September 7, Reiwa 8 Authorized Signatory for Expenditure Control Deputy Director of General Affairs Division, Kanto Regional Bureau of Environment, Toshihiro Hayashi 1. Work Overview (1) Work Name: Reiwa 8 Fiscal Year Nikko National Park Yumoto Road (Roadway) Pavement Work (Shirane Road) (2) Work Location: Yumoto Onsen, Nikko City, Tochigi Prefecture (3) Work Details: Road pavement renovation, etc. Milling and overlay pavement: 1,576.3 m² Drainage facility work: 1 set Line marking work: 403.6 m Curb work: 1 set Existing facility removal work: 1 set Details are in the attached drawings. (4) Construction Period: From the day after the contract conclusion date until January 29, Reiwa 9 (5) For this work, the submission of documents and bidding, etc., will be conducted through the Procurement Portal and Government Electronic Procurement System (GEPS) (hereinafter referred to as the "Electronic Procurement System"). However, if it is difficult to use the Electronic Procurement System, paper bidding may be substituted with the consent of the ordering party. (6) This work is subject to the low-bid price investigation system. (7) This work is subject to "Weekly Stance Construction Work (Site Closure Type) [Complete Weekly Stance (Saturday/Sunday) Type I]" which ensures two days off per week due to site closure. (8) This work is subject to the weekly stance target. 2. Eligibility for Competition (1) Must not fall under the provisions of Article 70 and Article 71 of the Budget, Settlement and Accounting Order (Showa 22, Imperial Ordinance No. 165) (hereinafter referred to as the "Order"). (2) Must have been certified with the Reiwa 7/8 Fiscal Year General Competitive Bidding Eligibility for pavement work of Grade B or C in the Ministry of the Environment (For those for whom commencement of rehabilitation proceedings has been filed based on the Company Rehabilitation Act (Reiwa 14, Act No. 154) or commencement of rehabilitation proceedings has been filed based on the Civil Rehabilitation Act (Heisei 11, Act No. 225), re-certification of general competitive bidding eligibility based on procedures separately determined by the Ministry of the Environment after the decision to commence proceedings is required). (3) Must not be a person for whom commencement of rehabilitation proceedings has been filed based on the Company Rehabilitation Act or commencement of rehabilitation proceedings has been filed based on the Civil Rehabilitation Act (excluding those who have received re-certification as mentioned in (2) above). (4) Must have experience in performing the same type of work as specified below as the prime contractor, completed and delivered on or after Reiwa 23 (For joint ventures, experience as a member is limited to cases where the investment ratio is 20% or more). The construction performance evaluation score for such work must be 65 points or more. For ongoing joint ventures, any member must have experience in performing the same type of work as specified below as the prime contractor since Reiwa 23. 1) Same type of work: Experience in asphalt pavement work with traffic restrictions on roads under the Road Act, ordered by the national or local government. The construction performance evaluation score for such work must be 65 points or more. (5) Must be able to assign a chief engineer or supervising engineer who meets the following criteria to this work on a full-time basis. 1) In addition to the qualifications of the engineer to be assigned under the Construction Industry Act, must have experience as a site manager, chief engineer, or supervising engineer in the same type of work as specified in (4) above. 2) For supervising engineers, must possess a supervising engineer qualification certificate and a supervising engineer training completion certificate. 3) The assigned supervising engineer etc. must have a direct and continuous employment relationship. (6) Must not be subject to bid suspension measures under the "Measures for Bid Suspension etc. Regarding Construction Contracts with the Ministry of the Environment" (Reiwa 2, December 25, Kankaihatsu No. 2012255) during the period from the submission deadline of the competitive bidding eligibility confirmation application (hereinafter referred to as "Application") and supporting documents (hereinafter referred to as "Documents") to the bid opening time. (7) Must not be a contractor who received the design work etc. for the work specified in 1(1) or a construction contractor related to such contractor in terms of capital or personnel. (Refer to the tender explanation.) (8) Must have a head office, branch office, or business office permitted for pavement work under the Construction Industry Act within the Kanto Regional Bureau of Environment jurisdiction. (9) There must be no capital or personnel relationship between the bidders. (Refer to the tender explanation.) (10) Must not be a person who is substantially controlled by a gangster or equivalent, and who has been requested by the police authorities to be excluded from contracts ordered by the Ministry of the Environment, and such state continues. Other (1) Language and Currency to be used in procedures: Japanese and Japanese currency only. (2) Bid Security and Contract Security 1) Bid Security: Exempt. 2) Contract Security: To be paid. However, it can be substituted with a guarantee from a financial institution or guarantee company (ordering agency: Kanto Regional Bureau of Environment). Furthermore, if a public works performance guarantee bond is provided or a performance guarantee insurance contract is concluded, the contract security will be waived. The amount of contract security, guarantee amount, or insurance amount shall be one-tenth or more of the contract price. However, for contracts with those who have undergone the investigation stipulated in Article 86 of the Order (low-bid price investigation), the amount of contract security shall be three-tenths or more of the contract price. (3) Invalid Tenders 1) Tenders submitted by persons who do not have the eligibility for competition indicated in this announcement, tenders with false statements in the application or documents, and tenders that violate the conditions of the tender shall be invalid. 2) If a successful bidder is found to have submitted an invalid tender, the bid award will be canceled. 3) Even if a person has been confirmed to be eligible for competition by the contracting officer etc., if they do not meet the eligibility criteria listed in 2 at the time of bid opening, they shall be deemed to have no eligibility for competition. 4) Tenders for which a work cost breakdown is not submitted, or for which the submitted work cost breakdown is incomplete, shall be invalid. (4) For contracts with those who have undergone low-bid price investigation, "4/10" in Article 35, Paragraph 1 of the separate contract draft shall be changed to "2/10", and Paragraphs 6, 7, and 8 shall be changed accordingly. (5) Method of Determining the Successful Bidder The successful bidder shall be the person who submitted a valid bid at the lowest price within the limit of the estimated price established in accordance with the provisions of Article 79 of the Order. However, if it is deemed that the content of the contract cannot be performed in a satisfactory manner by the person who should be the successful bidder due to the bid price, or if it is deemed extremely inappropriate because it would disrupt the order of fair trade to conclude a contract with that person, the bidder who submitted the lowest bid among other bidders who bid within the limit of the estimated price may be selected as the successful bidder. (6) Confirmation of Assigned Supervising Engineer etc. If a violation of the exclusivity requirement for the assigned supervising engineer etc. is confirmed by CORINS etc. after the successful bid determination, the contract may not be concluded. Furthermore, replacement of the application form is not permitted, except when approved as unavoidable due to various circumstances. (7) In the case of a work for which the assignment of an exclusive supervising engineer is mandatory, if the contract is concluded at a price below the investigation standard price, an engineer meeting equivalent requirements may be required in addition to the supervising engineer. (8) Requirement for Contract Creation: Required. (9) Whether there is a plan to conclude a contract by private agreement with the contractor of this work for other related construction work: None. (11) Participation of persons not certified with general competitive bidding eligibility: Persons not certified with the general competitive bidding eligibility listed in 2(2) above can also submit the application and documents (hereinafter referred to as "Application etc.") in accordance with 3(3), but to participate in the competition, they must obtain eligibility certification and be confirmed for competitive bidding eligibility by the deadline for submitting bid forms. (12) Hearing on the content of the Application etc.: A hearing on the content of the Application etc. will not be held in principle. If a hearing becomes necessary, notification will be given separately. (13) Notes on Application etc.: In the eligibility review for competition, if the Application etc. is not submitted, or if the content of the Application etc. is deemed inappropriate, such as being created through consultation with other bidders regarding this work, competitive bidding eligibility will not be granted.
