the bidding). (2) Bids submitted by persons who have not paid or provided the prescribed bid security or collateral in lieu of bid security (excluding those for whom bid security is entirely waived). (3) Bids lacking the name and seal. (4) Bids with corrected amounts. (5) Bids where the intention is unclear due to misspellings, omissions, etc. (6) Bids that are clearly deemed to be collusive. (7) Bids that exceed the estimated price in the case of a bid where the estimated price is publicly announced in advance. 5 (8) Bids that are below the minimum reserve price in the case of a bid where the minimum reserve price is applied. (9) Other bids that violate the conditions related to bidding. 9. Assigned Engineer (When full-time assignment of supervising engineer, etc. is required) (1) The successful bidder must assign the planned engineer listed in the application for confirmation of bidding eligibility, etc. to the site of the said work. (2) If the bidder becomes unable to assign the planned engineer listed in the application for confirmation of bidding eligibility, etc. to this work due to being awarded another contract, they must promptly report this to the contracting authority. (3) If a bidder becomes unable to assign an engineer to this work and has already been awarded the contract, their bid shall be deemed invalid. 10. Other (1) When registering to participate in bids with the city, if you have delegated bidding/contracting authority to a branch or business office, please apply from the delegated branch/business office, not the head office/main branch. If the delegated party has difficulty with electronic bidding and the head office/main branch will bid, please submit an electronic bidding authorization form. (2) A briefing session for bidding and an on-site briefing session will not be held. (3) A hearing regarding eligibility for bidding will not be held. However, explanations may be requested if deemed necessary. (4) The completion deadline may be changed due to circumstances. (5) Bidders must be thoroughly familiar with the design documents, etc., and must comply with the bidding instructions and precautions for bidding. (6) If the low bid price investigation system is applied according to the Tender Outline, the operation of the system shall be in accordance with the Kazuno City Low Bid Price Investigation System Implementation Guidelines (2001 Kazuno City Administrative Notice No. 31) and the Kazuno City Low Bid Price System Operation Manual (2001 Kazuno City Administrative Notice No. 32), as well as the following: ① Bidders must cooperate with the smooth implementation of the low bid price investigation if they are subject to it. ② If a contract is concluded after a low bid price investigation, and subcontracting is involved, care must be taken to ensure that subcontractors are not unfairly burdened due to the low bid. (7) If the minimum reserve price system is applied according to the Tender Outline, the operation of the system shall be in accordance with the Kazuno City Construction Work Minimum Reserve Price System Implementation Guidelines (2009 Kazuno City Administrative Notice No. 82). (8) The successful bid award notification date may be changed due to circumstances. (9) If the successful bidder fails to meet the requirements listed in 3 between the successful bid award date and the contract conclusion date, the contracting authority may not conclude the contract with the successful bidder. (10) If the successful bidder does not conclude the contract (or provisional contract, for contracts requiring the approval of the assembly as stipulated in Article 121 of the Financial Regulations) within 5 days from the date of successful bid award, the successful bid shall lose its validity. However, the period may be extended with the prior consent of the contracting authority if there are unavoidable circumstances that prevent the conclusion of the contract. (11) Matters not stipulated in this announcement shall be governed by the Local Autonomy Act, the Local Autonomy Act Enforcement Order, the Local Autonomy Act Enforcement Regulations, the Kazuno City Financial Regulations, and the Kazuno City Competitive Bidding Procedures Manual.
