Contractors for Design and Other Services Not applicable Other Conditions (1) The conclusion of the contract for this bid is subject to the approval of the plan change application under Article 8, Paragraph 2 of the "Gifu Prefecture Nankai Trough Great Earthquake Old Mineral Mining Area Disaster Prevention Measures Project Subsidy (Ground Weakness Survey and Disaster Prevention Work Portion)" Grant Guidelines, and the resolution of the Mitake Town Assembly under Article 96, Paragraph 1, Item 5 of the Local Autonomy Act (Showa 22 Act No. 67) and Article 2 of the Ordinance on Contracts and Acquisition or Disposal of Property Subject to Resolution by the Mitake Town Assembly (Showa 39 Ordinance No. 6). If the contract cannot be concluded even after a considerable period has passed since the provisional contract, the provisional contract may be terminated by mutual agreement. Furthermore, even if the contractor incurs damages due to the above, the town shall not be held responsible for such damages. (2) Must be able to perform the matters stipulated in the specifications and special specifications. (3) Must not fall under the provisions of Article 167-4 of the Local Autonomy Act Enforcement Regulations (Showa 22 Cabinet Order No. 16). (8) Must not have filed for commencement of rehabilitation proceedings under Article 21, Paragraph 1 of the Civil Rehabilitation Act (Heisei 11 Act No. 225), nor have had such proceedings filed against them under Paragraph 2 of the same Article. Matters Concerning Post-Verification of Bidding Participation Qualifications (1) After the bid opening, the award decision will be suspended, and the bidder who submitted the lowest valid bid within the range of the estimated price and the low bid investigation price or minimum restriction price (hereinafter referred to as "successful bidder candidate") will be required to submit documents necessary for confirming bidding participation qualifications (hereinafter referred to as "confirmation application documents, etc.") for qualification confirmation. (2) Confirmation application documents, etc., must be submitted to the contracting party by the specified deadline. (3) If a bidder who meets the bidding participation qualifications no longer meets them by the bidding date (bid opening), they shall not be allowed to participate in the bid. (4) Those wishing to withdraw their bidding application must submit a written statement with reasons to the Mitake Town General Affairs Division by the day before the bidding date (bid opening). 6. Work with Optional Period Setting In the case of work with an optional period setting, the following items shall apply. (1) This construction is a project with an optional period set to ensure a smooth construction execution system for the contractor, allowing for preparation of construction materials, labor, etc., in advance. The contractor can arbitrarily set the construction start date within the construction start deadline indicated by the contracting party. (2) The construction start date cannot be a holiday. Setting a construction start date where the end of the construction period falls on a holiday is also not permitted. (3) The contractor must notify the construction start date using the format specified by the contracting party within 3 days from the day after the award decision date. (4) An optional period does not require the placement of a chief technical personnel or supervising technical personnel, or a site manager. (5) During the optional period, preparation of materials not brought to the site, etc., can be carried out, but work such as bringing materials to the site or installing temporary structures must not be started. Preparation carried out during the optional period shall be at the contractor's responsibility. (6) If the contract is concluded after the construction start deadline due to low bid price investigation, etc., the optional period cannot be set. 7. Other (1) If bidding or bid opening cannot be conducted due to natural disasters or other unavoidable reasons, it shall be canceled. Also, if there is only one bidder, the bid may be canceled. Any damages incurred in such cases shall be borne by the bidder. (2) Procedures such as submission of applications and viewing of design documents shall be conducted on days other than Sundays, Saturdays, national holidays, and other official holidays, within the bidding schedule above. (For electronic bidding, it shall be conducted via the electronic bidding system.) (3) If a price standard for low bid price investigation is set, and the bid price of the bidder who submitted the lowest bid within the limit of the estimated price is such that the fulfillment of the contract content by that bidder cannot be ensured, or if it is deemed significantly inappropriate to conclude a contract with that bidder as it would disrupt the order of fair trade, that bidder may not be selected as the successful bidder, and the bidder who submitted the lowest bid within the limit of the estimated price may be selected as the successful bidder.
