The supply of goods is carried out in batches on working days based on and in accordance with orders agreed by the Parties. The delivery period of the Goods is until December 31, 2026. Claims regarding the quantity and shelf life (expiration date) of the goods are accepted at the moment of acceptance and transfer. Unjustified refusal by the Buyer to accept the goods is not allowed. The Seller has the right to demand compensation from the Buyer for all losses incurred due to unjustified refusal to accept the goods. Place of delivery of the Goods: Vinnytsia region, Mohyliv-Podilskyi district, Ivan Bohun Lyceum of the Yampil City Council and its branches (Appendix 2 to the Agreement). The Buyer reserves the right to change the place of delivery of the Goods, about which the Parties conclude an Additional Agreement to this Agreement, which is its integral part. The Goods must be delivered in proper containers and packaging to ensure the integrity of the Goods and preserve their quality during transportation. Packaging and labeling of the Goods must comply with its specifications, technical conditions and standards and ensure proper conditions for the transportation of the Goods. The Goods must be packaged by the Supplier in such a way as to prevent its destruction or spoilage, as well as to protect it from atmospheric influences and ensure its safe transportation. The Goods and their packaging must be labeled and marked with the necessary, accessible and reliable information provided for by the current legislation of Ukraine. In case of absence of marking on the container, packaging or label, as well as the indication of the country of origin and date of manufacture, the Buyer reserves the right to refuse to accept such Goods with the corresponding drawing up of a motivated refusal of the Goods. Penalties for refusal to accept the Goods, under the circumstances indicated above, do not apply to the Buyer. - The Supplier must be a market operator in accordance with the requirements of the Law of Ukraine "On the basic principles and requirements for the safety and quality of food products". Food business operator (hereinafter - market operator) - a business entity that carries out activities for profit or without profit and manages facilities where primary production, production, sale and/or circulation of food products and/or other objects of sanitary measures is carried out, and which is responsible for fulfilling the requirements of the Law of Ukraine "On the basic principles and requirements for the safety and quality of food products" and legislation on the safety and certain quality indicators of food products. Market operators include individuals if they carry out activities for profit or without profit and are engaged in the production and/or circulation of food products or other objects of sanitary measures. A food market is also considered a market operator; - The Supplier must be a market operator who, in 2025, underwent a state control measure in the form of an audit of constantly operating procedures based on HACCP principles, conducted by the State Service of Ukraine on Food Safety and Consumer Protection on facilities for storing goods (namely, meat products stored in cold rooms) of the Supplier. - The Supplier must be a market operator who, in 2025, underwent a state control measure in the form of an act drawn up based on the results of a planned (unplanned) state control measure (inspection) regarding the compliance of market operators with food legislation, conducted by the State Service of Ukraine on Food Safety and Consumer Protection on facilities for storing goods (namely, meat products stored in cold rooms) of the Supplier.
