(2) The bid form must be submitted in person at the "Place and Date of Bidding" specified in the tender announcement. However, submission by mail (registered mail only) is also permitted. (3) The bid form shall be sealed in an envelope, and the "Name of Bidder" and "Name of Goods, etc." shall be written on the outside. (4) When submitting the bid form by mail, use a double envelope. Seal the bid form in an inner envelope, write the contents of (3) on it, and write "Bid Form Enclosed" in red on the outer envelope. The bid must arrive at the "Department in Charge of Contract Administration, etc." specified in the tender announcement by the time specified in the "Place and Date of Bidding" in the tender announcement. (5) Bidders shall submit a business card, and if a proxy is to perform bidding actions, a power of attorney (Separate Form No. 9) must be prepared and submitted. (6) A bidder or their proxy cannot act as a proxy for another bidder in the same bid. Furthermore, a corporate representative (including a branch manager or other authorized person) cannot act as a bidder for another bidder in the same bid. Invalid Bids: The following bids shall be deemed invalid: (1) Bids submitted by persons who do not have the necessary bid participation qualifications (including those who were confirmed to have qualifications but no longer meet them at the time of bid opening). (2) Bids with false statements in the application form. (3) Bids submitted by proxies without a power of attorney. (4) Bids where bidders have colluded to obstruct fair bid execution, achieve fair price formation, or gain unjust profits. (5) Submitting two or more bid forms for the same item to the contracting authority. (6) Bid forms where the amount, name, etc., are unidentifiable, bid forms lacking signatures and seals, or bid forms with altered bid amounts submitted to the contracting authority. (7) Other bids that violate the bidding conditions. 9. Re-bidding: If there are no bids within the limit of the estimated price, a re-bid may be conducted immediately. To decline a re-bid, write "Decline" on the bid form and submit it. A person who has once declined a bid cannot participate in a re-bid for the same item. 10. Method of Determining the Successful Bidder: (1) The successful bidder shall be the one who submits the lowest bid price within the range of the estimated price in 2(1) of the announcement (limited to valid bids), in accordance with Article 120, Paragraph 1 of the Regulations. (2) If there are two or more bidders who submitted the same lowest bid price, a lottery will be held among those bidders to determine the successful bidder. If any of these bidders are absent or do not participate in the lottery, a Yamagata Prefectural official unrelated to the bidding process will draw the lot on their behalf to determine the successful bidder. (3) A person who no longer meets the bid participation qualifications by the time the successful bidder is determined shall not be the successful bidder. 11. Other: (1) If false statements are made in the application form, suspension measures may be taken under the Yamagata Prefecture Guidelines for Suspension of Bidders in Competitive Bidding. (2) If it is deemed that fair bid execution cannot be carried out due to collusion among bidders or other reasons, such bidders may be excluded from participation, or the bid execution may be postponed or canceled. (3) Bidders shall not raise objections after bidding on the grounds of unclear contract provisions or bidding conditions. (4) The successful bidder cannot transfer their right to conclude the contract to another party.
