The successful tenderer is obliged to submit their offer with knowledge of this condition. Performance will be based on individual orders as per the draft contract. A professional commercial offer must be submitted as a price list. Bidding is mandatory for all lines of the table. The framework agreement is valid for 12 months from the date of entry into force (or for the extended period in case of extension) or until the framework amount is exhausted. The parties will determine the performance deadline for individual orders concluded under the contract in the individual orders, but the performance deadline cannot be shorter than 24 hours from the receipt of the order – the confirmation of the order by the Seller in EKR, i.e., the delivery obligation may also fall on a public holiday, taking into account the Buyer's obligation to perform its tasks: i.e., continuous availability must be ensured, taking into account Section 104 (3) of the Public Procurement Act. The exact name and technical parameters of the Products to be delivered are included in the technical description, which is part of the KD. The designation specified in the technical description and the table forming part thereof serves to clearly define the nature of the Product; alongside the designation of a specific make, origin, or type mentioned in the call or KD, the phrase "or equivalent" must always be added. In cases where the expected specification includes a specific requirement, the Contracting Authority will only be able to accept products that precisely meet that requirement, or the product specified in the requirement, due to veterinary and animal nutrition professional aspects. The specified requirements and conditions are the minimum requirements of the contracting authority; offers for products with more favorable characteristics for the contracting authority can also be submitted, so that Products meeting or exceeding the specified minimum conditions may be technically and commercially acceptable, with the understanding that more favorable offers will not be evaluated separately; the contracting authority applies the lowest price evaluation criterion, with the sum obtained by multiplying the unit price of the items in the table by the weight factor determined for each item constituting the price to be indicated on the reading sheet ("NET BID PRICE TO BE INDICATED ON THE READING SHEET"). The winner of the public procurement procedure must possess a valid certificate, attestation, or report issued by an external independent organization for the operation of a HACCP-food safety system, or an equivalent certified quality assurance system, or equivalent measures taken for quality assurance.
