Procurement Method: (1) This work will be performed by a specific joint venture using a joint construction method. (2) Applicants wishing to participate in the tender must meet the tender participation qualifications listed below for the members of the joint venture, the tender participation conditions listed in Section 4 below, and the conditions listed in Section 5 below, and must form a joint venture voluntarily before applying for tender participation. 3. Matters Concerning Tender Participation Qualifications for Joint Venture Members (as defined in Article 167-5, Paragraph 1 of the Local Autonomy Act Enforcement Order (1947 Cabinet Order No. 16; hereinafter referred to as "Enforcement Order"), meaning the tender participation qualifications stipulated in Article 3 of the Contract Regulations; hereinafter the same): Must be registered as a civil engineering contractor in the Reiwa 2025/2026 Kushiro City Construction Work Competitive Tender Participant Qualification List and have received an "A" rating. However, this also includes those certified as having an upper-level rating (skip-grade) due to the Reiwa 7 Fiscal Year Kushiro City Excellent Construction Award. 4. Matters Concerning Tender Participation Conditions for Joint Venture Members (as defined in Article 167-5, Paragraph 2 of the Enforcement Order, meaning the tender participation qualifications stipulated in Article 2, Paragraph 4 of the Contract Regulations; hereinafter the same): Applicants wishing to participate in the tender must meet all of the following conditions as of the application date. (1) Each member must not fall under Article 167-4 of the Enforcement Order. (2) Each member must not be subject to designation suspension measures based on the provisions of the Kushiro City Construction Work Designation Suspension Handling Guidelines from the date of announcement to the date of tender execution. (3) Each member must not be a person who has filed for commencement of rehabilitation proceedings under the Corporate Reorganization Act (2002 Act No. 154) or commencement of rehabilitation proceedings under the Civil Rehabilitation Act (1999 Act No. 225). However, this excludes cases where re-certification of Kushiro City's competitive tender participation qualification has been obtained after the decision to commence rehabilitation proceedings or rehabilitation proceedings. (4) Each member must not be a "B" designated entity, "B" member, or "B" related business operator as defined in Article 2 of the Kushiro City Anti-Boryokudan Ordinance (2012 Kushiro City Ordinance No. 33). (8) There must be no relationship between tender participants that falls under any of the following criteria (excluding cases where all parties with such a relationship are members other than the representative of the joint venture). Note: Capital and personnel relationships in (7) and (8) refer to the following. Furthermore, if such a relationship exists, contacting parties to decide who will withdraw does not fall under Article 6, Paragraph 2 of the Kushiro City Construction Work Tender Guidelines. A. Joint Venture Formation Conditions: Applicants wishing to participate in the tender must form a joint venture that meets the following conditions. (1) Each member shall not be a member of two or more joint ventures for this tender. (2) The number of members shall be two. (3) The share ratio of each member shall be at least 30%. (4) The share ratio of the representative of the joint venture shall not be less than that of other members. (5) At least one of the members must have experience as the prime contractor for construction work of the same or similar scale (hereinafter referred to as "same scale work"). However, this is limited to work where the construction objective has been delivered. If the prime contractor experience for the same scale work was as a joint venture, the share ratio must be 20% or more. Same scale work refers to prime contractor experience in road improvement work or sewer construction work in public works. 6. Tender Participation Application (1) Applicants wishing to participate in the tender must submit the following application documents in person. A. (B) Tender Participation Qualification Confirmation Statement (Form 2) [For each member]. (C) Documents proving construction experience of the same scale work. (D) Documents proving technical qualifications of assigned engineers, etc. (E) Application for Corporate Reorganization Act and Civil Rehabilitation Act (Form 3) [Submit only if applicable]. Inspection of Design Documents, etc. (1) Design documents for the work will be made available for inspection as follows. A. Inspection Location: Same as (1)B. 10. Date and Time and Location of Tender Execution (1) Date and Time: August 25, Reiwa 8, 10:00. (2) Location: Meeting Room B, 5th Floor, Kushiro City Disaster Prevention Building, 8-2 Kurogane-cho, Kushiro City. 11. Minimum Reserve Price System: A minimum reserve price will be set in accordance with the Kushiro City Minimum Reserve Price Setting Guidelines and will be publicly announced after the fact. 12. Tender Method, etc. (1) Bidders must fill in the necessary items on the prescribed tender form and bid breakdown and submit them. (2) For the determination of the successful bidder, the amount obtained by adding 10% of the bid amount to the bid amount (if there is a fraction of less than 1 yen, that fraction will be rounded down) will be the successful bid price. Therefore, bidders must state in their bid the amount equivalent to 100/110 of their estimated contract desired amount, regardless of whether they are a taxable or tax-exempt business with respect to consumption tax. (3) The number of tenders will be up to 3 times. However, those who have withdrawn from the first or second tender or submitted invalid bids cannot participate in subsequent tenders. (4) If there are no bids below the estimated price in the third tender, a negotiated contract will be pursued. In the case of a negotiated contract, quotations will be solicited from two or more bidders, including the bidder with the lowest bid price. (5) If a negotiated contract cannot be concluded, the tender will be canceled, and a new tender will be announced. 13. Invalid Tenders: Tenders falling under any of the following will be deemed invalid. (1) Tenders falling under any of the items in Article 10 of the Contract Regulations. (2) Tenders submitted by persons who do not meet the conditions specified in this announcement. (3) Tenders submitted with false information in the application documents. (4) Other, as per Article 8 of the Kushiro City Tender Guidelines. 14. Bid Bond: Exempt, in accordance with Article 6, Item 3 of the Contract Regulations and Article 2, Section 1, Item 3, Item 2(A) of the "Regarding the Enforcement of Kushiro City Contract Regulations" (2005 Kushiro City Notice No. 3; hereinafter referred to as "Enforcement of Regulations"). 15. Method of Determining Successful Bidder: (1) Among those who bid within the limit of the estimated price, the bidder with the lowest bid price will be determined as the successful bidder. However, bidders who bid below the minimum reserve price will be disqualified and cannot participate in subsequent tenders. (2) If there are two or more bidders with the lowest valid bid price, a lottery will be held among them to determine the successful bidder. Refusal to participate in the lottery is not permitted. 16. Announcement of Tender Results: Tender results will be announced on the Kushiro City Hall website by 17:00 on the tender date. 17. Submission of Contract Price Breakdown: (1) The successful bidder must promptly submit a contract price breakdown after the successful bid determination. (2) The format of the contract price breakdown is free, but it must at least clarify quantities, unit prices, amounts, and costs for materials, labor, statutory benefits, safety and health expenses, and contributions to the Construction Industry Retirement Allowance Mutual Aid Association. (3) The contract price breakdown is requested as a reference document. 18. Contract Conclusion Deadline: The deadline for concluding the contract for this work is August 27, Reiwa 8. If the contract is not concluded by the deadline, the successful bid will be canceled. 19. Contract Security Deposit: Exempt, in accordance with Article 30, Item 6 of the Contract Regulations and Article 3, Section 1, Item 4, Item 2(A) of the "Regarding the Enforcement of Regulations" related to Article 30 of the Regulations.
