Construction Overview (1) Construction Name: National Hospital Organization Yamaguchi Ube Medical Center General Ward 3F (Tuberculosis Ward) Air Handling Unit Replacement Work (2) Construction Location: Within National Hospital Organization Yamaguchi Ube Medical Center, 685 Higashi-kiwa, Ube City, Yamaguchi Prefecture (3) Construction Contents: The air handling unit installed on the 3rd floor of this hospital is malfunctioning, so the equipment will be replaced and connected to the existing central control panel. (4) Construction Period: Approximately 5 months (Final completion deadline: December 27, Reiwa 8 (2026)) 2. Eligibility for Participation in Competition: (1) Must meet one of the following conditions: ① Persons who do not have the capacity to conclude a contract, bankrupt persons who have not been reinstated, persons falling under any of the items in Article 32, Paragraph 1 of the Act on Prevention of Unjustifiable Acts by Violent Group Members (Heisei 3, Act No. 77), and persons falling under any of the items in Article 2, Paragraph 1 of the National Hospital Organization "Regulations on Response to Anti-Social Forces" (Heisei 27, Regulations No. 63), unless there are special reasons. Minors, persons under guardianship, or persons under assistance who have obtained the necessary consent for contract conclusion fall under special reasons. ② Persons who fall under any of the following categories and for whom a certain period has not elapsed since the fact occurred. The same applies to persons who use such persons as agents, managers, or other employees. The period, etc., shall be in accordance with the suspension of bidding period, etc., based on the "Guidelines for Suspension of Bidding, etc., for Contracts" issued by the Director of the National Hospital Organization. i. Persons who intentionally performed construction, manufacturing, or other services in a shoddy manner, or who engaged in fraudulent acts regarding the quality or quantity of goods during contract performance. ii. Persons who obstructed fair competition, or who conspired to harm fair prices or obtain unjust profits. iii. Persons who obstructed the negotiation right holder from concluding a contract or the contractor from performing the contract. iv. Persons who obstructed the duties of staff and those commissioned by the accounting officer during supervision or inspection. v. Persons who failed to perform the contract without justifiable reason. vi. Persons who, when determining the price after the contract, intentionally made a false claim for an excessive amount. vii. Persons who have used, as agents, managers, or other employees, persons for whom less than 2 years have elapsed since the occurrence of facts falling under any of the preceding items. viii. Persons who have committed acts similar to any of the preceding items. ③ Persons who use persons falling under ② as their bidding agent. (2) Must have been certified by the Ministry of Health, Labour and Welfare for general competitive (nominated competitive) tender eligibility for "Electrical Work" or "Piping Work" in the Chugoku region. (For persons who have filed for commencement of rehabilitation proceedings under the Corporate Rehabilitation Act (Heisei 14, Act No. 154) or filed for commencement of reorganization proceedings under the Civil Rehabilitation Act (Heisei 11, Act No. 225), they must have been re-certified for general competitive (nominated competitive) tender eligibility in the Chugoku region after the decision to commence proceedings.) (3) Must belong to Grade C or D in "Electrical Work" or "Piping Work" in the Chugoku region as certified by the Ministry of Health, Labour and Welfare. (6) Must be able to assign a chief engineer or supervising engineer who meets the following criteria to the construction work. (4) Determination of Negotiation Right Holder and Contract Price: ① The negotiation right holder shall be the bidder who has submitted a valid tender within the limit of the estimated price based on the specifications, design documents, etc., related to the contract. If there are multiple negotiation right holders, they shall be ranked based on their bid price for negotiation. However, if the bid price of the first-ranked negotiation right holder (hereinafter referred to as the "first negotiation right holder") is deemed likely to result in non-conforming performance of the contract, or if it is deemed significantly inappropriate to conclude a contract with that person as it would disrupt the order of fair trade, the next-ranked negotiation right holder may be appointed as the first negotiation right holder for the contract. ② Once the first negotiation right holder for the contract is determined, negotiations shall be immediately conducted with that person to determine the contract price. However, if negotiations fail or if the contract is not concluded within 10 days from the start of negotiations, the accounting officer may negotiate with other negotiation right holders in order of rank.
