“Supply of food products - fresh fruits and vegetables for the needs of Kindergarten „Little Red Riding Hood“, Plovdiv city“

I. The subject of the order is the supply of food products – fresh fruits and vegetables for the needs of Kindergarten „Little Red Riding Hood“, Plovdiv city. The supplies included in the subject of this public procurement are described in the Technical Specifications – Part II, attached to this documentation. 1. The supplies of food products for the needs of Kindergarten „Little Red Riding Hood“ shall be carried out by dividing the necessary types of food product supplies into 2 (two) separate lots: - Separate Lot No. 1 „Supply of fresh fruits and vegetables“ with an estimated value: EUR 96,784.03 including VAT, respectively EUR 80,653.36 excluding VAT; - Separate Lot No. 2 „Supply of packaged food products and pulses“ with an estimated value: EUR 23,623.00 including VAT, respectively EUR 19,685.83 excluding VAT; with a total estimated value of the entire public procurement of EUR 120,407.03 (one hundred and twenty thousand four hundred and seven euros and three euro cents) including VAT or up to EUR 100,339.19 (one hundred thousand three hundred and thirty-nine euros and nineteen euro cents) excluding VAT, which is also the maximum financial resource of the contracting authority for its execution in the individual separate lots. 2. Pursuant to Art. 21, para. 6 of the Public Procurement Act (PPA), Separate Lot No. 2 „Supply of packaged food products and pulses“ with an estimated value of EUR 19,685.83 excluding VAT (total 19.62% of the estimated value for the execution of the entire public procurement), planned as a separate lot in the current procurement, will be awarded according to the procedure valid for its individual estimated value - by "direct award" based on Art. 20, para. 4, item 3 of the PPA, as the value of the respective separate lot - EUR 19,685.83 excluding VAT does not exceed the amount of BGN 156,464, which converted to euros equals EUR 79,998.77, and at the same time the estimated value of the separate lot awarded in this manner does not exceed 20 percent of the total estimated value of the procurement excluding VAT, which is EUR 20,067.84 excluding VAT. The contracting authority decides to award Separate Lot No. 2 „Supply of packaged food products and pulses“ according to the procedure valid for its individual estimated value, based on and in compliance with the requirements of Art. 21, para. 6 of the Public Procurement Act – by "direct award" within the meaning of Art. 20, para. 4, item 3 of the PPA. Pursuant to Art. 7, para. 2 of the PPA Implementing Regulation, in the participation documentation, the contracting authority shall indicate all required information regarding separate lot No. 2, including the subject, scope, and value of the separate lot. 3. Estimated value of the public procurement awarded by "open procedure": The estimated value of the public procurement for the supply of food products - fresh fruits and vegetables is EUR 96,784.03 (ninety-six thousand seven hundred and eighty-four euros and three euro cents) including VAT, respectively EUR 80,653.36 (eighty thousand six hundred and fifty-three euros and thirty-six euro cents) excluding VAT, which is the remaining estimated and limit value of Separate Lot No. 1 „Supply of fresh fruits and vegetables“. Separate Lot No. 1 „Supply of fresh fruits and vegetables“ represents the main part of the subject of the procurement, therefore it is awarded independently according to its individual value in accordance with Art. 7, para. 2 of the PPA Implementing Regulation in connection with Art. 21, para. 6 of the PPA through an "open procedure" within the meaning of Art. 18, para. 1, item 1 of the PPA in connection with Art. 20, para. 1, item 1, letter "b" in connection with Art. 73 of the PPA. Given the foregoing, the subject of the procurement awarded by this "open procedure" is „Supply of food products - fresh fruits and vegetables for the needs of Kindergarten „Little Red Riding Hood“ - Plovdiv city“.
