Bidder Qualifications: Must meet all of the following requirements: (1) Not a person falling under the provisions of Article 167-4 of the Local Autonomy Act Enforcement Order (Cabinet Order No. 16 of 1947). (2) Must be registered in the competitive bidding participant list for goods purchase, etc. contracts ordered by Kagawa Prefecture. (3) Must have their head office (main office) in Kagawa Prefecture, or have a branch office, business office, or other business establishment in the prefecture and have its head authorized as an agent to conduct business with Kagawa Prefecture. (4) Not currently subject to suspension of designation measures for contracts for the purchase of goods, etc. ordered by Kagawa Prefecture. (5) Not a person for whom an application for commencement of rehabilitation proceedings under the Corporate Reorganization Act (Act No. 154 of 2002) or an application for commencement of rehabilitation proceedings under the Civil Rehabilitation Act (Act No. 225 of 1999) has been filed. However, the following persons shall be deemed to meet this requirement: ① A person who has received a decision to commence rehabilitation proceedings under the Corporate Reorganization Act. ② A person who has received a decision to approve a rehabilitation plan under the Civil Rehabilitation Act (limited to confirmed decisions). (6) Must have submitted a certificate of function/specifications proving that the goods to be bid on have the characteristics, etc. specified in the bidding instructions or specifications. (7) Must have proven that the procured goods and quantities specified in this notice can be reliably delivered to the time and place specified in the bidding instructions or specifications by the shipping certificate, etc. from the manufacturer, sales agent, or import agent of the goods. 10. Requirements for Bidders: Those who wish to participate in the bidding must submit documents proving that they meet the requirements of 9(6) and (7) to the location indicated in 4 by 3:00 PM on September 11, Reiwa 8 (Friday), and must respond if requested to provide explanations regarding said documents. In addition, apply for confirmation of eligibility for open competitive bidding via the electronic bidding system before submitting the documents. Only those who pass the review of the submitted documents will be allowed to participate in the bidding, and the results of the review will be notified by the day before the bidding date. 11. Invalid Bids: Bids submitted by persons who do not have the bidding qualifications specified in this notice, bids by persons who have not fulfilled the obligations required of bidders, and bids in cases falling under any of the items in Article 171 of the Regulations shall be invalid. 12. Cancellation or Postponement of Bidding or Bid Opening: In the event of natural disasters, malfunctions of the electronic bidding system, or other unavoidable circumstances, or if it is deemed that competition is ineffective or likely to be ineffective due to fraudulent acts in the bidding, the bidding or bid opening may be canceled or postponed. In this case, the bidder shall bear the damages resulting from the cancellation or postponement of the bidding or bid opening. 13. Method of Determining the Successful Bidder: Based on Article 147, Paragraph 1 of the Regulations, the bidder who submitted the lowest valid bid within the limit of the planned price shall be the successful bidder. The bid results will be published in accordance with the "Kagawa Prefecture Goods Purchase, etc. Competitive Bidding Results Notification and Public Announcement Guidelines" and the "Electronic Bidding Operation Standards". 14. Contract Conclusion Deadline: The successful bidder must conclude the contract within 5 days (excluding holidays) from the date of receiving the draft contract from the prefecture. If the contract is not concluded within this period, the successful bid shall be invalid. However, this period may be extended due to natural disasters or other unavoidable reasons. 15. Prohibition of Assignment of Reservation Completion Rights: The successful bidder shall not assign the reservation completion rights to a third party between the determination of the successful bid and the conclusion of the contract. 16.
