Delivery, installation and warranty maintenance of furniture and equipment required for the Cardiology clinic at UMHAT Prof. Dr. Stoyan Kirkovich AD. In the technical specification – Annex No. 1, of the documentation, the contracting authority has specified the materials from which the furniture and equipment must be made. The colors will be chosen by the Contracting Authority from the available color range offered by the selected contractor, with participants required to submit a catalog or specification of the colors of the materials for carcasses, fronts, handles, countertops, wall protectors, visitor chairs with their technical proposal, in which catalogs and specifications prices should not be visible. The contracting authority considers it necessary for the furniture and equipment to match the colors and design of the main renovation of the Cardiology Clinic carried out after a public procurement procedure. The execution of this renovation was carried out through an internal competitive selection and design of the premises in the clinic, corresponding, including to the medical standard for the respective hospital activity, along with the preparation of the cost estimate. As a result of the ongoing renovation, floor coverings will be laid in color, walls and ceilings will be painted, and after their final laying, the colors of the furniture, desks, etc. and equipment will be coordinated to achieve an aesthetic solution for the overall appearance of the clinic, and by specifying in the technical specification the material and coating (defined in the explanatory note to the project – "Architecture" part), from which the furniture should be made – to achieve high quality, durability, longevity of this furniture, with the possibility of disinfection, wet cleaning and non-combustibility. Due to the objective circumstances set out above, which lead to the need to specify specific materials, the contracting authority considers that the requirements formulated in the technical specification in this way do not lead to unjustified restriction of competition and/or unjustified advantage of participants. In fulfillment of the provision of Art. 48 para. 2 of the Public Procurement Act (PPA), it is to be considered that "or equivalent" has been added wherever in the participation documentation and its annexes, where a registry, document for the right to perform a specific activity or legal basis for performing a specific activity is indicated, depending on the legislation of the country in which the foreign participant is established. If anywhere in the documentation and the technical specification: a specific model, source, process, trademark, type, patent, origin, standard or production or other is indicated, the contracting authority on the basis of Art. 50 para. 1 of the PPA will accept any offer, provided that the participant proves with any relevant document that the solution proposed by him corresponds in an equivalent manner to the requirements. The public procurement is not divided into separate lots. Justification: The subject cannot be divided into separate lots, given the specifics of the procurement. The public procurement is indivisible in its nature, as its subject falls within the same delivery group according to the Common Procurement Vocabulary (CPV) and does not include heterogeneous deliveries, therefore, with a view to the main objective of the PPA to achieve efficiency in the spending of public funds, it is not advisable to divide it into separate lots, as it aims for an optimal result for the execution of the delivery, including a low price. Important! Participants must offer in their proposal for the execution of the procurement and in their price proposal – Annex No. 5A each nomenclature from the technical specification. Otherwise, they will be proposed for exclusion from the procedure on the grounds of Art. 107, item 2, letter "a" of the PPA. Execution period: The execution period for the delivery and installation activities is up to 30 days, starting from the later of the two dates - the date of signing the contract and the date of the order received by the contractor for the execution of the procurement activities.
