RAG (Remote Air-Ground communication) (4) Construction Period: From the weekday following the contract date until March 18, Reiwa 9 (2027) (5) This construction work is subject to electronic procurement systems for bidding and contracting. However, those who have difficulty using the electronic procurement system may, with the approval of the contracting entity, use the paper bidding and paper contracting methods. (6) This construction work is subject to the comprehensive evaluation and bidding system (construction capability evaluation type (Type II)) which determines the successful bidder by comprehensively evaluating factors other than price along with price. (7) This construction work is a trial project for the post-contract VE (Value Engineering) system, which accepts proposals on construction methods after the contract is concluded. (8) This construction work is a "two-day weekend promotion construction" (contracting entity designated method) in which the contracting entity designates the promotion of two days off per week (details will be provided in the site explanation document). (9) This construction work is subject to the obligation to implement separate demolition and recycling of construction materials, etc., and recycling of specified construction waste, etc., based on the Act on the Recycling of Construction Materials (Act No. 104 of 2000). (10) This construction work does not permit the assignment of a supervising engineer (hereinafter referred to as "special supervising engineer") to whom the provisions of Article 26, Paragraph 3, Proviso of the Construction Industry Act (Act No. 100 of 1949) apply. (11) This construction work is subject to additional points in the comprehensive evaluation for companies that implement wage increases. (12) This construction work is subject to additional points in the comprehensive evaluation for companies that have obtained certification based on laws and regulations as companies promoting work-life balance, etc. (WLB promotion companies). For details, please refer to the bid explanation document. (13) This construction work is subject to labor cost dumping investigation. Details are provided in the bid explanation document. 2. Qualifications for Bidding Participation (1) Not a person falling under the provisions of Article 70 of the Cabinet Order on Budget, Settlement, and Accounts (Imperial Ordinance No. 165 of 1947) (hereinafter referred to as "Budgetary Order"). Minors, persons under guardianship, or persons under assistance who have obtained the necessary consent for contract conclusion fall under "special circumstances" in the same article. 3 (2) Not a person falling under the provisions of Article 71 of the Budgetary Order. (3) Must be rated as Grade A or B in the "Telecommunications Construction Business" category of the Reiwa 7/8 (2025/2026) Ministry of Land, Infrastructure, Transport and Tourism General (Designated) Competitive Bidding Qualifications, and possess competitive bidding qualifications in the Osaka Aviation Bureau (for companies undergoing rehabilitation proceedings based on the Corporate Rehabilitation Act (Act No. 154 of 2002) or reconstruction proceedings based on the Civil Rehabilitation Act (Act No. 225 of 1999), re-certification of general competitive bidding qualifications based on procedures separately determined by the Director of the Osaka Aviation Bureau must have been obtained after the decision to commence proceedings). For those who do not possess the said qualifications, applications for competitive bidding qualifications will be accepted according to the application methods described in the "Public Notice on Qualifications of Bidders" (Official Gazette dated October 1, Reiwa 6 (2024)). (4) Not a person who has filed for commencement of rehabilitation proceedings based on the Corporate Rehabilitation Act or filed for commencement of reconstruction proceedings based on the Civil Rehabilitation Act. However, this does not apply to those who have obtained re-certification under (3). (5) Must not have been subject to a suspension of designation from the Director of the Osaka Aviation Bureau based on the "Measures Regarding Suspension of Designation for Contracts Related to Aviation Bureau Jurisdiction" (Notice No. 386 dated June 28, 1984) during the period from the deadline for submission of the Qualification Confirmation Application (hereinafter referred to as "Application") and Qualification Confirmation Documents (hereinafter referred to as "Documents") to the bid opening date. (6) There should be no capital or personnel relationship between bidders (or members of a joint venture). Please note that communication between parties for the purpose of determining a withdrawal is not in violation of Article 4, Paragraph 3, Item 2 of the Ministry of Land, Infrastructure, Transport and Tourism Aviation Bureau Competitive Contract Bidding Rules. (7) Not a person who is identified by the police authorities as a person whose management is substantially controlled by a gangster or a person equivalent thereto, and who has been requested to be excluded from Ministry of Land, Infrastructure, Transport and Tourism public works projects, and such state continues. (8) Not a contractor of design work for this project or a construction company related to such contractor in terms of capital or personnel (for details, please refer to the bid explanation document). (9) Must satisfy all the qualification requirements separately determined by the Authorized Officer for Expenditure, Director of Osaka Aviation Bureau, based on Article 73 of the Budgetary Order (for details, please refer to Attached Document 1 "Qualification Requirements"). However, collateral in the form of interest-bearing national bonds or guarantees from financial institutions, etc., may be substituted for the contract security deposit. Furthermore, if a performance bond from a public works performance bond insurance company or a performance guarantee insurance contract is provided, the payment of the contract security deposit will be waived. (3) Invalid Bids: Bids submitted by persons who do not meet the bidding qualifications stated in this notice, bids submitted by persons who have made false statements in their applications or documents, and bids that violate the bidding conditions are invalid. (4) Determination of Successful Bidder: The successful bidder will be the one with the highest evaluation score among bids within the limit of the estimated price prepared based on Article 79 of the Budgetary Order. However, if it is recognized that the contract may not be performed in accordance with its terms by the intended successful bidder due to their bid price, or if it is deemed significantly inappropriate to conclude a contract with them due to the risk of disrupting fair trade order, the successful bidder may be the one with the next highest evaluation score among those who bid within the limit of the estimated price. If the bid price of the intended successful bidder falls below the investigation standard price based on Article 85 of the Budgetary Order, an investigation will be conducted according to Article 86 of the Budgetary Order. (5) Confirmation of Assigned Supervising (or Chief) Engineer: If a violation of the exclusive assignment rule for the planned supervising engineer is confirmed through CORINS or other means after the successful bidder is determined, the contract may not be concluded. Replacement of the application form will not be permitted, except in cases approved as unavoidable due to various circumstances. (6) For works requiring the assignment of an exclusive supervising (or chief) engineer, if the contract is concluded at a price below the investigation standard price, an engineer with equivalent qualifications may be required in addition to the exclusive supervising (or chief) engineer (refer to the bid explanation document). (7) Negotiation during Procedures: None. (8) Requirement for Contract Document Creation: Required. This project is subject to the electronic procurement system for the exchange of documents related to contract procedures. If it is difficult to use the electronic procurement system, a request for approval of the paper contract method must be submitted to use the paper contract method instead. (9) Existence of Planned Contracts for Other Works Directly Related to This Project with the Same Contractor: None. (10) Participation by Those Not Certified with General Competitive Bidding Qualifications: Those who have not obtained the certification of general competitive bidding qualifications specified in 2.(3) may also submit applications and documents according to 3.(4), but to participate in competitive bidding, they must obtain the certification of qualifications specified in 2.(3) by the time of bid opening. (11) Post-Contract VE Proposals: After the contract is concluded, the contractor may propose to the contracting entity changes to the design documents that allow for a reduction in the contract price without lowering the functions or performance of the contracted work. If the proposal is deemed appropriate, the design documents will be amended, and if necessary, the contract price will be adjusted. The "qualification requirements separately determined by the Authorized Officer for Expenditure, Director of Osaka Aviation Bureau, based on Article 73 of the Budgetary Order" are as follows: (1) Construction Performance: Must have construction performance for work that meets any of the following requirements 1), 2), or 3) completed and delivered between April 1, Reiwa 11 (2023) and the date of this notice (private sector performance or overseas performance certified by the Overseas Infrastructure Project Engineer Certification/Award System (hereinafter referred to as "Overseas Certification/Award System") is also acceptable) (limited to performance as the prime contractor. Performance as a member of a joint venture under Type A agreement is limited to cases where the investment ratio is 20% or more. Performance of a joint venture under Type B agreement will be recognized only for the scope of work divided, and the investment ratio is not considered). If the performance evaluation for work ordered by the Ministry of Land, Infrastructure, Transport and Tourism or the Okinawa General Bureau of the Cabinet Office has been notified, work with an evaluation score below 65 points is excluded. 1) Same type of work (higher degree of similarity): Telecommunications work related to ITV equipment within the restricted area of an airport (including aerodromes) (excluding removal work only). 2) Same type of work: Telecommunications work within the restricted area of an airport (including aerodromes) (excluding removal work only). 3) Similar work: Telecommunications work related to public facilities or structures falling under Article 15 of the Enforcement Order of the Construction Industry Act (excluding removal work only). (2) Planned Engineers: Must be able to assign a chief engineer or supervising engineer (telecommunications work) who meets the following criteria exclusively to this project. However, if Article 26, Paragraph 3 of the Construction Industry Act does not apply, exclusive assignment is not required. 1) Must have construction performance for work that meets any of the requirements 1), 2), or 3) above, completed and delivered between April 1, Reiwa 11 (2023) and the date of this notice (the work does not need to be the same as the company's construction performance. Overseas performance certified by the Overseas Certification/Award System is also acceptable) (limited to performance as the prime contractor. Performance as a member of a joint venture under Type A agreement is limited to cases where the investment ratio is 20% or more. The date of commencement of site construction will be determined through consultation with the supervisor after the contract conclusion. ② The period after the completion of the work, inspection, and when only administrative procedures, cleanup, etc., remain (excluding cases where inspection is delayed due to the contracting entity's convenience). The date of completion of inspection is the date the contracting entity notifies the contractor of the confirmation of work completion (e.g., the date on the "Notice of Completion Inspection Confirmation"). (3) For construction performance where an evaluation score has been notified for telecommunications work ordered by the Osaka Aviation Bureau and its affiliated offices (offices of regional aviation bureaus as stipulated in Article 39, Paragraph 1 of the Act on the Organization of the Ministry of Land, Infrastructure, Transport and Tourism) between April 1, Reiwa 6 (2024) and the date of this notice, the average of these construction performance evaluation scores must be 65 points or higher.
