Kochi Port Coast (Suie District) High Tide Countermeasure Work (Port High Tide No. 6-21)
1 General Competitive Bidding (Electronic Bidding, Post-Bid Review, Comprehensive Evaluation Method) Public Notice (Common Matters): Common matters for general competitive bidding conducted by Kochi Prefecture using the post-bid review method and the construction system confirmation type comprehensive evaluation method are as follows.
Requirements such as application submission deadline, bid opening date, and definition of similar work will be set individually for each project in the separate General Competitive Bidding Individual Matters (hereinafter referred to as "Individual Matters").
In case of overlap between common matters and individual matters in this public notice, the matters specified in the individual matters shall take precedence.
1 Bidding Qualifications: Must meet all of the following requirements.
1. Not to fall under the provisions of Article 167-4, Paragraph 2 of the Local Autonomy Act (Cabinet Order No. 16 of 1947).
2. Not to have filed for commencement of bankruptcy proceedings under the Bankruptcy Act (Act No. 75 of 2004), for commencement of corporate reorganization proceedings under the Corporate Reorganization Act (Act No. 154 of 2002), for mediation of adjustment of specific debts, etc. under the Act on Promotion of Adjustment of Specific Debts, etc. (Act No. 158 of 1999), or for commencement of rehabilitation proceedings under the Civil Rehabilitation Act (Act No. 225 of 1999).
For those who have initiated such proceedings, they must have obtained re-certification of qualifications for competitive bidding for construction work in Kochi Prefecture through procedures separately determined by the Governor after the commencement of proceedings.
3. Not to be subject to suspension of designation, etc. under the Kochi Prefecture Construction Work Designation Suspension Measures Guidelines (Kochi Prefecture Public Notice No. 598 of August 2005) or the Designation Avoidance Measures Standards Manual (Notice No. 223 of the Director of Civil Engineering Department dated August 25, 2005) from the date of announcement until the bid opening.
4. Not to fall under the exclusion measures specified in Article 8, Item 9 of the Construction Industry Act (Act No. 100 of 1949) and Article 2, Paragraph 2, Item 5 of the Regulations for the Exclusion of Yakuza from Kochi Prefecture's Affairs and Business (Kochi Prefecture Ordinance No. 1 of March 2011).
5. No relationship falling under any of the following criteria between bidders.
If there is a capital or personnel relationship falling under the following criteria between parties who have submitted a general competitive bidding qualification confirmation application for this project, the bidding qualifications of all such parties will not be recognized.
(1) Capital Relationship: In the case of two companies falling under any of the following.
(a) Relationship between a subsidiary, etc. (hereinafter referred to as "subsidiary, etc.", meaning a subsidiary as defined in Article 2, Item 3-2 of the Companies Act (Act No. 86 of 2005), hereinafter the same) and a parent company, etc. (hereinafter referred to as "parent company, etc.", meaning a parent company as defined in Article 2, Item 4-2 of the same Act, hereinafter the same).
(b) Relationship between subsidiaries, etc. having the same parent company, etc.
(2) Personnel Relationship: In the case of two companies falling under any of the following.
However, this does not apply to case (a) if one of the companies, etc. (meaning a company, etc. as defined in Article 2, Paragraph 3, Item 2 of the Companies Act Enforcement Regulations (Ministry of Justice Ordinance No. 12 of 2006), hereinafter the same) is a company undergoing rehabilitation proceedings as defined in Article 2, Item 4 of the Civil Rehabilitation Act (Act No. 225 of 1999) or a company in reorganization (meaning a company in reorganization as defined in Article 2, Item 7 of the Corporate Reorganization Act (Act No. 154 of 2002), hereinafter the same).
(a) When an officer of one company, etc. (meaning an officer as defined in Article 2, Paragraph 3, Item 3 of the Companies Act Enforcement Regulations, including the following persons, hereinafter the same) concurrently serves as an officer of the other company, etc.
1) Director of a stock company. However, excluding the following persons.
(i) Directors who are audit committee members in a company with an audit and supervisory committee as defined in Article 2, Item 11-2 of the Companies Act.
2) Directors in a company with a nominating committee, etc. as defined in Article 2, Item 12 of the Companies Act.
3) Outside directors as defined in Article 2, Item 15 of the Companies Act.
4) Directors whose duties are not to be executed as stipulated in the articles of incorporation pursuant to Article 348, Paragraph 1 of the Companies Act.
2) Executive officers of a company with a nominating committee, etc. as defined in Article 402 of the Companies Act.
3) Members of a company with an equity interest (meaning a general partnership company, limited partnership company, or limited liability company) as defined in Article 575, Paragraph 1 of the Companies Act (excluding members whose duties are not to be executed as stipulated in the articles of incorporation pursuant to Article 590, Paragraph 1 of the same Act).
4) Directors of an association.
5) Other persons executing business who are equivalent to those listed in 1) to 4) above.
(b) When an officer of one company, etc. concurrently serves as a trustee (hereinafter referred to as "trustee") appointed under Article 64, Paragraph 2 of the Civil Rehabilitation Act or Article 67, Paragraph 1 of the Corporate Reorganization Act for the other company, etc.
(c) When a trustee of one company, etc. concurrently serves as a trustee of the other company, etc.
(3) Other cases where the fairness of bidding is deemed to be hindered. When an association (including a joint venture) and its members participate in the same bid, or other cases where a capital or personnel relationship equivalent to (1) or (2) above is recognized.
6. Must meet the requirements specified in the Individual Matters. The construction実績 (performance) must be completed and delivered by the time of application.
2 Bidding Method, etc.: Bidders wishing to participate in the bidding for this project must submit the application form, etc. specified in the Individual Matters by the application submission deadline as follows.
1 Acquisition of Application Form, etc. Styles: Download from the Bidding Information System or the Kochi Prefecture Website.

(1) General Competitive Bidding Participation Qualification Confirmation Application Form (Form 1)
(2) Company Evaluation Item List (Form 5) and Assigned Engineer Evaluation Item List (Form 6): Select "Yes" for the items you wish to be evaluated on and enter your self-assessed score in the corresponding field.
The declared evaluation score will be finalized if the submitted content is deemed appropriate after a thorough review of the supporting documents for the "Company Evaluation" and "Assigned Engineer Evaluation" of the successful bidder.
Regarding the Assigned Engineer Evaluation Item List (Form 6), if the assigned engineer cannot be identified at the time of application submission, or if applying with multiple candidates (e.g., for factory production (girder fabrication, etc.) experience and site (erection, etc.) experience), the candidate with the lower evaluation score will be the subject of review.
3 Submission Method: (1) Application Form, etc.: Submit by attaching the created electronic file from the "General Competitive Bidding Participation Qualification Confirmation Application Form Submission Screen" of the electronic bidding system within the submission period specified in the Individual Matters.
Those who do not submit the General Competitive Bidding Participation Qualification Confirmation Application Form (Form 1) and other required documents will be disqualified when they become the successful bidder.
(2) Method of Creating Electronic Files: a. Electronic files to be attached to the electronic bidding system must be created in one of the following file formats. Also, be careful not to use functions that are lost when saving the file during creation. However, for technical proposals in comprehensive evaluation methods requiring a construction plan, only the following ① is applicable (creation in formats other than ① due to the applicant's convenience is not prohibited, but the applicant is responsible for any issues such as garbled text or blank spaces).
① Files saved with the extension .docx or .doc that can be read by Word 2010 (hereinafter referred to as "Word file").
② Files saved with the extension .xlsx or .xls that can be read by Excel 2010 (hereinafter referred to as "Excel file"). (Excel files are recommended for Form 5 and Form 6.)
③ PDF format files.
④ Image files (JPEG format or GIF format).
⑤ Other file formats specifically approved by the ordering party (consult in advance).
b. If compressing electronic files, use ZIP format.
c. Submission in file formats other than those specified (including compressed files in other compression formats, including self-extracting formats) will be treated as if no submission was made.
(3) If electronic files cannot be attached when registering the application on the electronic bidding system (limited to cases due to system constraints, such as when the attached file size exceeds 5 megabytes), proceed as follows.
a. Inform the bidding execution organization's contract representative by phone or other means that the electronic file cannot be attached and that it will be submitted separately, and obtain their approval.
b. After registering the bid participation qualification confirmation application on the "General Competitive Bidding Participation Qualification Confirmation Application Form Submission Screen" of the electronic bidding system in accordance with (1), submit it in person or by mail, etc. by 5:00 PM on the final day of the application submission period, unless otherwise notified.
In addition, register the lottery number to be used for the electronic lottery according to the specifications defined in the bidding system.
The lottery number registration is optional, and the handling of electronic lotteries will be determined separately.
When determining the successful bidder, the bid price will be the amount obtained by adding 10/100 of the registered amount in the electronic bidding system to the registered amount (if there is a fraction of less than 1 yen, that fraction will be rounded down).
3 For construction work bids, prepare a breakdown of construction costs for the bid amount when registering the bid amount in the electronic bidding system, and attach it after converting it into an electronic file according to Section 2, Item 3 (2) above.
The format for the breakdown of construction costs can be downloaded from the website of the Civil Engineering Department, Technical Management Division.
If the necessary information is included in a different format, it is not necessary to use this format.
4 If electronic files cannot be attached when registering the bid amount in the electronic bidding system (limited to cases due to system constraints, such as when the attached file size exceeds 5 megabytes), submit by mail or in person by 5:00 PM on the bid deadline (or the bid acceptance deadline for re-bids, if separately notified), unless otherwise notified, as follows.
If submitting by mail, it must be registered mail.
(1) Place the written breakdown of construction costs in an envelope, write the bidder's name, project name, project number, and bid opening date on the front of the envelope, and seal it with "Breakdown of Construction Costs" in red ink (folding the breakdown and placing it in a small envelope is acceptable).
(2) When submitting by mail, place it in an envelope large enough to hold the unfolded envelope from (1), seal it, and write "Breakdown of Construction Costs Enclosed" in red ink on the front of the envelope.
5 If electronic bidding cannot be performed due to a system failure on the electronic bidding system or Kochi Prefecture's side, the execution of the bid may be postponed.
In addition, if electronic bidding cannot be performed for a long period, the bidding method may be switched to the paper bid submission method as stipulated in Article 5 of the Competitive Bidding Guidelines for Construction Work (Notice No. 808 of the Director of Civil Engineering Department dated December 7, 2007).
In such cases, bidders will be notified separately.
6 If electronic bidding cannot be performed due to a failure on the bidder's side (equipment malfunction, etc.), bidding using bid forms (Form 1, Appendix, Construction Work Electronic Competitive Bidding Guidelines (Notice No. 939 of the Director of Civil Engineering Department dated January 15, 2010, hereinafter the same)) may be permitted upon application, depending on the situation.
7 If re-acquisition of electronic certificates becomes necessary due to unforeseen circumstances, or due to communication failures caused by natural disasters, bidding using bid forms may be permitted upon application.
58 Bids from bidders permitted to use bid forms under the preceding two paragraphs will be opened by the bid executor at the time of bid opening, registered in the electronic bidding system, and then the bid opening will be conducted via the electronic bidding system.
9 If the estimated price is announced after the fact, and if there are no bids that can be the successful bid (e.g., all bidders' bids exceed the estimated price), re-bids will be held up to two times.
If a re-bid is held, bidders will be notified by email promptly after the bid opening.
10 The deadline for bid acceptance in a re-bid shall be 11:00 AM on the day following the bid opening date of the relevant bid (or the next business day if it is a closed day), unless otherwise notified, and the bid opening will be conducted immediately after the deadline.
Bidders shall bid using the methods described in items 2 to 7.
The submission deadline for the breakdown of construction costs is the same as the bid acceptance deadline, so please submit the breakdown of construction costs via the electronic bidding system even in a re-bid.
5th Invalid Bids: Bids falling under Article 9 of the Competitive Bidding Guidelines for Construction Work (Notice No. 939 of the Director of Civil Engineering Department dated January 15, 2010, hereinafter referred to as "Guidelines") shall be deemed invalid.
In addition, bids falling under Article 4, Paragraph 1, Item 6 or Item 7 of the "Trial Implementation Guidelines for Single-Round Bidding in General and Designated Competitive Bidding" (Notice No. 312 of the Director of Civil Engineering Department dated June 24, 2019) shall also be deemed invalid.
6th Disqualified Bids: Bidders falling under Article 10 of the Guidelines shall be disqualified.
7th Loss of Bidding Qualification: Bidders falling under either (1) or (2) below are not eligible to participate in the bidding for this project.
Bidders who have already submitted bids will be disqualified.
