(Handling of Information Related to Public Interest Whistleblowing) Article 4 Officers or former officers of the contractor shall not disclose secrets learned in the course of handling matters related to public interest whistleblowing without justifiable reason. (Contracting Authority's Right to Terminate) Article 5 The contracting authority may terminate this contract if the contractor fails to cooperate with an investigation based on the provisions of the Ordinance without justifiable reason, or fails to comply with a recommendation based on the provisions of the Ordinance without justifiable reason. Exclusion of Violent Groups, etc. (1) The contractor (or any of its constituent members if the contractor is a joint venture; hereinafter the same) shall not enter into subcontracting, purchase of materials/raw materials, or other contracts with a person who is recognized as a member of a violent group as defined in Article 2, Item 2 of the Osaka City Ordinance on the Exclusion of Violent Groups (Heisei 23 Osaka City Ordinance No. 10; hereinafter referred to as the "Ordinance") or a person closely related to a violent group as defined in Article 2, Item 3 (hereinafter referred to as "person closely related to a violent group"). (2) The contractor shall not allow subcontractors, etc. (hereinafter referred to as "subcontractors, etc.") as stipulated in Article 7 of the Ordinance to enter into subcontracting, purchase of materials/raw materials, or other contracts with a person recognized as a member of a violent group or a person closely related to a violent group. The contractor shall also cause the termination of such contracts if subcontractors, etc. enter into subcontracting, purchase of materials/raw materials, or other contracts with a person recognized as a member of a violent group or a person closely related to a violent group. (3) If the contractor receives an undue intervention as stipulated in Article 9 of the Ordinance (hereinafter referred to as "undue intervention") from a person recognized as a member of a violent group or a person closely related to a violent group in the performance of this contract, the contractor shall promptly report to the city's supervising official or inspector for this contract, or the manager of the department in charge of the relevant project (hereinafter referred to as "supervising official, etc."), and also report to the police. (5) The contractor shall cooperate with investigations conducted by the city and investigations conducted by the police due to the reports and notifications stipulated in the preceding paragraph. (6) If there is a risk that the proper performance of the contract will be hindered due to undue intervention from a person recognized as a member of a violent group or a person closely related to a violent group, the contracting authority and the contractor shall, after mutual consultation, adjust the performance schedule, extend the performance period, change the performance content, or take other necessary measures.
