Delivery period of goods: from the date of signing the contract until 08/20/2026 (inclusive). The Supplier delivers the goods according to the specification (Appendix No. 1) to the contract and in accordance with the technical specification (Appendix No. 1.1), on working days from 8:00 to 15:00, in batches (delivery volumes are determined by the Customer in the request (by phone or email or instant message (Viber or WhatsApp)), within 3 (three) working days from the date of receipt of such request. The volume of each batch is determined by the Customer depending on the actual need. A batch of goods under the contract is considered the delivery of goods in the volume determined by each individual request of the Customer.
Place of delivery of goods: warehouse of the COMMUNAL NON-PROFIT ENTERPRISE "DNIPROPETROVSK REGIONAL CLINICAL HOSPITAL NAMED AFTER I.I. MECHNIKOV" OF THE DNIPROPETROVSK REGIONAL COUNCIL", Soborna Square, building 14, Dnipro city, 49005, Ukraine. Unloading of goods is carried out in the hospital warehouse premises by the Supplier's representatives.
Method of goods delivery: When delivering, the goods must be accompanied by documents provided for by current legislation of Ukraine, in particular, a copy (copies) of the valid document(s) confirming the compliance of the procurement item with the requirements of technical regulations for medical devices with appendices (if any), or a notification of placing into circulation and use of individual medical devices for which the requirements of technical regulations have not been met, but their use is necessary in the interests of public health, duly certified by the Supplier, as well as quality certificate(s)/passport(s), instructions for use, etc. In primary documents (invoices, delivery notes, etc.), the Supplier must indicate wholesale prices and the amount of trade (retail) markup in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated 03/25/2009 No. 333 "Some issues of state regulation of prices for medicines and medical devices" (as amended) and/or the Resolution of the Cabinet of Ministers of Ukraine dated October 17, 2008 No. 955 "On measures to stabilize prices for medicines and medical devices" (as amended), if the cost of medical devices is subject to reimbursement in accordance with the law.
The Supplier ensures such packaging of goods as is necessary to prevent damage or spoilage during transportation to the final destination specified in the contract. The goods are supplied to the Customer in packaging that ensures storage during transportation and meets established standards. The goods are transferred to the Customer in the manufacturer's packaging, which must not be deformed or damaged. The packaging must contain markings in accordance with the manufacturer's standards, which allow identification of the goods, their origin, and production date. Transportation of goods is carried out by vehicles that comply with the conditions for transporting medical devices.
Acceptance and transfer of goods are carried out at the Customer's warehouse according to the accompanying documents: delivery note, cargo-delivery note.
Transfer of risks for the goods occurs at the moment of transfer of goods according to the delivery note.
The Supplier is responsible for damage to the goods as a result of transportation until the goods are transferred to the Customer at the place of delivery.
Payment terms for goods: Settlements for delivered goods are made on the basis of paragraph 1 of Article 49 of the Budget Code of Ukraine according to the invoice(s) based on the delivery note(s) on deferred payment terms up to 30 (thirty) calendar days and on the basis of the Resolution of the Cabinet of Ministers of Ukraine dated 06/09/2021 No. 590 "On approval of the Procedure for exercising powers by the State Treasury Service in a special regime under martial law" – as amended. In case of delay in budget financing, settlements for delivered goods are made within 3 (three) working days from the date of receipt of budget funds by the Customer for financing the purchase to its registration account.
Payments for goods are made in non-cash form.
Funding source – local (regional) budget (additional funds according to the limit certificate of budget appropriations and lending for 2026).
Based on paragraphs 1 and 4 of Article 23 of the Budget Code of Ukraine, any budget commitments and payments from the budget are made only if there is a corresponding budget appropriation. Expenditures from the special fund of the budget are made exclusively within the limits and at the expense of actual revenues of the special fund of the budget.
Budget commitments are undertaken by the Customer within the limits of budget appropriations. Budget financial commitments from the special fund of the budget are undertaken by the Customer exclusively within the limits of the corresponding actual revenues of the special fund of the budget.
ATTENTION! The quantitative requirements of the goods offered by the Supplier must comply with the requirements specified in the request for proposals from suppliers, in particular in the draft contract, which is an integral part of the request for proposals from suppliers, and the proposals of the successful bidder.
