1 Public Invitation to Bid (Electronic Bidding - Post-qualification - No Comprehensive Evaluation) Announcement (Common Provisions) Regarding construction work ordered by Kochi Prefecture, the common provisions for conducting public invitation to bid using the post-qualification method are as follows.
Requirements for application submission deadline, bid opening date, definition of similar work, etc., which are individually set for each project, will be defined separately in the Individual Provisions for Public Invitation to Bid (hereinafter referred to as "Individual Provisions").
In addition, if there are overlapping provisions in the announcement, common provisions, and individual provisions, the provisions in the individual provisions shall take precedence.
Article 1 Bid Participation Qualifications The bidder must meet all of the following requirements.
1. The bidder is not subject to the provisions of Article 167-4, Paragraph 2 of the Local Autonomy Act (1947 Cabinet Order No. 16).
2. The bidder has not filed for commencement of bankruptcy proceedings under the Bankruptcy Act (2004 Act No. 75), filed for commencement of corporate reorganization proceedings under the Corporate Reorganization Act (2002 Act No. 154), filed for conciliation proceedings for the promotion of adjustment of specific debts etc. under the Act on Promotion of Adjustment of Specific Debts etc. (1999 Act No. 158), or filed for commencement of rehabilitation proceedings under the Civil Rehabilitation Act (1999 Act No. 225).
If the bidder has undergone such proceedings, they must have obtained re-certification of eligibility for bidding on construction work in Kochi Prefecture through procedures separately determined by the Governor after the commencement of such proceedings.
3. The bidder must not have been subject to suspension of designation measures under the Kochi Prefecture Construction Work Designation Suspension Measures Ordinance (Kochi Prefecture Notice No. 598, August 2005) or the Designation Avoidance Measures Standards Manual (Notice from the Director of Civil Engineering Department, August 25, 2005, No. 17-Kokenkan-223) from the date of announcement until before the award decision.
4. The bidder must not fall under the exclusion measures target persons specified in Article 8, Paragraph 9 of the Construction Industry Act (1949 Act No. 100) and Article 2, Paragraph 2, Item 5 of the Regulations on the Exclusion of Gangs from Kochi Prefecture's Affairs and Businesses (Kochi Prefecture Order No. 1, March 2011).
5. There must be no relationship between bidders that falls under any of the following criteria.
Furthermore, if there is a capital or personnel relationship between any bidders who have submitted an application for eligibility confirmation for this project under public invitation to bid, the eligibility of all such bidders with that capital or personnel relationship will be denied.
(1) Capital Relationship In the case of two companies falling under any of the following:
(a) Relationship between a subsidiary (meaning a subsidiary as defined in Article 2, Item 3-2 of the Companies Act (2005 Act No. 86), hereinafter the same) and a parent company (meaning a parent company as defined in Article 2, Item 4-2 of the same Act, hereinafter the same).
(b) Relationship between subsidiaries sharing the same parent company.
(2) Personnel Relationship In the case of two companies falling under any of the following.
However, (a) shall not apply if one of the companies (meaning a company as defined in Article 2, Paragraph 3, Item 2 of the Ordinance on Companies Act (2006 Ministry of Justice Ordinance No. 12), hereinafter the same) is a company for which rehabilitation proceedings are ongoing as defined in Article 2, Item 4 of the Civil Rehabilitation Act (1999 Act No. 225), or a company undergoing reorganization (meaning a company undergoing reorganization as defined in Article 2, Item 7 of the Corporate Reorganization Act (2002 Act No. 154), hereinafter the same).
(a) A director of one company (meaning a director as defined in Article 2, Paragraph 3, Item 3 of the Ordinance on Companies Act, hereinafter the same) is concurrently serving as a director of the other company.
1) Directors of a stock company.
However, the following shall be excluded:
(i) Directors who are audit committee members in a company with an audit and supervisory committee as defined in Article 2, Item 11-2 of the Companies Act.
(ii) Directors in a company with a nominating committee as defined in Article 2, Item 12 of the Companies Act.
(iii) Outside directors as defined in Article 2, Item 15 of the Companies Act.
(iv) Directors whose duties are not to be executed as stipulated in the articles of incorporation pursuant to Article 348, Paragraph 1 of the Companies Act.
2) Executive officers of a company with a nominating committee as defined in Article 402 of the Companies Act.
3) Members of a partnership company (meaning a general partnership company, limited partnership company, or limited liability company) as defined in Article 575, Paragraph 1 of the Companies Act (excluding members whose duties are not to be executed as stipulated in the articles of incorporation pursuant to Article 590, Paragraph 1 of the same Act).
4) Directors of an association.
5) Other persons executing business who are equivalent to those listed in 1) to 4) above.
(b) A director of one company is concurrently serving as a trustee (hereinafter referred to as "trustee") appointed under Article 64, Paragraph 2 of the Civil Rehabilitation Act or Article 67, Paragraph 1 of the Corporate Reorganization Act of the other company.
(c) A trustee of one company is concurrently serving as a trustee of the other company.
(3) Other cases where the fairness of bidding is deemed to be hindered. Cases where an association (including a joint venture) and its members participate in the same bid, or other cases where a capital or personnel relationship equivalent to (1) or (2) above is recognized.
6. The bidder must meet the requirements specified in the Individual Provisions.
Furthermore, the construction performance record must have been completed and delivered by the time of the bid participation application.
Article 2 Bid Participation Method, etc. Bidders wishing to participate in the bidding for this project must submit the application forms, etc., specified in the Individual Provisions by the deadline for submission of application forms, etc., as follows.
1. Obtaining Application Form Templates: Download from the bidding information system or the Kochi Prefecture website.

Please note that those who do not submit the Application for Confirmation of Eligibility for Public Invitation to Bid (Form 1) will be disqualified when they become the successful bidder candidate.
(2) Method of Creating Electronic Files: a. Electronic files to be attached to the electronic bidding system must be created in one of the following file formats. Also, be careful not to use functions that are lost when saving the file during creation.
i. Files saved with the extension .docx or .doc that can be read by Word 2010 (hereinafter referred to as "Word files").
ii. Files saved with the extension .xlsx or .xls that can be read by Excel 2010.
iii. PDF format files.
iv. Image files (JPEG format or GIF format).
v. In addition to the above, file formats specifically approved by the contracting authority (consult in advance).
b. If compressing electronic files, use ZIP format.
c. Submission in file formats other than the specified formats (including compressed files in other compression formats, including self-extracting formats) will be treated as if no submission was made.
(3) If electronic files cannot be attached when registering the application in the electronic bidding system (limited to cases due to system constraints, such as when the attached file size exceeds 5 megabytes), proceed as follows.
a. Inform the contracting authority's contract representative by phone or other means that the electronic file cannot be attached and will be submitted separately, and obtain their consent.
b. Except when otherwise notified, after applying for eligibility confirmation through the "Application for Confirmation of Eligibility for Public Invitation to Bid" screen in the electronic bidding system in accordance with (1), submit the application forms, etc., in person or by mail by 5:00 PM on the last day of the submission period.
If submitting by mail, it must be registered mail.
c. Submissions must arrive by the deadline. Please note that submissions arriving after the deadline, including due to postal circumstances, will not be accepted.
d. When submitting, place the written application forms, etc., in an envelope, clearly write the bidder's name, project name, project number, and bid opening date on the front of the envelope, and seal it with "Application Forms, etc." written in red ink (it is permissible to fold the application forms and place them in a small envelope).
e. If submitting by mail, place the envelope from d. into an envelope of a size that does not require folding, seal it, and write "Application Forms, etc. Enclosed" in red ink on the front of the envelope.
(4) Submission Location and Deadline: To be determined in the Individual Provisions.
In addition, "closed business day" in this announcement (including Individual Provisions) refers to the prefectural holidays stipulated in Article 1 of the Ordinance on Holidays of Kochi Prefecture (1989 Kochi Prefecture Ordinance No. 2) (Saturdays, Sundays, national holidays stipulated in the Act on National Holidays (1948 Act No. 178), and the period from December 29 to January 3 of the following year).
Article 3 Inspection of Design Documents, etc. 1. Inspection of Design Documents, etc.: Design documents, etc., can be viewed on the bidding information system.

(2) When submitting a question, be sure to inform the contracting authority's contract representative by phone that you have sent it.
(3) Answers to questions will generally be provided through the bidding information system to the person who asked the question and to those who have applied for eligibility confirmation as per Article 2.
(4) Question Submission Deadline and Answer Deadline: To be determined in the Individual Provisions.
Article 4 Bidding Method 1. Bidding shall be conducted by registering the bid amount in the electronic bidding system during the bidding period specified in the Individual Provisions.
2. Bidders, whether they are taxable or exempt from consumption tax and local consumption tax, shall register the amount equivalent to 100/100 of their estimated contract desired amount in the electronic bidding system.
In addition, register a lottery number to be used for electronic lotteries according to the specifications defined in the bidding system.
Note that the handling of electronic lotteries, except when a lottery number is not registered, will be determined separately.
The successful bid price will be the amount registered in the electronic bidding system plus an amount equivalent to 10/100 of that amount (if there is a fraction of less than one yen, that fraction will be rounded down).
3. For construction work bids, when registering the bid amount in the electronic bidding system, prepare a breakdown of the construction costs for the bid amount, create an electronic file according to Article 2(2), and attach it.
The template for the breakdown of construction costs can be downloaded from the website of the Civil Engineering Department's Technology Management Division.
Furthermore, if the matters to be described in the template are described, it is not necessarily required to use this template.
4. If an electronic file cannot be attached when registering the bid amount in the electronic bidding system (limited to cases due to system constraints, such as when the attached file size exceeds 5 megabytes), submit it in person or by mail by 5:00 PM on the bid closing date (or the bid acceptance deadline separately notified in case of re-bidding), except when otherwise notified, as follows.
If submitting by mail, it must be registered mail.
(1) Place the written breakdown of construction costs in an envelope, clearly write the bidder's name, project name, project number, and bid opening date on the front of the envelope, and seal it with "Breakdown of Construction Costs" written in red ink (it is permissible to fold the breakdown of construction costs and place it in a small envelope).
(2) If submitting by mail, place the envelope from (1) into an envelope of a size that does not require folding, seal it, and write "Breakdown of Construction Costs Enclosed" in red ink on the front of the envelope.
5. If electronic bidding cannot be performed due to a failure in the electronic bidding system or on the Kochi Prefecture side, the execution of the bid may be postponed.
Furthermore, if electronic bidding cannot be performed for a prolonged period, the bidding method stipulated in Article 5 of the Construction Work Competitive Bidding Rules (Notice from the Director of Civil Engineering Department, December 7, 2007, No. 19-Kokenkan-808) (method of placing paper bids in a bid box) may be switched to.
In such cases, bidders will be notified separately.
6. If electronic bidding cannot be performed due to a failure on the bidder's side (e.g., equipment malfunction), bidding using bid forms (Form No. 1 attached to the Electronic Construction Work Competitive Bidding Rules (Notice from the Director of Civil Engineering Department, January 15, 2010, No. 21-Kokenkan-939; hereinafter referred to as "bid form")) may be permitted depending on the situation, upon application.
7. In the event of unforeseen circumstances requiring re-acquisition of an electronic certificate, or due to communication failures caused by natural disasters, etc., bidding using bid forms may be permitted upon application.
8. For bidders permitted to use bid forms as per the preceding two paragraphs, the bid forms will be opened by the bid executor at the time of bid opening, registered in the electronic bidding system, and then the bid opening will be conducted via the electronic bidding system.
9. In bids where the planned price is announced after the fact, if there are no bids that should be awarded (e.g., all bidders exceed the planned price), re-bidding will be conducted up to two times.
If re-bidding occurs, the bidder will be promptly notified by email after the bid opening.
10. The deadline for bid acceptance in re-bidding, unless otherwise notified, is the day after the bid opening date of the relevant bid (if that day is a closed business day, then the next immediately following business day)...
