Furthermore, among the bidders who submitted bids within the limit of the estimated price, the bidder who submitted the most advantageous bid in terms of price and other conditions according to the successful bidder determination criteria stipulated in Paragraph 3 of the same Article shall be the successful bidder. At the time of bid opening, only the prices of bidders who submitted bids within the limit of the estimated price will be announced. The successful bidder will be determined after evaluating the bid price and proposal content based on the successful bidder determination criteria, and will be notified to the successful bidder and other bidders at a later date. 9. Successful Bidder Determination Criteria: The successful bidder determination criteria are as described separately. 10. Failure to Conclude Contract with Successful Bidder: (1) If the successful bidder is found to be a gangster-related business operator, etc., and measures are taken to exclude them from public works, etc., conducted by the prefecture, the contract will not be concluded with such successful bidder. (2) For contracts requiring the creation of a contract document, if the successful bidder is subject to a bid suspension between the determination of the successful bidder and the conclusion of the contract, the contract may not be concluded. In this case, the successful bidder cannot claim compensation for damages incurred due to the inability to conclude the contract. 11. Requirement for Contract Document Creation: (1) The creation of a contract document is required for this contract. (2) The successful bidder shall, promptly after the bid determination, indicate whether the contract will be concluded in writing or through an electronic record recording the contract content. 12. Other: (1) Invalid Bids: Bids submitted by persons who do not possess the qualifications stipulated in 2 at the time of bid opening, bids falling under the categories listed in each item of Article 154 of the Hokkaido Financial Regulations (Hokkaido Ordinance No. 30 of 1970), and bids that violate the bidding conditions specified in this notice shall be deemed invalid. (2) Low Bid Price Investigation Standard Price: A standard price for low bid price investigation has not been set in accordance with Paragraph 1 of Article 167-10 of the Local Autonomy Act Enforcement Order. (3) Handling of Consumption Tax and Local Consumption Tax (hereinafter referred to as "Consumption Tax, etc.") related to Bid Amount, etc.: A. For the determination of the successful bidder, the bid price shall be the amount stated in the bid form plus 10% of that amount (if there is a fraction of less than one yen, that fraction shall be rounded down). Therefore, bidders shall write the amount equivalent to 100/100 of the estimated contract amount on their bid form, regardless of whether they are taxable or non-taxable business operators for consumption tax, etc. B. (8) Cancellation or Postponement of Bidding: This bidding may be cancelled or postponed. (9) Public Opening of Bid Execution: The execution of this bid will be public. (10) Contract Performance: A. If, during an audit or inspection related to this contract, the performance, functions, technology, etc., are not fulfilled as proposed in the proposal, the contractor shall repair or re-perform in accordance with the proposal content upon the prefecture's request. B. If repair or re-performance in accordance with the proposal content is deemed difficult or unreasonable, the prefecture may, instead of the repair or re-performance stipulated in A, reduce the contract amount by the amount equivalent to the non-fulfillment of the proposal content, claim damages for the non-fulfillment of the proposal content, or reduce the contract amount and claim damages for the non-fulfillment of the proposal content. (11) Consent to Assignment of Claims: If the contractor wishes to utilize the loan guarantee system related to fluid asset collateral insurance under Article 3-4 of the Small and Medium-sized Enterprise Credit Insurance Act (Law No. 264 of 1950) after concluding the contract, and if the prefecture deems it appropriate after the contractor submits a request for consent to assignment of claims related to payment claims under this contract, the assignment of claims may be consented to. Please note that requests for consent must be made using the form designated by the prefecture.
