Original language: ukВідповідно до підпункту 2 пункту 8 постанови Кабінету Міністрів України від 11.11.2022 №1275 «Деякі питання здійснення оборонних закупівель на період дії правового режиму воєнного стану», військова частина 3011 Національної гвардії України здійснює закупівлю у порядку проведення спрощених закупівель, визначених Законом України “Про публічні закупівлі”, з урахуванням положень, визначених цими особливостями.
Порядок проведення спрощених закупівель регламентований статтею 14 Закону України «Про публічні закупівлі», яка, в свою чергу, не містить вимоги у разі посилання на конкретну марку чи виробника або на конкретний процес, що характеризує продукт чи послугу певного суб’єкта господарювання, чи на торгові марки, патенти, типи або конкретне місце походження чи спосіб виробництва, необхідності містити вираз "або еквівалент".
З огляду на викладене, військова частина 3011 Національної гвардії України має намір придбати конкретні монітори, наведені у оголошенні про проведення спрощеної закупівлі, проекті договору і не розглядатиме аналоги до таких моніторів.
