Qualifications Required for Bidders: (1) Not a person falling under Article 167-4 of the Local Autonomy Act (Cabinet Order No. 16 of 1947). (2) A person recognized as having bidding participation qualifications in accordance with Article 7 of the Maniwa City Construction Works Bidding Qualification Examination Regulations (Maniwa City Public Notice No. 22 of 2008). (3) Not subject to a bid suspension order from the Mayor of Maniwa City under the Maniwa City Construction Works Bidding Participation Qualification Recipient Designation Suspension Regulations (Maniwa City Public Notice No. 202 of 2006) between the date of the bid announcement and the date the successful bidder is determined. (Note 2) For works requiring a dedicated technician, if a single technician applies for bidding participation qualification for multiple works commissioned by Maniwa City, that technician will be assigned to the work for which the successful bid is first determined. Therefore, other bids for which the same technician applied for bidding participation qualification (limited to those conducted by Maniwa City, excluding works conducted in the same or adjacent locations (as recognized by Maniwa City) for which the same technician applied for bidding participation qualification as the chief technician) will be invalidated. In such cases, a withdrawal form must be submitted immediately for bids other than the one for which the successful bid was determined. However, if a bid has already been submitted, contact the relevant authority immediately. (Note 3) For works that require the approval of the Maniwa City Council in accordance with the Ordinance on Contracts Subject to Resolution by the Maniwa City Council and Acquisition or Disposal of Property (Maniwa City Ordinance No. 55 of 2005), if the assigned technician cannot be identified at the time of applying for bidding participation qualification, multiple technicians (up to 3) can be listed as assigned technicians for the bidding participation qualification application. Attached Sheet - 2 - (Note 4) For works requiring a dedicated technician, technicians who are currently engaged in other works as chief technicians, supervising technicians, or site supervisors at the time of applying for bidding participation qualification (excluding chief technicians engaged in other works conducted in the same or adjacent locations (as recognized by Maniwa City) as chief technicians or site supervisors) cannot be assigned as planned technicians, unless the completion period of the work in which they are engaged is before the day before the bid opening, or it is clear that the inspection to confirm the completion of the work in which they are engaged will be conducted by the day before the bid opening. 3. Confirmation of Bidding Participation Qualifications: (1) Basic confirmation of bidding participation qualifications conducted before bid opening: For all applicants who have expressed their intention to participate in the bidding by the deadline specified in the announcement through the Okayama Electronic Bidding Joint Utilization System (hereinafter referred to as the "Electronic Bidding System"), the following basic bidding participation qualifications will be confirmed before the bid opening. If deemed unqualified, they will not be allowed to participate in the bidding. A. Existence of Maniwa City Bidding Participation Qualification (limited to the industry related to the bid). B. The confirmation of bidding participation qualifications will be finalized by the post-bid opening confirmation of bidding participation qualifications specified in (2). (2) Confirmation of bidding participation qualifications conducted after bid opening: If a bid is received at a price equal to or less than the estimated price (or at a price equal to or greater than the minimum reserve price and less than or equal to the estimated price, if a minimum reserve price is set), the bid award will be suspended, and the qualifications of the lowest bidder (or the bidder with the lowest bid price among those who bid at a price equal to or greater than the minimum reserve price and less than or equal to the estimated price, if a minimum reserve price is set) will be confirmed one by one based on all bidding participation qualifications according to the announcement and this explanation, in order of lowest bid price. Confirmation will be completed when bidding participation qualifications are confirmed, and the bidding participation qualifications of other applicants will not be confirmed. Questions and Answers Regarding Design Documents, etc.: (1) Questions regarding design documents, etc., will only be accepted through the question and answer function of the electronic bidding system. The submission deadline and destination are as specified in the attached announcement. (2) Answers to questions in (1) will be provided as specified in the announcement. 5. Bid Execution: (1) Bids and bid openings will generally be conducted through the electronic bidding system. (2) The number of bid executions is limited to two. - 3 - (3) For the successful bidder, the bid price will be the amount written on the bid form plus an amount equivalent to 10% of that amount (if there is a fraction of less than one yen, that fraction will be rounded down). Therefore, bidders must enter the amount equivalent to 100/110 of their estimated contract amount (excluding consumption tax and local consumption tax) on the bid form, regardless of whether they are taxable or non-taxable businesses for consumption tax. (4) If a minimum reserve price system is established, bids below the minimum reserve price will be disqualified. (5) If no successful bidder is found, the bid will be considered unsuccessful. 6. Invalid Bids: Bids falling under any of the following categories will be considered invalid. If the successful bidder was determined from an invalid bid, the bid award decision will be revoked. (1) Bids submitted by persons who do not have the bidding participation qualifications specified in this announcement and explanation. (2) Bids submitted by persons who have made false statements in the application forms, etc. (3) Bids that violate the conditions specified in the announcement. (4) Bids falling under the categories listed in Article 13 of the Maniwa City Construction Works etc. Electronic Bidding Implementation Regulations. 7. Method of Determining the Successful Bidder: The successful bidder candidate will be the person who submitted the lowest valid bid within the limit of the estimated price according to Article 107 of the Maniwa City Financial Regulations (or the person who submitted the lowest valid bid within the limit of the estimated price and at or above the minimum reserve price, if a minimum reserve price is set). Subsequently, bidding participation qualifications will be examined, and the successful bidder will be determined. 8. Explanation to Unqualified Persons: (1) Persons deemed unqualified after the post-bid opening confirmation of bidding participation qualifications will be notified by the "Qualification Examination Result Notice" (Form No. 5). Those who receive the notice may request an explanation of the reasons from the Property Utilization Division as specified in the announcement. (2) Answers to the explanation requests in (1) will be provided as specified in the announcement. 9. Bid Security: Reduction or exemption will be granted if any of the items in Article 106 of the Maniwa City Financial Regulations (Maniwa City Regulations No. 54 of 2005) apply. 10. Contract Security: Shall be 10% or more of the contract amount. However, this may be substituted by providing interest-bearing national bonds or a guarantee from a financial institution or guarantee company recognized as reliable by Maniwa City (meaning a guarantee company as defined in Article 2, Paragraph 4 of the Law Concerning Guarantee Business for Advance Payment of Public Works (Law No. 184 of 1952)). Furthermore, if a performance guarantee bond for public works is provided or a performance guarantee insurance contract is concluded, the payment of the contract security will be waived. - 4 - 11.
