Відповідно до постанови КМУ №178 від 02 березня 2022 р., установлено, що до припинення чи скасування воєнного стану операції з постачання товарів для заправки (дозаправки) або забезпечення транспорту Збройних Сил, Національної гвардії, Служби безпеки, Служби зовнішньої розвідки, Державної прикордонної служби, Міністерства внутрішніх справ, Державної служби з надзвичайних ситуацій, Управління державної охорони, Державної служби спеціального зв’язку та захисту інформації, інших утворених відповідно до законів військових формувань, їх з’єднань, військових частин, підрозділів, установ або організацій, що утримуються за рахунок коштів державного бюджету, для потреб забезпечення оборони України, захисту безпеки населення та інтересів держави обкладаються податком на додану вартість за нульовою ставкою.
Ціна тендерної пропозиції може перевищувати очікувану вартість предмета закупівлі, зазначену в оголошенні про проведення відкритих торгів, з урахуванням абзацу другого пункту 28 Особливостей не більше, ніж на 15 %.
До розгляду приймається тендерна пропозиція, ціна якої є вищою ніж очікувана вартість предмета закупівлі, але не більше ніж на 15 відсотків від ціни, визначеної замовником в оголошенні про проведення відкритих торгів.
