(2) Not falling under the provisions of Article 167-4 of the Enforcement Order. (3) Must have been certified for "Air Conditioning/Plumbing" in the Toyonaka City Construction Work Bidding Participation Qualifications as of the date of this announcement. However, if a person who has received a decision to commence rehabilitation proceedings under Article 33, Paragraph 1 of the same Act has had a decision to approve the rehabilitation plan under Article 174, Paragraph 1 of the same Act finalized, they shall be deemed not to have filed or had filed against them an application for commencement of rehabilitation proceedings. (16) Not a person who has filed or has had filed against them an application for commencement of reorganization proceedings under Article 17, Paragraph 1 or 2 of the Corporate Reorganization Act (2002, Act No. 154) (including applications for commencement of reorganization proceedings under Article 30, Paragraph 1 or 2 of the former Corporate Reorganization Act (1952, Act No. 172; hereinafter referred to as "Former Act") concerning reorganization cases where the former provisions still apply according to Supplementary Provisions Article 2 of the same Act. Application Restrictions Notwithstanding the provisions of Article 2, the following persons are not eligible to participate in this bid: (1) As of the date of announcement, the bidder has won 6 or more contracts for works with an estimated price of 30,000,000 yen or more (hereinafter referred to as "works of 30,000,000 yen or more") (limited to uncompleted works) that have been awarded by this city (including the Waterworks and Sewerage Bureau and the Municipal Toyonaka Hospital) through general or designated competitive bidding. However, for those who have obtained a work performance score of 80 or higher in the completion inspection by this city for works of 30,000,000 yen or more completed within one year prior to the announcement date (excluding those who have obtained a work performance score of less than 60 in the completion inspection by this city for works of 30,000,000 yen or more completed within one year prior to the announcement date), the number of contracts is 7 or more. (2) As of the date of announcement, the total amount of contract prices for works of 30,000,000 yen or more (limited to uncompleted works) is equal to or greater than the amount specified in the table according to the grade related to the certification specified in 2. Bidding Method, etc. (1) For the determination of the successful bidder, the bid amount shall be the amount written on the bid form plus 10% of that amount (if there is a fraction of less than 1 yen, it shall be rounded down). Therefore, bidders must write the amount equivalent to 100/110 of their estimated contract amount on the bid form, regardless of whether they are taxable or exempt from consumption tax and local consumption tax. (2) The number of bids is limited to one. (3) A minimum price will be set for this bid in accordance with the provisions of Article 167-10, Paragraph 2 of the Enforcement Order. (4) The estimated price and minimum price will be announced at the time of bid opening. (5) The bid results will be announced at the time the successful bidder candidate is determined. 8. Determination of Successful Bidder As a result of the bid opening, the bidder who submitted the lowest bid within the range of the estimated price and the minimum price (if there are two or more bidders with the same lowest bid, the one determined by lottery through the electronic bidding system) will be the successful bidder candidate. A bidding qualification confirmation examination will be conducted using the qualification examination documents submitted in accordance with 6. (6). If the bidder is deemed qualified, they will be declared the successful bidder. However, if the successful bidder candidate is deemed unqualified, the next ranked candidate will be sequentially examined for bidding qualification, and the successful bidder will be determined. 9. Bid Security and Contract Security (1) Bid security: Exempt. (2) Contract security: Must be paid in an amount equal to or greater than 10/100 of the contract amount.
