(3) Must not be subject to a suspension of bidding by Tomiya City. (4) Must not fall under the provisions of Article 167-4 of the Local Autonomy Act Enforcement Order. (5) Must not fall under any of the exclusion measures listed in each item of the attached table of the Tomiya City Contract Exclusion of Gangs Ordinance. 3. Bidding Method, etc. (1) By mail. (2) When determining the successful bidder, the contract amount will be the amount written on the bid form plus 10% of that amount (rounded down to the nearest yen if there are fractions of less than 1 yen). Therefore, bidders must state the amount equivalent to 100/110 of their estimated contract desired amount on the bid form, regardless of whether they are subject to consumption tax and local consumption tax. (3) Write the name of the recipient as "Mayor of Tomiya, Hirotoshi Wako" on the bid form and submit it in an envelope. (4) Enter the submission date for the date on the bid form. (5) Bidders must place the bid form and the cost breakdown (item 8) in the bid submission envelope (write "Mayor of Tomiya, Hirotoshi Wako", "Personal (Subject)", "Company Name", "Statutory Welfare Costs Indicated" on the envelope), seal it with glue, and then mail it in a postal envelope addressed to "Tomiya City Planning Department, Finance Division" by registered mail with proof of delivery. However, if the successful bidder fails to conclude the contract, the City may collect an amount equivalent to 5% of the bid amount (including consumption tax and local consumption tax) (or, for unit price contracts where unit prices are set for each supply category, the total amount obtained by multiplying the unit price by the planned quantity for each supply category) as a penalty. 8. Submission of Cost Breakdown: (1) A cost breakdown corresponding to the bid amount written on the first bid form must be submitted with the first bid. (2) The format of the cost breakdown is not specified, but it must include quantities, unit prices, amounts, and statutory welfare costs. (3) The cost breakdown will be kept by the City after confirmation by the person in charge. (4) Failure to submit a cost breakdown, or if quantities/unit prices are unclear due to expressions like "lump sum," or if statutory welfare costs are not clearly indicated, will result in disqualification. 9. Invalid Bids: Bids submitted by those who do not meet the required qualifications for participation in this bidding, those who have made false applications, and those who have violated the conditions specified in the Tomiya City Conditional Open Competitive Bidding Participation Guidelines (hereinafter referred to as "Bidding Participation Guidelines") are invalid. Furthermore, bids from those who have been confirmed as qualified but no longer meet any of the requirements in item 2 at the time of bidding will be deemed invalid. 10. Method of Determining Successful Bidder: (1) The bidder who submits the lowest bid at or below the planned price will be the successful bidder. However, in the case of bidding with a minimum reserve price, the successful bidder will be the one with the lowest bid within the range of the planned price or above the minimum reserve price. (2) If no successful bidder is determined as a result of the bidding, a contract may be concluded by discretionary contract based on the provisions of Article 167-2, Paragraph 1, Item 8 of the Local Autonomy Act Enforcement Order. 11. Contract Security Deposit: Not less than 1/10 of the contract amount. (May be waived according to Tomiya City Financial Regulations) 12.
