1. Public Announcement of General Competitive Bidding (Electronic Bidding, Post-qualification, Comprehensive Evaluation Method) (Common Matters) Regarding design and other consulting services procured by the Kochi Prefectural Government Enterprise Bureau, the common matters for implementing general competitive bidding using the comprehensive evaluation method with a post-qualification system are as follows.
Requirements such as the deadline for submitting applications, bid opening date, and definition of similar services will be individually set for each project in the "General Competitive Bidding Individual Matters" (hereinafter referred to as "Individual Matters").
In the event of any overlapping matters between the common matters and individual matters in this announcement, the matters specified in the individual matters shall take precedence.
Article 1: Eligibility for Bidding
Bidders who meet all of the following requirements are eligible to participate in the bidding for this service.
1. Not falling under the provisions of Article 167-4, Paragraph 2 of the Local Autonomy Act Enforcement Order (Cabinet Order No. 16 of 1947).
2. Not having filed for commencement of bankruptcy proceedings under the Bankruptcy Act (Act No. 75 of 2004), for commencement of corporate reorganization proceedings under the Corporate Reorganization Act (Act No. 154 of 2002), for conciliation of adjustment of specific debts under the Act on Promotion of Adjustment of Specific Debts (Act No. 158 of 1999), or for commencement of rehabilitation proceedings under the Civil Rehabilitation Act (Act No. 225 of 1999).
However, those who have undergone such proceedings may be eligible if they have obtained re-certification of eligibility for bidding for surveying and construction consulting services in Kochi Prefecture through procedures separately determined by the Governor after the commencement of such proceedings.
3. Not having been subjected to measures such as suspension of bidding from the date of this announcement until the determination of the successful bidder, based on the "Kochi Prefecture Construction Work and Other Bid Suspension Measures Manual" (Kochi Prefecture Public Notice No. 598, August 2005) or the "Bid Avoidance Measures Standards" (Notice from the Director of Civil Engineering, 17 Kokoken No. 223, August 25, 2005).
4. Not falling under the excluded persons specified in Article 2, Paragraph 2, Item 5 of the "Kochi Prefecture Regulations on the Exclusion of Anti-Social Forces from Administrative and Business Operations" (Kochi Prefecture Ordinance No. 1, March 2011).
5. There is no relationship between bidders that falls under any of the following criteria.
In cases where there is a capital or personnel relationship that falls under the following criteria among those who have submitted the "Application for Confirmation of Eligibility for General Competitive Bidding" for this service, the eligibility of all parties with such capital or personnel relationship will not be recognized.
(1) Capital Relationship: In the case of two companies falling under any of the following.
(a) Relationship between a subsidiary (meaning a subsidiary as defined in Article 2, Item 3-2 of the Companies Act, hereinafter the same) and a parent company (meaning a parent company as defined in Article 2, Item 4-2 of the same Act, hereinafter the same).
(b) Relationship between subsidiaries sharing the same parent company.
(2) Personnel Relationship: In the case of two companies falling under any of the following.
However, (a) shall not apply if one of the companies (meaning a company as defined in Article 2, Paragraph 3, Item 2 of the Companies Act Enforcement Regulations, hereinafter the same) is a company undergoing rehabilitation proceedings as defined in Article 2, Item 4 of the Civil Rehabilitation Act (Act No. 225 of 1999) or a company undergoing reorganization (meaning a company undergoing reorganization as defined in Article 2, Item 7 of the Corporate Reorganization Act (Act No. 154 of 2002), hereinafter the same).
(a) One company's officer (meaning an officer as defined in Article 2, Paragraph 3, Item 3 of the Companies Act Enforcement Regulations, hereinafter the same) is concurrently serving as an officer of the other company.
1) Director of a stock company. However, the following are excluded.
(i) Directors who are audit committee members in companies with audit committees as defined in Article 2, Item 11-2 of the Companies Act.
(ii) Directors in companies with nominating committees as defined in Article 2, Item 12 of the Companies Act.
(iii) Outside directors as defined in Article 2, Item 15 of the Companies Act.
(iv) Directors who are stipulated in the articles of incorporation pursuant to Article 348, Paragraph 1 of the Companies Act not to execute business.
2) Executive officers of companies with nominating committees as defined in Article 402 of the Companies Act.
3) Members of limited liability companies (meaning unlimited partnerships, limited partnerships, or limited liability companies) as defined in Article 575, Paragraph 1 of the Companies Act (excluding members who are stipulated in the articles of incorporation pursuant to Article 590, Paragraph 1 of the same Act not to execute business).
4) Directors of associations.
5) Other persons executing business who are equivalent to those listed in 1) to 4).
(b) An officer of one company is concurrently serving as a trustee appointed under Article 64, Paragraph 2 of the Civil Rehabilitation Act or Article 67, Paragraph 1 of the Corporate Reorganization Act (hereinafter referred to as "trustee") of the other company.
(c) A trustee of one company is concurrently serving as a trustee of the other company.
(3) Other cases where the fairness of bidding is deemed to be hindered. Cases where an association (including a joint venture) and its members participate in the same bid, or other cases where a capital or personnel relationship equivalent to (1) or (2) above is recognized.
6. Meet the requirements specified in the Individual Matters. Performance records must be completed and delivered by the time of application for bidding.
Article 2: Bidding Method, etc.
Bidders who wish to participate in the bidding for this service must submit the application form, etc., specified in the Individual Matters by the deadline for submission of application forms, etc., as follows.

(Note that uppercase and lowercase letters are distinguished. The same applies hereinafter.)

2. Preparation Guidelines, etc.: Prepare the following application forms, etc., using the downloaded templates.
(1) Application for Confirmation of Eligibility for General Competitive Bidding (Form 1)
(2) Company Evaluation Item List (Form 4) and Deployed Personnel Evaluation Item List (Form 5). Select "Yes" for the items you wish to be evaluated and enter your self-assessed score in the corresponding column.
The declared scores will be finalized after a thorough review of supporting documents for the "Company Evaluation" and "Deployed Personnel Evaluation" of the successful bidder candidate, and if the declared content is deemed appropriate.
For the Deployed Personnel Evaluation Item List (Form 5), if the deployed personnel cannot be identified at the time of submitting the application forms, multiple candidates may be submitted, in which case the candidate with the lower evaluation score will be subject to review.
3. Submission Method:
(1) Application Forms, etc.: Submit by attaching the prepared electronic file to the "Application for Confirmation of Eligibility for General Competitive Bidding Submission Screen" of the electronic bidding system within the submission period specified in the Individual Matters.
Those who do not submit the "Application for Confirmation of Eligibility for General Competitive Bidding" (Form 1) will be disqualified when they become the successful bidder candidate.
(2) Electronic File Creation Method:
A. Electronic files to be attached to the electronic bidding system must be created in one of the following file formats. Also, be careful not to use functions that are lost when saving the file during creation.
However, for comprehensive evaluation methods that require technical proposals, the following ① is generally required (creation by methods other than ① due to the applicant's convenience is not prevented, but the applicant is responsible for cases where the file cannot be read due to garbled characters or blank spaces).
① Files saved with the extension .docx or .doc that can be read by Word 2010 (hereinafter referred to as "Word files").
② Files saved with the extension .xlsx or .xls that can be read by Excel 2010 (hereinafter referred to as "Excel files"). (Forms 4 and 5 are recommended to be Excel files.)
③ PDF format files.
④ Image files (JPEG or GIF format).
⑤ Other file formats specifically approved by the contracting entity (prior consultation is required).
B. If compressing electronic files, use ZIP format.
C. Submission in file formats other than those specified (including compressed files in other compression formats, including self-extracting formats) will be treated as if no submission was made.
(3) If electronic files cannot be attached to the application registration on the electronic bidding system (limited to cases due to system constraints, such as when the attached file size exceeds 5 megabytes), proceed as follows:
A. Inform the contracting officer of the bidding organization by phone or other means that the electronic file cannot be attached and that it will be submitted separately, and obtain consent.
B. After registering the application for eligibility confirmation on the "Application for Confirmation of Eligibility for General Competitive Bidding Submission Screen" of the electronic bidding system in accordance with (1), and unless otherwise notified, submit the application forms, etc., by hand or mail by 5:00 PM on the last day of the submission period.
If submitting by mail, it must be registered mail.
C. Submissions must arrive by the deadline. Please note that items arriving after the deadline, including due to postal circumstances, will not be accepted.
D. When submitting, place the written application forms, etc., in an envelope, clearly write the bidder's name, service name, service number, and bid opening date on the front of the envelope, and seal it with "Application Forms, etc." written in red ink (folding and enclosing application forms in a small envelope is acceptable).
E. If submitting by mail, place the envelope from D into an envelope of a size that can accommodate it without folding, seal it, and write "Application Forms, etc. Enclosed" in red ink on the front of the envelope.
(4) Submission Location and Deadline: Specified in the Individual Matters.
Note: "Closed day" in this announcement (including Individual Matters) refers to the prefectural holidays stipulated in Article 1 of the "Kochi Prefecture Ordinance on Holidays" (Ordinance No. 2 of 1989) (Saturdays, Sundays, national holidays as stipulated in the "Act on National Holidays" (Act No. 178 of 1948), and the period from December 29 to January 3 of the following year).
Article 3: Inspection of Design Documents, etc.
1. Inspection of Design Documents, etc.: Design documents, etc., can be viewed on the Bidding Information System.

2. Q&A:
(1) In principle, inquiries shall be made through the Bidding Information System. Inquiries made by phone or other means will not be answered.
(2) When submitting an inquiry, be sure to inform the contracting officer of the bidding organization by phone that it has been sent.
(3) In principle, answers to inquiries will be provided through the Bidding Information System to the inquirer and those who have applied for confirmation of eligibility for bidding as per Article 2.
(4) Deadline for Inquiry Submission and Answer: Specified in the Individual Matters.
Article 4: Bidding Method
1. Bidding shall be conducted by registering the bid amount on the electronic bidding system within the bidding period specified in the Individual Matters.
2. Bidders shall register an amount equivalent to 100/110 of their estimated contract desired amount on the electronic bidding system, regardless of whether they are taxable or tax-exempt businesses for consumption tax and local consumption tax.
Simultaneously, register a lottery number to be used for the electronic lottery according to the specifications defined in the bidding system.
Handling of the electronic lottery, including cases where a lottery number is not registered, will be handled separately.
The successful bid price will be the amount registered on the electronic bidding system plus 10% of that amount (rounded down to the nearest yen if there is a fraction of less than one yen).
3. If electronic bidding cannot be performed due to a system failure on the electronic bidding system or the Kochi Prefecture side, the execution of the bid may be postponed.
Furthermore, if electronic bidding cannot be performed for an extended period, the bidding method may be switched to the method of depositing paper bids in the bid box as stipulated in Article 5 of the "Bidding Procedures for Construction Work" (Notice from the Director of the Enterprise Bureau, 20 Kokokiso No. 53, April 23, 2008).
In such cases, bidders will be notified separately.
4. If electronic bidding cannot be performed due to a failure on the bidder's side (e.g., equipment malfunction), bidding using bid forms may be permitted upon application, depending on the situation (Form 1 attached to the "Bidding Procedures for Electronic Competitive Bidding for Construction Work" (Form 1, Notice from the Director of the Enterprise Bureau, 21 Kokokiso No. 461, February 9, 2010), hereinafter referred to as "bid form").
5. In the event of unforeseen circumstances requiring re-acquisition of electronic certificates, or due to communication failures caused by natural disasters, etc., bidding using bid forms may be permitted upon application.
6. For bidders permitted to use bid forms in the preceding two paragraphs, the bid forms will be opened by the bid executor at the time of bid opening, and after the contents are registered in the electronic bidding system, the bid opening will be conducted via the electronic bidding system.
7. For bids where the estimated price is publicly announced afterward, if there are no bids that should be successful (e.g., all bids exceed the estimated price), re-bidding will be conducted up to two times.
If re-bidding is conducted, bidders will be notified promptly by email after the bid opening.
8. The deadline for accepting bids in re-bidding, unless otherwise notified, will be 11:00 AM on the day following the bid opening date of the relevant bid (or the next business day if that day is a closed day), and the bid opening will be conducted immediately thereafter.
Bidders shall bid using the methods described in paragraphs 2 to 5.
Article 5: Invalid Bids
Bids falling under Article 9 of the "Bidding Procedures for Electronic Competitive Bidding for Construction Work" (hereinafter referred to as "Procedures") will be considered invalid.
Furthermore, bids falling under Article 4, Paragraph 1, Item 6 or Item 7 of the "Trial Implementation Guidelines for the Single-Round Bidding Method in General and Designated Competitive Bidding" (Notice from the Director of Civil Engineering, Gen-ko-do-sei No. 312, June 24, 2019) will also be considered invalid.
Article 6: Disqualified Bids
Bidders falling under Article 10 of the Procedures will be disqualified.
Article 7: Loss of Bidding Eligibility
Bidders falling under either (1) or (2) below will not be eligible to participate in the bidding for this service.
For bidders who have already submitted a bid, they will be disqualified.
(1) Those who no longer meet any of the bidding eligibility requirements from the date of this announcement until the determination of the successful bidder.
(2) Those found to have submitted false information in their application for bidding eligibility.
Article 8: Comprehensive Evaluation Method
Evaluation will be conducted based on the sum of the "Evaluation Score" (technical evaluation score), the score for the bidder's bid price relative to the estimated price (price evaluation score), and the score for the effectiveness of quality assurance (quality assurance evaluation score), using the comprehensive evaluation items, evaluation criteria, and point allocations specified in the Individual Matters. The resulting sum is referred to as the "Evaluation Value."
