Tender Participation Qualifications: Matters concerning qualifications for participating in tenders (hereinafter referred to as "Qualifications") based on Article 167-5, Paragraph 1 of the Local Government Act (Local Government Order No. 16 of 1947, hereinafter referred to as "Enforcement Order"). The same applies hereinafter. Must be registered as a waterworks contractor in the "Kushiro City Construction and Other Competitive Tender Participation Qualification List for 2025-2026" and have received a "A" rating. 3. Tender Participation Conditions: Matters concerning conditions for participating in tenders (hereinafter referred to as "Conditions") based on Article 167-5, Paragraph 2 of the Enforcement Order. Those wishing to participate in the tender must meet all of the following conditions as of the application date. (1) Not falling under Article 167-4 of the Enforcement Order. (2) Not subject to suspension of bidding measures based on the "Kushiro City Construction and Other Competitive Tender Suspension Handling Guidelines" from the date of announcement to the date of tender execution. (3) Not a person for whom commencement of rehabilitation proceedings has been filed under the Company Rehabilitation Act (Act No. 154 of 2002) or commencement of rehabilitation proceedings has been filed under the Civil Rehabilitation Act (Act No. 225 of 1999). However, this does not apply if re-certification of Kushiro City's competitive tender participation qualification has been obtained after a decision to commence rehabilitation proceedings or rehabilitation proceedings. (4) Not a "Boryokudan" (organized crime group), a member of a "Boryokudan," or a business operator related to a "Boryokudan" as defined in Article 2 of the Kushiro City Ordinance on the Exclusion of "Boryokudan" (Kushiro City Ordinance No. 33 of 2012). (7) Must not have received two consecutive "E" rank evaluations under the "Kushiro City Contract Work Performance Evaluation Guidelines" in the two years prior to the application date. (8) Not be a contractor for design work related to this project or a related party in terms of capital or personnel relations with such contractor. (9) There must be no relationship between persons wishing to participate in the tender that falls under any of the following criteria. Capital and personnel relations in (8) and (9) refer to the following. Explanation of Reasons for Disqualification: Persons deemed ineligible to participate in the tender may request an explanation of the reasons for disqualification from the City. Date and Time and Location of Tender Execution: (1) Date and Time: August 25, 2026, 10:00 AM. (2) Location: Conference Room B, 5th Floor, Kushiro City Disaster Prevention Building, 8-2 Kurogane-cho, Kushiro City. 9. Minimum Reserve Price System: A minimum reserve price will be set according to the "Kushiro City Minimum Reserve Price Setting Guidelines" and will be publicly announced after the fact. 10. Tender Method, etc.: (1) Bidders must fill out and submit the prescribed tender form and breakdown of tender amount. (2) For the purpose of determining the successful bidder, the amount obtained by adding 10% of the amount written on the tender form to the amount (if there is a fraction of less than 1 yen, that fraction shall be rounded down) shall be the successful bid price. Therefore, bidders should write the amount equivalent to 100/110 of their estimated contract price on the tender form, regardless of whether they are subject to or exempt from consumption tax. (3) The number of tenders shall be up to three. However, those who withdraw from participation or submit an invalid bid in the first or second tender shall not be allowed to participate in subsequent tenders. (4) If no bid is submitted at or below the estimated price in the third tender, a non-competitive contract will be negotiated. In the case of a non-competitive contract, quotations will be requested from two or more bidders, including the bidder with the lowest bid price. (5) If a non-competitive contract cannot be concluded, the tender will be canceled, and a new tender will be announced. 11. Invalid Tenders: Tenders falling under any of the following items shall be invalid. (1) Tenders falling under any of the items in Article 10 of the Contract Regulations. (2) Tenders submitted by persons who do not meet the conditions specified in this announcement. (3) Tenders submitted by persons who have made false statements in their application documents. (4) Other cases falling under Article 8 of the "Kushiro City Construction and Other Competitive Tender Guidelines" (hereinafter referred to as "Tender Guidelines"). 12. Tender Security: Exempt from tender security in accordance with Article 6, Item 3 of the Contract Regulations and Article 2, Section 1, Item 3, Item 2(b) of the "Kushiro City Contract Regulations Enforcement" (Kushiro City Notice No. 3 of 2005, hereinafter referred to as "Regulations Enforcement"). 13. Method of Determining Successful Bidder, etc.: (1) The bidder who submitted the lowest bid price within the range of the estimated price shall be determined as the successful bidder. However, bidders who submit bids below the minimum reserve price will be disqualified and will not be allowed to participate in subsequent tenders. (2) If there are two or more bidders who submitted the lowest valid bid price, the successful bidder will be determined by drawing lots among them. In this case, refusal to draw lots is not permitted. 14. Publication of Tender Results: Tender results will be published on the Kushiro City Hall website by 5:00 PM on the day of the tender. 15. Submission of Contract Price Breakdown: (1) The successful bidder must promptly submit a breakdown of the contract price after the award of the contract. (2) The format of the breakdown of the contract price is free, but it must at least clarify the quantity, unit price, amount, material costs, labor costs, statutory welfare costs, safety and health expenses, and contributions to the construction industry retirement fund. (3) The breakdown of the contract price is requested as a reference document. 16. Contract Conclusion Deadline: The deadline for concluding the contract for this project shall be August 31, 2026. Failure to conclude the contract within the deadline will result in the cancellation of the award. 17. Contract Security: (1) Upon conclusion of the contract for this project, contract security of 10% or more of the contract amount for this project must be paid in accordance with Article 29 of the Contract Regulations. a. (2) Notwithstanding (1), if the successful bidder falls under any of the provisions of Article 30 of the Contract Regulations, the contract security will be waived. 18. Requirement for Contract Document: Required. 19. Method of Contract Payment: (1) Advance Payment: An advance payment may be made in accordance with Article 58, Paragraph 1 of the Contract Regulations. (2) Interim Advance Payment: An interim advance payment may be made in accordance with Article 58, Paragraph 2 of the Contract Regulations. (3) Partial Payment: Partial payment will not be made. 20. Law Concerning the Recycling of Materials in Construction Work, etc.: Applicable. 21. Site Supervisor: In cases where the "Kushiro City Ordinance on the Assignment of Site Supervisors, Chief Engineers, etc. for Commissioned Works (Effective April 1, 2025)" applies, concurrent assignment of site supervisors is permitted. 22. Other: (1) The language and currency to be used in tender and contract procedures shall be Japanese and the currency of Japan, respectively. (2) In addition to the foregoing provisions, bidders must comply with the Local Government Act (Act No. 67 of 1947), the Enforcement Order, the Contract Regulations, the Regulations Enforcement, the Tender Guidelines, and other laws and regulations related to tenders and contracts.
