The qualifications required for participation in the tender are as follows: (1) Must be listed in the Reiwa 7 & 8 Fukaya City Construction Works Tender Participant Qualification Register (hereinafter referred to as the "Qualification Register") based on the Fukaya City Construction Works Tender Participant Qualification Regulations (Heisei 21, Fukaya City Ordinance No. 30). (2) Must have a head office in the city and have a representative with the authority to conclude contracts. (3) Must be registered in the Civil Engineering Works category and be rated as Special A or A class. (4) Must not fall under Article 167-4 of the Order. (5) Must not have been subject to suspension or exclusion from bidding under the Fukaya City Contract Bid Suspension Measures Ordinance and the Fukaya City Bid Exclusion Measures for Violence Exclusion from Contracts from the date of this announcement until the contract is concluded. (6) Must hold a permit under Article 3 of the Construction Industry Act (Showa 24, Act No. 100) for the work category corresponding to this project. However, if the total amount of subcontracted work is equal to or exceeds the amount specified in Article 2 of the Construction Industry Act Enforcement Order (Showa 31, Cabinet Order No. 273), a specific construction industry permit must be held. (7) Must be able to appoint a technician in accordance with Article 26 of the Construction Industry Act for the execution of the work. The assigned technician shall comply with the provisions of the Construction Industry Act, the Construction Industry Act Enforcement Order, and the Fukaya City Regulations on the Handling of Technician Assignment in Construction Works, etc. (8) Must not be a company for which rehabilitation proceedings have been initiated under the Corporate Rehabilitation Act (Heisei 14, Act No. 154) or for which reorganization proceedings have been initiated under the Civil Rehabilitation Act (Heisei 11, Act No. 225). However, this does not apply to companies for which proceedings have been initiated. (9) Must have undergone a business performance review with a review standard date on or after July 1, 1 year and 7 months prior to the bid opening date, for the relevant industry, in accordance with Article 27-23, Paragraph 1 of the Construction Industry Act. (10) Must not have any capital or personnel relationship with other tender participants. (11) Must be enrolled as an employer in health insurance under the Health Insurance Act (Taisho 11, Act No. 70), employees' pension insurance under the Employees' Pension Insurance Act (Showa 29, Act No. 115), and employment insurance under the Employment Insurance Act (Showa 49, Act No. 116) as of the bid announcement date. However, this does not apply to those for whom all or part of the above insurance is legally exempt. 7. Confirmation of eligibility for tender participation will be conducted after the tender execution, based on the Fukaya City General Competitive Bidding for Construction Works (Post-Qualification Review Type) Guidelines. 8. Questions regarding design documents, etc., must be submitted via the Electronic Bidding System within the reception period. (1) Reception Period: From Tuesday, September 15, Reiwa 8 (2026), 9:00 AM to Tuesday, September 29, Reiwa 8 (2026), 12:00 PM (excluding times when the Electronic Bidding System is not operational). (2) Answers to questions will be posted on the Electronic Bidding System by Thursday, October 1, Reiwa 8 (2026). 10. A minimum restriction price will be set in accordance with Article 4, Paragraph 1 of the Fukaya City Minimum Restriction Price System Handling Guidelines. 11. The bid bond is waived in accordance with Article 8 of the Fukaya City Contract Regulations. 12. The contract deposit must be paid at a rate of 10% or more of the contract amount in accordance with Article 28, Paragraph 1 of the Fukaya City Contract Regulations. 13. Payment Terms (1) Advance payment will be applicable for contract amounts exceeding 3 million yen. (The amount shall be within 4/10 of the contract amount.) (2) Intermediate advance payment will be applicable for contract amounts exceeding 5 million yen and construction periods exceeding 60 days. (The amount shall be within 2/10 of the contract amount.) (3) Partial payments will not be made. 14. Method of determining the successful bidder, etc. (1) After the bid opening, the bidder who submitted the lowest bid within the range of the estimated price and above the minimum restriction price will be the successful bid candidate. The name of the successful bid candidate will be stated in the reason column of the notification letter sent from the Electronic Bidding System. (2) The successful bid candidate must submit the "Confirmation of Eligibility for Tender Participation Application," "Confirmation of Eligibility for Tender Participation Documents," and "Social Insurance Enrollment Confirmation Documents," etc., within 2 days from the day after receiving the notification letter (excluding city holidays as defined in Article 1 of the Fukaya City Holidays Ordinance (Heisei 18, Fukaya City Ordinance No. 2)). (3) This project is subject to a labor cost dumping investigation. If the direct construction cost stated in the bid amount breakdown sheet falls below a certain level, the reason will be promptly investigated after the bid opening. The investigation will be limited to the successful bid candidate and will be notified separately. Failure to provide a reason may result in the bid being deemed invalid for violating tender conditions. (4) If the successful bid candidate is found to meet the eligibility requirements after the tender qualification review, they will be declared the successful bidder. (5) If there are two or more bids at the same price for the successful bid candidate price, the successful bid candidate will be determined by electronic lottery using the Electronic Bidding System. (6) If there is a possibility of an event affecting the construction period or contract amount, the successful bidder must notify the contracting authority by the time the contract is concluded, along with information necessary to grasp the situation of the event, using Form No. 1 of the Fukaya City Tender Participant's Handbook (related to Article 29), in accordance with Article 20-2, Paragraph 2 of the Construction Industry Act (Showa 24, Act No. 100). 15. Concurrent site manager duties will be handled in accordance with the handling guidelines for the relaxation of the site manager's continuous presence obligation. 16. Notes on Bidding (1) For the determination of the successful bid, the contract amount will be the amount written on the bid form plus 10% of that amount (if there is a fraction of less than 1 yen, the fraction will be rounded down). Therefore, bidders, regardless of whether they are taxable or tax-exempt for consumption tax and local consumption tax, must write the amount equivalent to 100/110 of the desired contract amount on their bid forms. (2) Download the forms from the Electronic Bidding System and submit the bid amount breakdown sheet along with the bid form at the time of bidding. However, the bid amount breakdown sheet is not required for re-bids. (3) Even if a confirmation of eligibility for tender participation application has been received through the Electronic Bidding System, those who do not meet the eligibility requirements at the time of bid opening cannot participate in the tender. (4) If, after the bid opening, there are no bids within the estimated price range and above the minimum restriction price, a re-bid will be conducted. (5) Re-bids will be conducted up to two times. The date and time of the re-bid will be notified via the re-bid notification on the Electronic Bidding System. (6) Participants in the first re-bid will be those who participated in the initial bid. However, those whose bids were invalidated or who were disqualified in the initial bid cannot participate in the first re-bid. (7) Participants in the second re-bid will be those who participated in the first re-bid. However, those whose bids were invalidated or who were disqualified in the first re-bid cannot participate in the second re-bid. (8) Bids that fall under Article 17 of the Fukaya City Tender Participant's Handbook will be deemed invalid. 17. Postponement of Bidding, etc. (1) If deemed necessary, bidding may be postponed, suspended, or canceled. (2) In the case of (1), the city will not bear any costs incurred for the bidding. 18.
