Construction Overview (1) Project Name: Tokorozawa Godo Chosha Elevator Renewal Construction (2) Project Location: 6-1-3 Namiki, Tokorozawa City, Saitama Prefecture, 359-0042 (3) Construction Details: Renewal of elevator control systems to enhance safety measures. (4) Construction Completion Deadline: To be determined by the Saitama Labor Bureau within the period up to Monday, March 29, Reiwa 9, in coordination with the site representative. (5) This project is subject to the "Law for Promotion of Sorted Demolition and Recycling of Construction Materials" (Law No. 104 of 2000), which mandates the sorted demolition and recycling of construction materials and specified construction waste. (6) This project will be conducted using the Government Electronic Procurement System for document submission, bidding, etc. However, those who find it difficult to use the Government Electronic Procurement System may apply for paper bidding with the approval of the authorized officer for expenditure. 2. Eligibility for Participation in Competition (1) Not subject to the provisions of Article 70 and Article 71 of the Order for the Execution of Orders concerning Budget, Settlement and Accounts (Imperial Ordinance No. 165 of 1947) (hereinafter referred to as "the Order"). (2) Must be rated "C" or "D" in the "Electrical Construction" category and have a valid "Kanto-Koshinetsu" region in the Reiwa 7/8 fiscal year general competitive bidding eligibility qualification for the Ministry of Health, Labour and Welfare. (For those for whom rehabilitation proceedings have been initiated based on the Corporate Rehabilitation Law (Law No. 154 of 2002) or for whom rehabilitation proceedings have been initiated based on the Civil Rehabilitation Law (Law No. 225 of 1999), re-certification of general competitive bidding eligibility must have been obtained in accordance with procedures separately determined by the Director of the Accounting Division, Minister's Secretariat, Ministry of Health, Labour and Welfare after the commencement of proceedings.) (5) Must be able to assign a chief engineer who meets the following criteria to this project: ① Meets the requirements of Article 26, Paragraph 1 of the Construction Industry Act (Law No. 100 of 1949). ② Has experience as the prime contractor in projects meeting the criteria specified in (4) above, completed and delivered since fiscal year 2006. (6) Must not be subject to a bid suspension order based on the "Procedures for Bid Suspension, etc. for Construction Contracts" issued by the Director of the Accounting Division, Minister's Secretariat, Ministry of Health, Labour and Welfare, during the period from the deadline for submission of the general competitive bidding eligibility application and confirmation documents to the bid opening. (7) There must be no relationship between bidders that falls under any of the following criteria (excluding cases where all parties falling under the criteria are members other than the representative of a joint venture). ① Capital relationship: In the case of two companies falling under any of the following. However, this excludes cases where a subsidiary or one of the subsidiaries is a company undergoing rehabilitation or reconstruction proceedings. (a) Parent-subsidiary relationship. (b) Relationship between subsidiaries with the same parent company. ② Personnel relationship: In the case of two companies falling under any of the following. However, (a) excludes cases where one of the companies is undergoing rehabilitation or reconstruction proceedings. (a) An officer of one company concurrently serves as an officer of the other company. (b) An officer of one company concurrently serves as a trustee of the other company. ③ Other: Cases where it is recognized that the fairness of bidding is hindered. Other cases where a capital or personnel relationship equivalent to the above (a) or (b) is recognized. (8) Must not be a construction company whose management is substantially controlled by a gangster or equivalent, and for which a request for exclusion from Ministry of Health, Labour and Welfare-ordered projects has been made by the police authorities, and such status continues. (4) The successful bidder shall be the one who submits the lowest valid bid within the limit of the estimated price established in accordance with Article 79 of the Order. However, if it is deemed that the contract cannot be performed satisfactorily by the lowest bidder, or if it is deemed significantly inappropriate to conclude a contract with the lowest bidder due to reasons that would disrupt fair trade, the bidder with the next lowest bid within the limit of the estimated price may be selected as the successful bidder.
