2. Considering the patients' need for such an assortment and the previous quantity of medical pharmaceutical preparations, medicinal, technical means, specialized nutrition: - Free provision of technical and other means to persons with disabilities (according to patients' IRP), children with disabilities (according to the conclusions of the regional LCC), who are residents of VMTG, and internally displaced persons registered with the department of social policy of the city council, as internally displaced persons, in accordance with their individual rehabilitation programs, provided for by Appendix 1 to the Procedure for providing persons with disabilities and children with disabilities with technical and other means, approved by the Resolution of the Cabinet of Ministers of Ukraine dated 03.12.2009 No. 1301 (as amended); - List of rare (orphan) diseases that lead to a shortened lifespan of patients or their disability and for which there are recognized treatment methods, approved by the order of the Ministry of Health of Ukraine dated 27.10.2014 No. 778 (as amended); - Specific expensive and life-saving food products for special dietary consumption in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated 31.03.2015 No. 160 "On approval of the Procedure for providing citizens suffering from rare (orphan) diseases with medicines and appropriate food products for special dietary consumption" (as amended), and the fact that according to paragraph 10 of the Specifics, Customers procure goods and services (except for current repair services, the subject of procurement of which is determined in accordance with paragraph 3 of section II "Procedure for determining the subject of procurement", approved by the order of the Ministry of Economy dated April 15, 2020 No. 708 (hereinafter - current repair services), the cost of which is 100 thousand UAH or more, current repair services, the cost of which is 200 thousand UAH or more, works, the cost of which is 1.5 million UAH or more, by applying open tenders in the manner defined by these specifics, and/or by using an electronic catalog for the procurement of goods in accordance with the procedure established by the Resolution of the Cabinet of Ministers of Ukraine dated September 14, 2020 No. 822 "On approval of the Procedure for the formation and use of an electronic catalog", taking into account the provisions defined by these specifics. Taking into account the foregoing, the procurement procedure in the annual plan for the procurement of the specified goods for 2026 should be indicated as - "Use of the electronic catalog - by requesting proposals from suppliers".

In accordance with paragraph 3 of paragraph 12 of the Specifics, in a request for proposals from suppliers regarding the subject of procurement of goods, the cost of which is 500 thousand UAH or more, it is carried out in accordance with the product specification formed by the electronic catalog administrator, which does not provide for the customer's ability to independently determine information about the product characteristics and their permissible values.

In accordance with paragraph 2 of part 2 of the "Procedure for determining the subject of procurement", approved by Order No. 708 dated 15.04.2020 of the Ministry of Economic Development and Trade of Ukraine, when carrying out procurement - in case of procurement of medicines, the subject of procurement is determined by the customer according to the indicator of the third digit of the Unified Procurement Dictionary.

In accordance with Order No. 708 dated 15.04.2020 of the Ministry of Economic Development and Trade of Ukraine, when procuring goods and services, the subject of procurement is determined by the customer in accordance with paragraphs 21 and 34 of part one of Article 1 of the Law and according to the indicator of the fourth digit of the Unified Procurement Dictionary.

7. For its own funds, other funds, except for local budget funds (funding sources) in 2026, these goods are not purchased by the Customer.

Due to the impossibility of financing 100% of the annual need (in monetary terms) of this procurement with local budget funds at the beginning of 2026, and for the purpose of optimization, reducing delivery times for goods with additional funding from local budget funds during the budget year, the missing amount of the annual need for this type of goods (in monetary terms) can be indicated as the amount of own or other funds, exclusively for formal compensation of the annual need in monetary terms.
