In the individual detailed information of the tender information system, it was stated that the minimum reserve price was not set and the investigation standard price was set. However, as per the public notice (individual matters), we inform you that the minimum reserve price is correctly set.
1. General Competitive Tender (Electronic Bidding / Post-Verification / No Comprehensive Evaluation)
Public Notice (Common Matters)
Regarding construction work ordered by Kochi Prefecture, the common matters for conducting a general competitive tender using the post-verification method are as follows. Requirements such as the application submission deadline, bid opening date, and definition of similar construction work, which are set individually for each project, will be defined in the "Individual Matters for General Competitive Tender" (hereinafter referred to as "Individual Matters") separately. If there are any matters that are defined in both the public notice and the individual matters, the matters defined in the individual matters shall take precedence.
Section 1: Tender Participation Qualifications
All of the following requirements must be met.
1. Not be subject to the provisions of Article 167-4, Paragraph 2 of the Local Autonomy Act (Cabinet Order No. 16 of 1947).
2. Not have filed for commencement of bankruptcy proceedings under the Bankruptcy Act (Act No. 75 of 2004), commencement of corporate reorganization proceedings under the Corporate Reorganization Act (Act No. 154 of 2002), mediation for adjustment of specific debts etc. under the Act on Promotion of Adjustment of Specific Debts etc. (Act No. 158 of 1999), or commencement of rehabilitation proceedings under the Civil Rehabilitation Act (Act No. 225 of 1999). Those who have undergone such proceedings must have been re-certified for Kochi Prefecture construction work competitive tender participation qualifications through procedures separately determined by the Governor after the commencement of proceedings.
3. Not be subject to suspension of designation etc. based on the "Kochi Prefecture Construction Work Designation Suspension Measures" (Kochi Prefecture Public Notice No. 598 of August 2005) or the "Guidelines for Designation Avoidance Measures" (Notice from the Director of Civil Engineering, dated August 25, 2005, No. 17 Kokenkan No. 223) from the date of this announcement until before the determination of the successful bidder.
4. Not fall under the exclusion measures specified in Article 8, Item 9 of the Construction Industry Act (Act No. 100 of 1949) and Article 2, Paragraph 2, Item 5 of the "Regulations on the Exclusion of Gangs in Kochi Prefecture's Affairs and Business" (Kochi Prefecture Order No. 1 of March 2011).
5. There must be no relationship between the applicants that falls under any of the following criteria. If there is a capital or personnel relationship between two or more parties who have submitted the "Application for Confirmation of Eligibility for General Competitive Tender Participation" for this work, the participation eligibility of all parties with such a relationship will not be recognized.
(1) Capital Relationship: In the case of two entities falling under any of the following:
(a) Relationship between a subsidiary etc. (meaning a subsidiary etc. as defined in Article 2, Item 3-2 of the Companies Act (Act No. 86 of 2005); the same applies hereinafter) and a parent company etc. (meaning a parent company etc. as defined in Article 2, Item 4-2 of the same Act; the same applies hereinafter).
(b) Relationship between subsidiaries etc. that share the same parent company etc.
(2) Personnel Relationship: In the case of two entities falling under any of the following. However, this excludes cases where one of the companies etc. (meaning companies etc. as defined in Article 2, Paragraph 3, Item 2 of the Companies Act Enforcement Regulations (Ministry of Justice Ordinance No. 12 of 2006); the same applies hereinafter) is a company etc. undergoing rehabilitation proceedings as defined in Article 2, Item 4 of the Civil Rehabilitation Act (Act No. 225 of 1999) or a reorganized company (meaning a reorganized company as defined in Article 2, Item 7 of the Corporate Reorganization Act (Act No. 154 of 2002); the same applies hereinafter).
(a) When an officer of one company etc. (meaning officers as defined in Article 2, Paragraph 3, Item 3 of the Companies Act Enforcement Regulations, excluding the following; the same applies hereinafter) concurrently serves as an officer of the other company etc.
1) Director of a stock company. However, excluding the following:
(i) Directors who are audit committee members in a company with an audit committee as defined in Article 2, Item 11-2 of the Companies Act.
(ii) Directors in a company with a nominating committee etc. as defined in Article 2, Item 12 of the Companies Act.
(iii) Outside directors as defined in Article 2, Item 15 of the Companies Act.
(iv) Directors whose duties are not to be executed due to separate provisions in the articles of incorporation as stipulated in Article 348, Paragraph 1 of the Companies Act.
2) Executive officers of a company with a nominating committee etc. as stipulated in Article 402 of the Companies Act.
3) Members of a partnership company (meaning a general partnership company, limited partnership company, or limited liability company) as stipulated in Article 575, Paragraph 1 of the Companies Act (excluding members whose duties are not to be executed due to separate provisions in the articles of incorporation as stipulated in Article 590, Paragraph 1 of the same Act).
4) Directors of a joint venture.
5) Other persons executing business who are equivalent to those listed in 1) to 4).
(b) When an officer of one company etc. concurrently serves as a trustee appointed under Article 64, Paragraph 2 of the Civil Rehabilitation Act or Article 67, Paragraph 1 of the Corporate Reorganization Act (hereinafter referred to as "trustee") of the other company etc.
(c) When a trustee of one company etc. concurrently serves as a trustee of the other company etc.
(3) Other cases where the fairness of the tender is deemed to be impaired. Cases where a joint venture (including a joint venture) and its members participate in the same tender, or other cases where a capital or personnel relationship equivalent to the above (1) or (2) is recognized.
6. Meet the requirements specified in the Individual Matters. Construction performance must be completed and delivered by the time of application for tender participation.
Section 2: Method of Tender Participation, etc.
Those who wish to participate in the tender for this work must submit the application forms etc. specified in the Individual Matters by the deadline for submission of application forms etc. as follows:
1. Obtaining Application Forms etc. and Templates: Download from the Tender Information System or the Kochi Prefecture website.
(Note that uppercase and lowercase letters are case-sensitive. The same applies hereinafter.) 2. Submission Method:
(1) Application Forms etc.: Submit via the "General Competitive Tender Participation Qualification Confirmation Application Form Submission Screen" of the electronic bidding system within the submission period specified in the Individual Matters, by attaching the created electronic file. Applicants who do not submit the "General Competitive Tender Participation Qualification Confirmation Application Form (Form 1)" will be disqualified when they become the successful bidder candidate.
(2) Method of Creating Electronic Files: Create electronic files to be attached to the electronic bidding system in one of the following file formats. Also, be careful not to use functions that are lost when saving the file during creation.
① File formats readable by Word 2010, saved with the extension .docx or .doc (hereinafter referred to as "Word file").
② File formats readable by Excel 2010, saved with the extension .xlsx or .xls.
③ PDF format files.
④ Image files (JPEG format or GIF format).
⑤ In addition to the above, file formats specifically approved by the contracting authority (consult in advance).
Zip files should be used for compressing electronic files. Files submitted in formats other than the specified formats (including compressed files in other compression formats, such as self-extracting formats) will be treated as not submitted.
(3) If electronic file attachment is not possible when registering the application on the electronic bidding system (limited to cases due to system constraints, such as when the attached file size exceeds 5 megabytes):
a. Inform the contracting officer of the tender execution body by phone or other means that the electronic file cannot be attached and that it will be submitted separately, and obtain consent.
b. Submit in person or by mail etc. by 5:00 PM on the last day of the submission period for application forms etc., except when otherwise notified, after performing the application for confirmation of eligibility for tender participation via the "General Competitive Tender Participation Qualification Confirmation Application Form Submission Screen" of the electronic bidding system in accordance with (1).
If submitting by mail, it must be registered mail.
c. Submissions must arrive by the deadline. Please note that items arriving after the deadline, including due to postal circumstances, will not be accepted.
d. When submitting, place the written application form etc. in an envelope, clearly write the tender participant's name, work name, work number, and bid opening date on the front of the envelope, and seal it with "Application Form etc." written in red ink (it is permissible to fold the application form etc. and place it in a small envelope).
e. When submitting by mail etc., place the envelope from d into an envelope of a size that can accommodate it without folding, seal it, and write "Application Form etc. Enclosed" in red ink on the front of the envelope.
(4) Submission Place and Deadline: To be specified in the Individual Matters. "Closing day" in this announcement (including Individual Matters) refers to holidays as defined in the "Kochi Prefecture Holidays Act" (Kochi Prefecture Ordinance No. 2 of 1989) (Saturdays, Sundays, holidays as defined in the "Act on National Holidays" (Act No. 178 of 1948), and the period from December 29 to January 3 of the following year).
Section 3: Inspection of Design Documents, etc.
1. Inspection of Design Documents etc.: Design documents etc. can be viewed on the Tender Information System. Tender Information System https://ppi.pref.kochi.lg.jp/JuchuWeb/
2. Question and Answer:
(1) Inquiries should be made primarily through the Tender Information System. Responses will not be provided for inquiries made by phone or other methods.
(2) When submitting an inquiry, be sure to inform the contracting officer of the tender execution body by phone that you have sent it.
(3) Answers to inquiries will be provided primarily through the Tender Information System to those who made the inquiry and to those who submitted the application for confirmation of eligibility for tender participation in Section 2.
(4) Inquiry Submission Deadline and Answer Deadline: To be specified in the Individual Matters.
Section 4: Bidding Method
1. Bids shall be submitted by registering the bid amount on the electronic bidding system during the bidding period specified in the Individual Matters.
2. Bidders shall register an amount equivalent to 100/110 of their estimated contract desired amount on the electronic bidding system, regardless of whether they are subject to or exempt from consumption tax and local consumption tax. In addition, register a lottery number to be used for the electronic lottery according to the specifications defined by the bidding system. Note that the handling of electronic lotteries, including cases where a lottery number is not registered, will be handled separately.
For the determination of the successful bidder, the amount obtained by adding 10% of the amount registered on the electronic bidding system (rounded down to the nearest yen if there is a fraction of less than 1 yen) will be the successful bid price.
3. For construction work bids, a breakdown of construction costs must be created when registering the bid amount on the electronic bidding system, and attached as an electronic file in accordance with Section 2(2). The template for the breakdown of construction costs can be downloaded from the website of the Civil Engineering Department's Technology Management Division. Alternatively, if the matters to be stated in the template are included, it is not necessarily required to use this template.
4. If electronic file attachment is not possible when registering the bid amount on the electronic bidding system (limited to cases due to system constraints, such as when the attached file size exceeds 5 megabytes), submit in person or by mail etc. as follows, except when otherwise notified, by 5:00 PM on the bid closing date (or by the deadline for bid acceptance separately determined in the case of a re-tender). If submitting by mail, it must be registered mail.
(1) Place the written breakdown of construction costs in an envelope, clearly write the tender participant's name, work name, work number, and bid opening date on the front of the envelope, and seal it with "Breakdown of Construction Costs" written in red ink (it is permissible to fold the breakdown of construction costs and place it in a small envelope).
(2) When submitting by mail etc., place the envelope from (1) into an envelope of a size that can accommodate it without folding, seal it, and write "Breakdown of Construction Costs Enclosed" in red ink on the front of the envelope.
5. If electronic bidding cannot be performed due to a system failure on the electronic bidding system or Kochi Prefecture's side, the execution of the tender may be postponed. Furthermore, if electronic bidding cannot be performed for a long period, the bidding method may be switched to the method of placing paper bids in the bid box as stipulated in Article 5 of the "Construction Work Competitive Bidding Rules" (Notice from the Director of Civil Engineering, dated December 7, 2007, No. 19 Kokenkan No. 808). In such cases, participants will be notified separately.
6. If electronic bidding cannot be performed due to a failure on the bidder's side (e.g., equipment malfunction), bidding using bid forms (Form No. 1 of the Appendix to the "Construction Work Electronic Competitive Bidding Rules" (Notice from the Director of Civil Engineering, dated January 15, 2010); hereinafter referred to as "bid form") may be permitted upon application, depending on the situation.
7. In the event that re-acquisition procedures for electronic certificates become necessary due to unforeseen circumstances, or in the event of communication failures due to natural disasters etc., bidding using bid forms may be permitted upon application.
8. For bids permitted to use bid forms as per the preceding two paragraphs, the bid form will be opened by the bid execution officer at the time of bid opening, its contents registered in the electronic bidding system, and then the bid opening will be conducted via the electronic bidding system.
9. In the case of tenders where the estimated price is publicly announced afterwards, if there are no bids that can be successful (e.g., all bidders' bids exceed the estimated price), a re-tender will be conducted up to two times. If a re-tender is held, participants will be notified of this fact via email immediately after the bid opening.
10. The deadline for accepting bids in a re-tender will be 11:00 AM on the day following the bid opening date of the tender in question (or the next business day if that day is a closing day), unless otherwise notified, and the bid opening will be conducted immediately after the acceptance deadline. Bidders shall bid using the methods described in 2 to 7. The submission of the breakdown of construction costs will have the same deadline as the bid acceptance deadline. Therefore, in a re-tender as well, the breakdown of construction costs must be submitted via the electronic bidding system.
Section 5: Invalid Bids
Bids falling under Article 9 of the "Construction Work Electronic Competitive Bidding Rules" (Notice from the Director of Civil Engineering, dated January 15, 2010; hereinafter referred to as "Rules" in this Section 5) are invalid. Furthermore, bids falling under Article 4, Paragraph 1, Item 6 or Item 7 of the "Guidelines for Trial Implementation of the One-Bid-Per-Bidder Method in General Competitive Tenders and Designated Competitive Tenders" (Notice from the Director of Civil Engineering, dated June 24, 2019, No. Moto-Ko-Dosei No. 312) are also invalid.
Section 6: Disqualified Bids
Bidders falling under Article 10 of the Rules will be disqualified.
Section 7: Loss of Tender Participation Qualification
Any person falling under either (1) or (2) below cannot participate in the tender for this work. For bidders who have already submitted a bid, they will be disqualified.
(1) Those who no longer meet any of the tender participation qualifications from the date of the announcement until before the determination of the successful bidder.
(2) Those who have been found to have made a false application in their tender participation qualification application.
Section 8: Method of Determining the Successful Bidder
1. After the bid opening, a "Notice of Hold" (notification that the bid results are on hold for post-verification) will be sent to bidders via the electronic bidding system, and a "Notice of Successful Bidder Determination" will be sent after the successful bidder is determined.
