Bidding Method: Bidding procedures for this construction will be conducted through the electronic bidding system. If the applicant and the electronic bidder are different, an electronic bidding delegation form must be submitted. 3. Bidding Participation Qualifications: Bidders must meet all of the following requirements. (1) Must not fall under the provisions of Article 167-4 of the Local Autonomy Act. (2) Must be registered in the Kazuno City Bidding Participant Qualification List (according to the rated work type and grade indicated in the "Outline of Construction Work" (hereinafter referred to as "Outline")). (3) Must have obtained a construction industry permit in accordance with Article 3 of the Construction Industry Act (Showa 22, Act No. 100) (according to the permitted industry type and permit classification indicated in the Outline). (4) For the permitted industry type indicated in the Outline, must have undergone the management performance review in accordance with Article 27-23 of the Construction Industry Act on or after the end of the business year immediately preceding the date of concluding the contract by one year and seven months. (5) Must not have been subject to a designation suspension measure by Kazuno City during the period from the submission deadline of the competitive bidding participant qualification confirmation application form to the date of award determination. (6) Must have a business office in the location indicated in the Outline among the business offices stipulated in Article 3 of the Construction Industry Act. (7) The supervising engineer or chief engineer (hereinafter referred to as "Supervising Engineer, etc.") to be assigned to this construction must be assigned as follows: ① When a full-time Supervising Engineer, etc. is required by the Outline: Must be able to assign a person with the qualifications of the planned engineer indicated in the Outline on a full-time basis (limited to those who have been in a direct and continuous employment relationship with the bidder for three months or more prior to the deadline for submitting the bidding participation qualification confirmation application. Also, must not be a person who is a "business management supervisor" as stipulated in Article 7, Paragraph 1 or Article 15, Paragraph 1 of the Construction Industry Act, or a "full-time engineer of a business office" as stipulated in Article 7, Paragraph 2 or Article 15, Paragraph 2 (regardless of the permitted industry type)). ② When a chief engineer who does not require full-time assignment is required by the Outline: Must be able to assign a person who has been in a direct and continuous employment relationship with the bidder for three months or more prior to the date of submitting the bidding participation qualification confirmation application as the chief engineer for this construction. (However, this excludes persons who are assigned full-time or continuously to other construction projects during the construction period of this project.) (8) Must not be a person who has filed for commencement of rehabilitation proceedings under the Company Rehabilitation Act (2002 Act No. 154) or filed for commencement of civil rehabilitation proceedings under the Civil Rehabilitation Act (1999 Act No. 225) (excluding those for whom a decision to commence proceedings has been made). (9) Regarding organized crime groups, must not fall under any of the following: ① Being recognized as an organized crime group as defined in Article 2, Item 2 of the Act on Prevention of Unjustifiable Acts by Boryokudan Members, etc. (1991 Act No. 77; hereinafter referred to as "Boryokudan Countermeasures Act"). ② Being recognized as a member of an organized crime group as defined in Article 2, Item 6 of the Boryokudan Countermeasures Act (hereinafter referred to as "Boryokudan Member"). ③ Using an organized crime group or Boryokudan Member for the purpose of profiting oneself, one's company, or a third party, or causing damage to a third party. ④ Cooperating or being involved directly or actively in the maintenance or operation of an organized crime group by supplying funds or providing benefits to an organized crime group or Boryokudan Member. ⑤ Being recognized as having a socially reprehensible relationship with an organized crime group or Boryokudan Member. ⑥ Being recognized as using an organized crime group, Boryokudan Member, or any person falling under items ③ to ⑤ above inappropriately, while knowing that they are such. (10) Must not be a person who performed the survey, planning, or design work for this construction. (11) Must not have any tax arrears. (12) Other bidding participation qualification requirements are as described in the Outline. 4. Bidding Participation Qualification Confirmation Application, etc. (1) Distribution of materials required for bidding application: Check on the Kazuno City website or within the electronic bidding system. (2) Submission of bidding participation qualification application form: Bidders wishing to participate in the bidding must submit the competitive bidding participant qualification confirmation application form and bidding participation qualification confirmation materials to the Contract and Treasury Management Office via the electronic bidding system by the deadline indicated in the Outline. (3) Confirmation of bidding participation qualification: Confirmation of bidding participation qualification will be conducted after the opening of bids, primarily for the bidder(s) who need to be confirmed to be the successful bidder (hereinafter referred to as "successful bid candidate(s)"). Confirmation will not be conducted for others. (4) Withdrawal from bidding: A bidder who has submitted a bidding participation qualification confirmation application form and subsequently becomes ineligible to participate in the bidding before the award determination must promptly submit a bidding withdrawal notification form before the opening of bids, or a notification stating such after the opening of bids. (5) Inspection of design documents, etc.: ① The method of inspection and borrowing of design documents, specifications, drawings, etc. (hereinafter referred to as "design documents, etc.") for this construction shall be in accordance with the provisions of the "Handling Guidelines for Inspection of Design Documents, etc." (Reiwa 27, Administrative Notice No. 102). ② The inspection period shall be as indicated in the Outline. (6) Questions and answers regarding design documents, etc.: The method for questions and answers regarding design documents, etc. shall be in accordance with the provisions of the "Handling Guidelines for Inspection of Design Documents, etc." (Reiwa 27, Administrative Notice No. 102). The question deadline and answer deadline shall be as indicated in the Outline. Please check the questions and answers on the website before submitting your bid form, etc. 5. Bid Security Deposit and Contract Security Deposit: (1) Bid Security Deposit: Exempt. (2) Contract Security Deposit: An amount not less than 1/10 of the contract amount. (However, for construction with a design cost of less than 5 million yen, the contract security deposit is generally exempted.) Payment methods, etc., shall be in accordance with the provisions of the Kazuno City Financial Regulations (Reiwa 11, Kazuno City Regulations No. 12; hereinafter referred to as "Financial Regulations"). 6. Place and Time of Bidding and Submission of Bid Forms, etc.: (1) Submission Method: Submit via the electronic bidding system by the deadline indicated in the Outline. However, those who have difficulty using the electronic bidding system (limited to cases approved by the bidding executive officer in accordance with Article 8 or Article 9 of the Kazuno City Public Works Electronic Bidding Operation Standards) may use the paper bidding method. (2) Amount to be stated in the bid form: ① When determining the successful bidder, the contract amount will be the amount stated in the bid form plus 10% of that amount. Therefore, bidders shall state an amount equivalent to 110/100 of their estimated contract amount, regardless of whether they are taxable or tax-exempt businesses for consumption tax. ② Bid amount shall be in units of one thousand yen. (3) Submission of bid breakdown: For bids where the estimated price is publicly announced in advance, or for bids announced afterward, submit a bid breakdown corresponding to the amount stated in the first bid form. The bid breakdown must include the company name or trade name. (4) Other: ① For bids where the estimated price is publicly announced in advance, the number of bidding rounds will be one. For bids where the estimated price is not publicly announced at the time of the bidding announcement, up to one re-bid will be held. ② Bidding will be conducted even if there is only one bidder. 7. Method of Determining the Successful Bidder: (1) The bidder who submitted a bid within the limit of the estimated price (or, if a minimum price limit is set, the bidder who submitted a bid at or above the minimum price limit within the limit of the estimated price) with the lowest bid price will be the successful bid candidate. In this case, if there are two or more bidders with the lowest bid price, the order will be determined by drawing lots, and the highest-ranked bidder will be the successful bid candidate. (2) The bidding participation qualifications of the successful bid candidate in (1) will be confirmed. If the qualifications are confirmed and the candidate does not fall under any of the following, the successful bid candidate will be the successful bidder. ① When it is recognized that the contract cannot be performed in accordance with its contents due to the bid price of the successful bid candidate. ② When it is recognized that concluding a contract with the successful bid candidate would disrupt the order of fair trade and is significantly inappropriate. (3) If a successful bidder is not determined under (2), the bidder who submitted a bid within the limit of the estimated price (or, if a minimum price limit is set, the bidder who submitted a bid at or above the minimum price limit within the limit of the estimated price) with the next lowest bid price after the successful bid candidate will be the successful bid candidate (if there are two or more such bidders, the highest-ranked bidder will be determined by the method in the latter part of (1)). However, if the successful bid candidate was determined by drawing lots, the next ranked bidder in that drawing will be used. Confirmation, etc., will be performed for this successful bid candidate. (4) The above method will be repeated sequentially until a successful bidder is determined. (5) If the successful bid candidate is determined to be ineligible, the contracting authority will notify the successful bid candidate with a qualification confirmation result notice explaining the reason for the ineligibility. (6) The recipient of the notice in (5) may request an explanation of the reason for the ineligibility in writing to the contracting authority within two days (excluding holidays as defined in Article 1, Paragraph 1 of the Kazuno City Holiday Designation Ordinance (1990 Kazuno City Ordinance No. 23)) from the day following the date of the notice. (7) In the case of a bid to which the low bid price investigation system is applied, if the lowest bid price is below the investigation standard price, the successful bid candidate will be determined according to the provisions of the "Kazuno City Low Bid Price Investigation System Implementation Guidelines" (2001 Kazuno City Administrative Notice No. 31) and the "Kazuno City Low Bid Price System Operation Manual" (2001 Kazuno City Administrative Notice No. 32). After confirming the bidding participation qualifications of the successful bid candidate (if there are two or more, the highest-ranked bidder determined by drawing lots), if the qualifications are confirmed, that successful bid candidate will be the successful bidder. If the successful bid candidate is determined to be ineligible, the provisions of (5) and (6) shall apply. 8. Invalid Bids: Bids falling under any of the following are invalid. (1) Bids made by persons who do not have the qualification to participate in the competition (persons other than those who have obtained the right to participate in the bidding). (2) Bids made by persons who have not submitted or provided the prescribed bid security deposit or collateral in lieu of a bid security deposit (excluding those who have been exempted from the entire bid security deposit). (3) Bids lacking a signed and sealed name. (4) Bids with corrected amounts. (5) Bids where the expression of intent is unclear due to typos, omissions, etc. (6) Bids that are clearly deemed to be collusive. (7) In bids where the estimated price is publicly announced in advance, bids with an amount exceeding the estimated price. 5 (8) In bids where the minimum price limit is applied, bids with an amount below the minimum price limit. (9) Other bids that violate the bidding conditions. 9. Assigned Engineers (When full-time assignment of supervising engineers, etc., is required): (1) The successful bidder must assign the planned engineer(s) stated in the bidding participation qualification confirmation application form, etc., to the site of the construction. (2) If a bidder becomes unable to assign the planned engineer(s) stated in the bidding participation qualification confirmation application form, etc., to this construction due to being awarded another contract, they must promptly report this to the contracting authority. (3) If a bidder who has become unable to assign an engineer to this construction has already been awarded the contract, their bid will be deemed invalid. 10. Other: (1) When registering to participate in bids with the city, if you have delegated the authority to bid and contract to a branch office or business office, please apply from the delegated branch office or business office, not from the head office/main office. If the delegated office has difficulty bidding electronically and the head office/main office will bid, please submit an electronic bidding delegation form. (2) Bidding explanation meetings and on-site briefing sessions will not be held. (3) Hearing regarding bidding participation qualifications will not be held. However, explanations may be requested if deemed necessary. (4) The completion deadline may be changed due to circumstances. (5) Bidders must be familiar with the design documents, etc., and comply with the bidding instructions and precautions for bidding. (6) For projects where the low bid price investigation system is applied according to the Outline, the system will be operated in accordance with the "Kazuno City Low Bid Price Investigation System Implementation Guidelines" (2001 Kazuno City Administrative Notice No. 31) and the "Kazuno City Low Bid Price System Operation Manual" (2001 Kazuno City Administrative Notice No. 32), as well as the following: ① Bidders must cooperate with the smooth implementation of the investigation if they are subject to the low bid price investigation. ② When a contract is concluded after a low bid price investigation, if subcontracting is involved, consideration must be given to ensure that the low-price contract does not lead to unreasonable burdens on subcontractors. (7) For projects where the minimum price limit system is applied according to the Outline, the system will be operated in accordance with the "Kazuno City Construction Work Minimum Price Limit System Implementation Guidelines" (2009 Kazuno City Administrative Notice No. 82). (8) The date of award notification may be changed due to circumstances. (9) If the successful bidder fails to meet the requirements listed in 3 between the date of award determination and the date of contract conclusion, the contracting authority may not conclude the contract with that successful bidder. (10) If the successful bidder does not conclude the contract (or provisional contract for contracts requiring the approval of the assembly as stipulated in Article 121 of the Financial Regulations) within five days from the date of award determination, the award will lose its validity. However, if there are unavoidable circumstances that prevent the conclusion of the contract, this period may be extended with the prior consent of the contracting authority. (11) Matters not stipulated in this announcement shall be governed by the Local Autonomy Act, the Local Autonomy Act Enforcement Order, the Local Autonomy Act Enforcement Regulations, the Kazuno City Financial Regulations, and the Kazuno City Competitive Bidding Procedures Manual.
