Matters to be tendered (1) Tender name: As per the attached "Construction Order Outline" (2) Construction overview and tender participation requirements: Posted on the Isehara City website and announced by the Contract Inspection Division. 2. Qualifications for participation in competition Those who wish to participate in the bidding must meet all of the following requirements. (1) Matters common to all constructions a. Must be registered in the Isehara City Competitive Bidding Participant Register for Reiwa 7/8 and be recognized for registration in the business categories and subcategories specified for each bidding item. b. Must have a valid business performance review result notification. c. Must be able to submit a construction cost breakdown (a calculation of the bid amount). d. Must be able to assign technicians in accordance with Article 26 of the Construction Industry Act for the contracted construction type. e. Must not be within the suspension period of bidding participation qualifications based on the Isehara City Measures for Suspension of Competitive Bidding Participation Qualifications, etc. f. Must not fall under the provisions of Article 167-4 of the Local Autonomy Act Enforcement Order. g. Must not have been suspended from business operations by laws or regulations (limited to the region including Isehara City). h. Must not have had a bank transaction suspension order within the past 2 years. However, this does not apply to those who have re-obtained competitive bidding participation qualifications after the commencement of rehabilitation (or reconstruction) proceedings has been decided by a court under the Corporate Reorganization Act or the Civil Rehabilitation Act. i. Must not have issued dishonored bills or checks within the past 6 months. However, this does not apply to those who have re-obtained competitive bidding participation qualifications after the commencement of rehabilitation (or reconstruction) proceedings has been decided by a court under the Corporate Reorganization Act or the Civil Rehabilitation Act. j. Must not have had a provisional seizure order, seizure order, preservation seizure, or commencement of foreclosure proceedings decided against their assets due to default. k. If a joint venture or cooperative association applies for participation, they must not be a member of it. l. Must directly pay national and local taxes. m. Must have a proper office structure. n. Must not be a violent group (as defined in Article 2, Item 2 of the Ordinance; hereinafter the same) or a corporation controlled by a violent group, etc. (as defined in Article 2, Item 5 of the Ordinance; hereinafter the same). p. Officers, etc. must not use violent groups or members of violent groups for the purpose of obtaining unjust profits for themselves, their companies, or third parties, or for the purpose of causing damage to third parties. q. Officers, etc. must not directly or actively cooperate with or be involved in the maintenance or operation of violent groups by supplying funds or providing benefits to violent groups or their members. r. Officers, etc. must not have socially reprehensible relationships with violent groups or their members. s. Must be enrolled in social insurance, etc. (Social insurance, etc. refers to health insurance, employees' pension insurance, and employment insurance. Those who are not obligated to join are excluded.) (2) Construction-specific matters: As per the "Construction Order Outline" 3. Confirmation of qualifications for participation in competition Those who wish to participate in the bidding must apply for confirmation of qualifications for participation in competition through the Kanagawa Electronic Bidding Joint System by the deadline specified in the "Construction Order Outline." 4. Notification of confirmation of qualifications for participation in competition Qualification status will be notified through the "Kanagawa Electronic Bidding Joint System" by the deadline specified in the "Construction Order Outline." If any qualification is lost between the notification and the bidding date, participation in the bidding will not be permitted. Furthermore, qualifications will be re-examined after bid opening, and the bidder will be determined as the successful bidder only if the qualifications are confirmed. 5. Submission of bid forms (1) Bid forms must be submitted through the "Kanagawa Electronic Bidding Joint System" during the period specified in the "Construction Order Outline." (2) Bidders must examine the specifications, drawings, etc., before bidding. In this case, if there are any doubts regarding the specifications or drawings, explanations can be requested during the period specified in the "Construction Order Outline." (3) The bid form must state an amount equivalent to 100/110 of the estimated contract amount, regardless of whether the bidder is a taxable or tax-exempt business regarding consumption tax. (When determining the successful bid, the successful bid price will be the amount stated in the bid form plus 10% of that amount (if there are fractions of less than one yen, such fractions will be rounded down).) (4) The number of bid executions is generally one. If there are no bids within the range of the estimated price and above the minimum reserve price, a second round of bidding will be conducted once. Bid forms cannot be altered or withdrawn. Furthermore, those who did not participate in the first round of bidding, submitted invalid bids, or were disqualified in the first round of bidding cannot participate in the second round of bidding. In addition, the submission of a breakdown under Section 5(5) is not required for the second round of bidding. (In this case, even if a breakdown is submitted, it will be considered as not submitted.) (5) A breakdown of the bid amount (hereinafter referred to as "breakdown") must be submitted when submitting the bid form. (6) This construction is subject to a labor cost dumping investigation. If the direct construction cost stated in the breakdown submitted under Section 5(5) falls below a certain level, the reason will be confirmed in writing immediately after bid opening. Failure to submit the written document or respond with the reason may result in the bid being considered a violation of the bidding conditions and being invalidated. (7) Bids below the minimum reserve price will be disqualified. (8) Bids submitted without the breakdown under Section 5(5) will be disqualified. 6. Invalid bids: The following bids will be considered invalid: (1) Bids submitted by individuals who do not meet the specified competitive bidding qualifications. (2) Bids submitted with false information in the documents required for confirmation of competitive bidding qualifications. (3) Bids with incomplete breakdown of construction costs submitted with the bid form. (4) Other bids that violate the bidding conditions. (5) Bids in cases where there is information of bid rigging prior to contract conclusion, and the investigation confirms the fact of bid rigging. 7. Determination of successful bidder candidate and successful bidder: The bidder who submitted a bid at the lowest price within the range of the estimated price and above the minimum reserve price will be the successful bidder candidate. The successful bidder candidate will be notified via the "Kanagawa Electronic Bidding Joint System." After examining the participation requirements and specified documents, the bidder will be determined as the successful bidder if they are confirmed to meet the requirements. If the bidder is found not to meet the requirements after the examination, the bid will be invalidated, and a similar examination will be conducted for the next lowest bidder. If the bid is invalidated, the same examination will be conducted sequentially for bidders with lower prices. If there are multiple bidders who submitted the lowest bid, the successful bidder candidate will be determined by lottery on the "Kanagawa Electronic Bidding Joint System," and after examination, the bidder will be determined as the successful bidder if they are confirmed to meet the requirements. For the specific method of lottery, please refer to the attached "Method of Lottery." 8. Objection filing: Bidders who have submitted a bid form and have doubts about the design documents, etc., may inspect the design documents with prices and file objections only from the issuance of the notice of suspension until 4:00 PM on the day after the bid opening date (excluding closed days, etc.). However, this does not apply to tenders that are not awarded or are canceled. Please refer to "Regarding the Objection Filing System for Tenders, etc." posted on the Isehara City website. Bid opening date: From the issuance of the notice of successful bidder suspension until 5:00 PM (excluding 12:00 PM to 1:00 PM). Day after bid opening date: 8:30 AM to 4:00 PM (excluding 12:00 PM to 1:00 PM). 9. Bid security: Bid security is waived. 10. Contract security: (1) If the contract amount (including tax) is less than 3 million yen: Contract security is waived. (2) If the contract amount (including tax) is 3 million yen or more: An amount equivalent to 10% of the contract amount must be paid at the time of contract conclusion. However, payment of contract security can be substituted by providing interest-bearing national bonds or a guarantee from a financial institution (as defined in Article 3 of the Act on Regulation of Receipts, Deposits, and Interest Rates of Financial Institutions) or a guarantee company (as defined in Article 2, Paragraph 4 of the Act on Guarantee Business for Advance Payment of Public Works Projects; hereinafter the same). Furthermore, if the successful bidder provides a guarantee by public works performance guarantee securities or concludes a performance guarantee insurance contract, the payment of contract security will be waived. 11. Other: (1) If the successful bidder no longer meets any of the competitive bidding qualifications listed in Section 2 by the time of contract conclusion, the contract will not be concluded. (2) A contract document must be prepared for the conclusion of the contract. The costs required for preparing the contract document shall be borne by the successful bidder. The contract document must be submitted within 7 days from the date of the successful bidder determination. (3) The language and currency to be used in the contract procedures shall be Japanese and Japanese currency. (4) Bids can be withdrawn at any time until the bid submission deadline. (5) If the contract falls under the provisions of Article 2 of the Ordinance on Contracts Subject to Resolution by the Isehara City Council and Acquisition or Disposal of Property, a provisional contract will be concluded, and it will become a final contract after obtaining the resolution of the council. If the council's resolution cannot be obtained, or if the bidder is subject to participation qualification restrictions under Article 167-4 of the Local Autonomy Act Enforcement Order or qualification suspension measures under the Isehara City Measures for Suspension of Competitive Bidding Participation Qualifications, etc. by the time of the council's resolution, the provisional contract will be canceled. In this case, compensation for damages cannot be claimed. (6) If it is determined that the bid cannot be executed fairly, or if there is a risk of it, the bidder will not be allowed to participate in the bid, or the execution of the bid may be postponed or canceled. (7) In the event of a failure in the "Kanagawa Electronic Bidding Joint System," the bid may be canceled or postponed. (8) If the bid is canceled or postponed, the costs incurred for the bid cannot be claimed from this City. (9) In addition to the preceding items, the provisions of various laws and Isehara City Contract Regulations, etc., shall apply. (10) This project is subject to electronic contract and electronic guarantee. Method of Lottery 1. If multiple parties submit the lowest bid, an electronic lottery will be conducted on the Kanagawa Electronic Bidding Joint System to determine the order of successful bidder candidates, and examinations will be conducted according to that order. The method of electronic lottery is as follows, referring to the excerpt from the "Kanagawa Electronic Bidding Joint System (Manual)" below. Note: The successful bidder in the above frame should be read as the first-ranked successful bidder candidate. 2. In item ② above, the number obtained by adding 2 to the remainder (within the blue frame) will be the second-ranked successful bidder candidate, adding 3 will be the third-ranked successful bidder candidate, and so on, determining the rank of all lottery participants. For the second-ranked successful bidder candidate and subsequent candidates, if the sum of the remainder and the addition value exceeds the number of participating companies, it will be the number obtained by subtracting the number of participating companies from that value. The results of the lottery will be sent along with the notice of successful bidder determination. 3. The first-ranked successful bidder candidate will be contacted by phone, etc., and requested to submit documents for examination of competitive bidding qualifications. If they are confirmed to meet the requirements, they will be determined as the successful bidder, and a notice of successful bidder determination will be issued. 4. If the first-ranked successful bidder candidate is not confirmed to meet the competitive bidding qualification requirements, the second-ranked successful bidder candidate will be contacted by phone, etc., and requested to submit documents for examination of competitive bidding qualifications. This process will be repeated from 3 and 4 until a candidate is confirmed to meet the competitive bidding qualification requirements. About Electronic Lottery The Kanagawa Electronic Bidding Joint System can conduct an electronic lottery based on the lottery number entered in the bid form when a lottery is required as a result of bid opening. The mechanism of the electronic lottery is as follows: ① Bidders participating in the lottery are sorted in ascending order by lottery number and assigned a "rank number." (If lottery numbers are the same, the order of bid submission will be used.) ② The sum of lottery numbers x is added to the milliseconds y of the date and time when the contracting authority presses the "Lottery Decision Button," and the result is divided by the number of lottery participants z. The remainder plus 1 is the "winning number." Formula: (x + y) / z = m ... n Winning number = n + 1 (Example) If x = 16, y = 250, z = 3 (16 + 250) / 3 = 88 remainder 2 Winning number = 2 + 1 = 3 Note ③ The bidder whose "rank number" matches the "winning number" is the "winner = successful bidder." * Even if the same lottery number is entered, only one successful bidder will be selected. Handling of Bid Amount Breakdown (hereinafter referred to as "Breakdown") If the submitted breakdown is deemed "incomplete" and falls under any of the following items, the bid of the person who submitted the breakdown will be invalidated. 1. Deemed equivalent to non-submission (1) If the breakdown is not submitted by the submission deadline. (2) If documents unrelated to the breakdown are submitted. (3) If the breakdown for another construction is submitted (including cases where the format is different from the one specified for each construction project). (4) If the document submitted as a breakdown is blank. (5) If the submitter's seal is missing from the breakdown (excluding cases where the breakdown is submitted through the electronic bidding system). (6) If the breakdown cannot be identified. (7) If the breakdown prepared by another bidder is obtained and used. 2. Missing items to be filled in (1) If there is no breakdown description at all. (2) If the bid amount is not entered in the breakdown. 3. Errors in items to be filled in (1) Error in company name or trade name (e.g., company name or trade name not entered). (2) If the bid amount in the breakdown differs from the bid amount in the bid form. (3) If there is an error in the calculation of the breakdown. 4. Other incompleteness.
