Invalid Bids (1) Bids submitted by persons who do not meet the competitive bidding qualifications specified in Section 3 above, or bids that violate the bidding conditions indicated in the bidding documents, shall be invalid. (2) In the case of bids submitted via the System, bids submitted by those who violate the "Terms of Use for the Procurement Portal/Electronic Procurement System" shall be invalid. (3) In principle, bids submitted with no breakdown or with an incomplete breakdown shall be invalid. 12. Language and Currency The language and currency used in bidding and contract procedures shall be Japanese and Japanese currency only. 13. Matters Concerning Consumption Tax For the purpose of determining the successful bid, the successful bid price shall be the amount stated in the bid form plus an amount equivalent to 10% of that amount (if there is a fraction of less than 1 yen in that amount, the fractional amount shall be rounded down). Therefore, bidders shall state in their bid form an amount equivalent to 100/110 of the estimated contract amount (including consumption tax), regardless of whether they are taxable or exempt from consumption tax. 14. Method of Determining the Successful Bidder The successful bidder shall be the one who submits the lowest bid within the range of the estimated price limit. However, if the bid price of the party who would be the successful bidder is such that it is deemed unlikely that the contract content will be performed in accordance with the contract, or if it is deemed significantly inappropriate to conclude the contract with such party as it would disrupt the order of fair trade, the bidder who submitted the lowest bid within the range of the estimated price limit may be selected as the successful bidder. 15. Construction Performance Evaluation For this work, if the contract amount exceeds 5 million yen (including tax), it will be subject to construction performance evaluation as stipulated in Article 7 of the Act on Promotion of Quality Assurance of Public Works (Act No. 18 of 2005). Construction performance evaluation will be conducted at the time of completion inspection, and the evaluation results will be notified to the contractor via a construction performance evaluation notice. 16.
