1) The payment for the Goods is exempt from Value Added Tax on the basis of clause 197.11 of Article 197 of the Tax Code of Ukraine, as the supplied Goods are financed by international technical assistance provided in accordance with the international agreement: Agreement between the Government of Ukraine and the Government of the United States of America on humanitarian and technical-economic cooperation dated 07.05.1992, Resolution of the Cabinet of Ministers of Ukraine dated 15.02.2002 No. 153 "On the creation of a unified system for attracting, using and monitoring international technical assistance" and within the framework of the project "Strengthening HIV infection treatment, laboratory network capacity, substitution supportive therapy and program monitoring in Ukraine within the framework of the US President's Emergency Plan for AIDS Relief (PEPFAR)" with the financial support of the US Department of Health and Human Services (DHHS). Date, state registration number of the project No. 4951-12 dated 11.03.2026.
2) When forming the price of the offer, the supplier is obliged to take into account the unloading (carrying) of the goods into the customer's warehouse (clause 2.3 of the draft agreement)
