- 1 -Akita Prefecture Conditional Open Competitive Bid Announcement [Minimum Reserve Price Applied]: We hereby announce that a conditional open competitive bid will be held, in accordance with the provisions of Article 167-6 of the Local Autonomy Act (Showa 22, Cabinet Order No. 16).
July 9, Reiwa 8 Contracting Officer, Director of Akita Odate Power Plant Office, Noriaki Oguchi. Please note that a minimum reserve price is set for this bid, and bids below the minimum reserve price will not be eligible for successful bid.
1 Items for Bidding (1) Contract Name: Cleaning and Pest Control Services at Various Power Plants 08-DO-N6 [Main Service]: Cleaning (2) Contract Location: Within Kasuke, Shiro-no-uchi, Sasagawa National Forest, Fujisato Town, Yamamoto District, Akita Prefecture, and other locations (3) Contract Period: August 7, Reiwa 8 to March 9, Reiwa 9 (4) Contract Outline: - Cleaning of various power plants (excluding Hachimantai No. 2 Power Plant) 3 times per year. - Stink bug control at Hayaguchi Power Plant 2 times per year. - Removal of hornet nests 2 nests. 2 Bidder Qualifications: Those who wish to bid must meet all of the following requirements.
(1) Must not fall under the provisions of Article 167-4 of the Local Autonomy Act.
(2) Must not be a member of a violent group or have close ties with a violent group as defined in Article 6 of the Akita Prefecture Ordinance on the Exclusion of Violent Groups (Heisei 23, Akita Prefecture Ordinance No. 29).
(3) Must not have filed for commencement of rehabilitation proceedings under the Corporate Reorganization Act (Heisei 14, Act No. 154) or commencement of civil rehabilitation proceedings under the Civil Rehabilitation Act (Heisei 11, Act No. 225) (excluding those for whom a decision to commence proceedings has been made).
(4) Must not be in arrears with Akita Prefecture taxes, and must be enrolled in social insurance and not be in arrears with social insurance premiums (excluding applicable exemption businesses).
(5) As of the announcement date, must be registered in the list of contractors for maintenance of buildings, etc., as stipulated in Article 5 of the Akita Prefecture Public Notice No. 5 regarding qualifications necessary for general and designated competitive bidding for maintenance of buildings, etc. (June 1, Heisei 22).
i. Must be registered for "Cleaning" and "Rodent and Insect Control" as desired services.
ii. Must be registered for "Kazuno Regional Development Bureau Jurisdiction", "Kitaakita Regional Development Bureau Jurisdiction", and "Yamamoto Regional Development Bureau Jurisdiction" as regions where contract performance is possible.
(6) Must have head office in Akita Prefecture.
(7) Must employ a qualified person to carry out this contract and be able to assign them as the person in charge of the work.
3 Submission of Bidder Qualification Confirmation Application, etc. (1) Those wishing to bid must submit the Bidder Qualification Confirmation Application, which will be distributed separately, as follows.
i. Submitted Documents: a. Competitive Bidding Qualification Confirmation Application (Form No. 1) b. Pledge (Form No. 2) c. Copy of certificate of registered matters (copy of registered extract) or copy of document proving head office in Akita Prefecture. d. Copy of qualification certificate of the person in charge of the work and documents confirming employment relationship, etc. ii. Submission Period: July 9, Reiwa 8 (Thursday) to July 24, Reiwa 8 (Friday). However, excluding prefectural holidays as defined in Article 1, Paragraph 1 of the Akita Prefecture Ordinance on Prefectural Holidays (Heisei 1, Akita Prefecture Ordinance No. 29). iii. Submission Hours: 9:00 AM to 5:00 PM. - 2 - iv. Submission Location: Akita Odate Power Plant Office, General Affairs and Power Operation Team. v. Number of Copies: 1 copy. vi. Distribution of Bidder Qualification Confirmation Application: The application will be posted and distributed on the Akita Prefecture official website "Binokuni Akita Net" simultaneously with this announcement, starting from the announcement date.
(2) Confirmation of bidder qualifications will be conducted primarily for the bidder(s) who are potential successful bidders (hereinafter referred to as "Successful Bid Candidates") after the bid opening. Confirmation will not be conducted for others.
(3) A bidder who has submitted a Bidder Qualification Confirmation Application must promptly submit a Bid Withdrawal Form (Form No. 3) before the bid opening if they lose their eligibility, or a notification stating such after the bid opening, until the successful bidder is determined.
4 Distribution of Design Documents, etc.: Specifications, drawings, draft contract, and breakdown of costs without amounts (hereinafter referred to as "Design Documents, etc.") related to this contract will be posted on the Akita Prefecture official website "Binokuni Akita Net" from July 9, Reiwa 8 (Thursday) to July 24, Reiwa 8 (Friday).
5 Questions and Answers Regarding Design Documents, etc. (1) Questions regarding Design Documents, etc., must be submitted in writing to the Director of the Odate Power Plant Office by July 21, Reiwa 8 (Tuesday).
(2) Answers to the above questions will be posted on the Akita Prefecture official website "Binokuni Akita Net" by July 23, Reiwa 8 (Thursday).
6 Bid Bond: Exempt.
7 Contract Deposit: The successful bidder must provide one of the following guarantees equivalent to 1/10 or more of the contract amount at the time of contract submission.
(1) Payment of contract deposit. (2) Provision of securities in lieu of contract deposit. (3) Guarantee from a bank or guarantee company.
8 Exemption of Contract Deposit: The contracting officer may exempt the contract deposit in whole or in part in the following cases.
(1) When a performance guarantee insurance contract with the prefecture as the insured has been concluded with an insurance company.
(2) When contracts of similar type and scale have been concluded multiple times with the national government or local public entities within the past two years, and all have been performed faithfully, and there is no risk of non-performance.
9 Submission of Bids, etc. (1) Submission Method: Those who have submitted a Bidder Qualification Confirmation Application as per 3 must bring their bid form to the Odate Power Plant Office conference room at the scheduled bid opening time and date for submission, and must attend the bid opening.
(2) Scheduled Bid Opening Time: July 28, Reiwa 8 (Tuesday) 1:30 PM. Odate Power Plant Office, 2nd Floor Conference Room.
(3) Amount to be Stated in Bid Form: The successful bid amount will be the amount stated in the bid form plus 10% of that amount (rounded down to the nearest yen if there are fractions of less than one yen). Therefore, bidders must state the amount equivalent to 100/110 of their estimated contract price in the bid form, regardless of whether they are a taxable or non-taxable business with respect to consumption tax.
- 3 - (4) Other: ① The number of bid executions shall be up to 2 times. However, bidders who submitted a bid below the minimum reserve price in the first round will not be allowed to participate in the second round. ② Bids will be executed even if there is only one bidder.
10 Determination of Successful Bidder: (1) The bidder who submitted a bid within the limit of the estimated price and at or above the minimum reserve price, and has the lowest bid price, will be the successful bid candidate. If there are two or more such bidders, the order will be determined by lottery, and the highest-ranked bidder will be the successful bid candidate.
(2) The eligibility of the successful bid candidate in (1) will be confirmed. If the eligibility is confirmed, that candidate will be determined as the successful bidder. However, if it is deemed significantly inappropriate because it may disrupt the order of fair trade to conclude a contract with the successful bid candidate, they will not be determined as the successful bidder.
(3) If a successful bidder is not determined under (2), the bidder with the next lowest bid price within the limit of the estimated price and at or above the minimum reserve price (if there are two or more such bidders, the highest-ranked bidder will be determined by the method in the latter part of (1). However, if the successful bid candidate was determined by lottery, the next ranked bidder in the lottery will be selected) will be the successful bid candidate, and the confirmation under (2) will be conducted.
(4) The above method will be repeated sequentially until a successful bidder is determined.
(5) If the contracting officer determines that the successful bid candidate is ineligible under (2), they will promptly notify the successful bid candidate with a confirmation of eligibility results form (Form No. 5) stating the reasons for disqualification.
(6) The recipient of the notification in (5) may request an explanation of the reasons for disqualification in writing to the contracting officer within 2 days (excluding holidays as defined in Article 1, Paragraph 1 of the Akita Prefecture Ordinance on Prefectural Holidays (hereinafter referred to as "Holidays")) from the day after the date of notification. If no such request is made, the recipient of the notification in (5) may file a complaint with the contracting officer within 3 days (excluding holidays) from the day after the announcement of the bid results.
(7) The successful bidder must promptly submit a document proving that they are not in arrears with Akita Prefecture taxes and social insurance premiums.
11 Invalid Bids: Bids falling under any of the following categories will be considered invalid.
(1) Bids submitted by those who have been confirmed to be ineligible.
(2) Bids submitted by those who have been confirmed to no longer meet the requirements in 2 between the bid opening date and the successful bid determination date.
(3) Bids submitted by the same person for the same bid item more than once.
(4) Bids submitted by an agent acting for two or more bidders for the same bid item.
(5) Bids suspected of being the result of collusion or other fraudulent acts.
(6) Bids with missing or illegible entries, or bids where the bid amount has been corrected.
(7) Bids submitted by an agent without a power of attorney.
(8) Bids lacking a signature and seal.
(9) Bids submitted by those who did not attend the bid opening.
(10) Bids that violate the specified conditions, in addition to those listed above.
12 Other: (1) No briefing session or site inspection will be held.
(2) No hearing will be held regarding bidder qualifications. However, explanations may be requested if deemed necessary.
(3) Submitted Bidder Qualification Confirmation Applications, etc., will not be returned. Furthermore, Bidder Qualification Confirmation Applications, etc., will not be published or used without permission.
(4) The cost of preparing Bidder Qualification Confirmation Applications, etc., shall be borne by the submitter.
(5) The contract period may be changed due to circumstances.
- 4 - (6) Bidders must be familiar with the Design Documents, etc., and comply with the notes for bidding.
(7) If the successful bidder is found to no longer meet the requirements in 2 between the successful bid decision and the contract conclusion, the contracting officer may not conclude the contract with that successful bidder.
(8) Matters not covered in this announcement shall be governed by the Local Autonomy Act, the Local Autonomy Act Enforcement Order, the Public Enterprise Act, the Public Enterprise Act Enforcement Order, and the Akita Prefecture Public Enterprise Finance Regulations.

4 Guarantee: If any defects or deficiencies are found after the completion of the work, such as failure to meet specifications, the contractor shall immediately re-perform the work at their own expense. Furthermore, if any damage is caused to the prefecture's business or assets due to these reasons, and the prefecture requests compensation, the contractor must respond through consultation.
