The execution period of the order cannot exceed 90 calendar days from the date of signing the order for opening the construction site and determining the construction line and level of the structure. The financial resource for the execution of this order is BGN 55,000 excluding VAT. The price proposed by the participants for the execution of the order must not exceed the maximum forecast value of BGN 55,000.00 excluding VAT or EUR 28,121.05. FINANCING: Under the "Human Resources Development" 2021-2027 program, priority 1: Promoting employment and developing skills, procedure BG05SFPR002-1.004 "Adapted work environment", for the implementation of project No. BG-RRP-2.004-0587 "For a healthy and safe environment in a hospital for the future", under contract BG05SFPR002-1.004-0587-C01 and co-financing with own funds of the Contracting Authority. No financing has been secured at the opening of the procedure. This is stated in the decision to open the order, and a clause for deferred payment is provided in the draft contract. At the contractor's request, the Contracting Authority pays 40% of the execution price of the order under the contract concluded with the selected participant, within 10 working days after the signed contract, notification received from the contractor that financing for the execution of the order has been secured, a signed Protocol for opening the construction site and determining the construction line and level of the structure (Annex No. 2 to Art. 7, para. 3, item 2 of Ordinance No. 3 of July 31, 2003 on the composition of acts and protocols during construction) and a guarantee for the amount of the advance payment submitted by the contractor. In accordance with Art. 111, para. 3 of the Public Procurement Act (PPA), advance payments are secured by a guarantee in the form referred to in Art. 111, para. 5 of the PPA, which guarantee is in the amount of these funds and is released up to three working days after the return or utilization of the advance. The contractor must notify the Contracting Authority in writing within three days of receiving the notification of secured financing whether they wish to receive an advance payment in the specified amount. 4.2. The remainder of the contract value, amounting to 60%, is paid in stages, after deducting the advance, within 60 days after signing Act 19 for the acceptance of the respective performed construction and assembly works. Pursuant to Art. 116, para. 1, items 4 and 6 of the PPA, the CONTRACTOR may be replaced under the following conditions: Replacement of the CONTRACTOR is permitted: in case of delayed fulfillment of an obligation under the Contract and in case of accrued/due penalties in a total amount of not less than 15% of the contract price, or in case of insolvency or liquidation proceedings against the CONTRACTOR, or in case of failure to submit a document in the hypothesis of Art. 25a of the Construction Contracts Act. The replacement of the CONTRACTOR is carried out with the participant ranked second, after sending an invitation to the participant and receiving confirmation regarding the terms of replacement. The invitation to the participant primarily includes the following conditions: The value for the execution of the remaining part of the contract does not exceed the contract price, reduced by the part of the works and activities performed up to the time of sending the invitation. The deadlines for the execution of the contract are shifted according to the delay and lateness of the Contractor, as well as the deadlines required for the replacement. When executing the site, the execution technology included in the offer of the second-ranked participant will be used, provided that the execution stages of the site allow for a change in the execution technology. other conditions related to the execution, including the participant's right to renegotiate the terms with subcontractors and/or to include subcontractors offered in his technical proposal in the execution.
