Notice is hereby given that an open competitive tender will be held in accordance with Article 4 of the Kushiro City Contract Regulations (2005, Kushiro City Ordinance No. 83; hereinafter referred to as the "Contract Regulations").

Ordering Method (1) This work shall be executed by a special joint venture using a joint construction method. (2) Those wishing to participate in the tender must meet the tender participation qualifications listed below for the members of the joint venture, the tender participation conditions listed in 4 below, and the conditions listed in 5 below, and must form a joint venture voluntarily before applying for tender participation. 3. Tender Participation Qualifications for Joint Venture Members (as stipulated in Article 167-5, Paragraph 1 of the Local Autonomy Act Enforcement Order (1947, Cabinet Order No. 16; hereinafter referred to as the "Enforcement Order"), referring to the tender participation qualifications stipulated in Article 3 of the Contract Regulations. 4. Tender Participation Conditions for Joint Venture Members (as stipulated in Article 167-5, Paragraph 2 of the Enforcement Order, referring to the tender participation qualifications stipulated in Article 2, Paragraph 4 of the Contract Regulations. The same applies hereinafter) Tender participants must meet all of the following conditions as of the application date.
(1) Each member shall not fall under Article 167-4 of the Enforcement Order.
(2) Each member shall not have been subject to bid suspension measures under the "Kushiro City Construction Work, etc., Bid Suspension Handling Guidelines" from the date of announcement to the date of tender execution.
(3) Each member shall not be a company that has filed for commencement of reorganization proceedings under the Corporate Reorganization Act (2002, Act No. 154) or filed for commencement of rehabilitation proceedings under the Civil Rehabilitation Act (1999, Act No. 225). However, this does not apply if re-certification of Kushiro City's competitive tender participation qualifications has been obtained after the decision to commence reorganization or rehabilitation proceedings.
(4) Each member shall not be a gangster, a gangster member, or a gangster-related business operator as defined in Article 2 of the Kushiro City Anti-Gangster Ordinance (2012, Kushiro City Ordinance No. 33).

However, excluding the following: ① Directors who are audit and supervisory committee members in a company with an audit and supervisory committee system as defined in Article 2, Item 11-2 of the Companies Act. ② Directors in a company with a nomination committee etc. system as defined in Article 2, Item 12 of the Companies Act. ③ Outside directors as defined in Article 2, Item 15 of the Companies Act. ④ Directors whose duties are not to be executed due to separate provisions in the articles of incorporation as defined in Article 348, Paragraph 1 of the Companies Act. 2) Executive officers of a company with a nomination committee etc. system as defined in Article 402 of the Companies Act. 3) Members of a partnership company (limited liability partnership, general partnership, or limited liability company) as defined in Article 575, Paragraph 1 of the Companies Act (excluding members whose duties are not to be executed due to separate provisions in the articles of incorporation as defined in Article 590, Paragraph 1 of the same Act). 4) Directors of a cooperative union. 5) Other persons executing business who are equivalent to those listed in 1) to 4). (b) When an officer of one company, etc., concurrently serves as a trustee (hereinafter referred to as "trustee") appointed under Article 64, Paragraph 2 of the Civil Rehabilitation Act or Article 67, Paragraph 1 of the Corporate Reorganization Act for the other company, etc.

(9) Each member shall be able to appropriately assign a supervising engineer or chief engineer and a site supervisor for the relevant construction type in accordance with the Construction Industry Act (1949, Act No. 100), etc. However, the site supervisor shall be assigned by the representative of the joint venture. 5. Joint Venture Formation Conditions: Those wishing to participate in the tender must form a joint venture that meets the following conditions.
(1) Each member shall not be a member of two or more joint ventures for the tender of this work.
(2) The number of members shall be 2.
(3) The investment ratio of each member shall be at least 30%.
(4) The investment ratio of the representative of the joint venture shall not be less than the investment ratio of other members.
(5) At least one of the members must have experience as a prime contractor in work of the same or similar scale as this work (hereinafter referred to as "same scale work"). However, this is limited to works where the delivery of the work product has been completed. If the prime contractor experience for "same scale work" was as a joint venture, the investment ratio must be 20% or more. Construction work experience must be as a prime contractor for pipe equipment work in public buildings.
6. Tender Participation Qualification Application (1) Those wishing to participate in the tender for this work must submit the following application documents in person.

b. Submission Period: From Friday, July 10, 2026, to Monday, July 27, 2026, excluding holidays of Kushiro City institutions as defined by the Kushiro City Holidays Ordinance (2005, Kushiro City Ordinance No. 2), from 9:00 AM to 5:00 PM daily.

(2) Application documents for confirmation of tender participation qualifications can be downloaded from the Kushiro City Hall website from the date of this announcement.
(3) Those who do not submit application documents by the deadline or are deemed unqualified cannot participate in the tender for this work.
(4) Other: a. Expenses incurred in preparing application documents shall be borne by the applicant.
b. Submitted documents shall not be used for purposes other than intended without the applicant's permission.
c. Submitted application documents will not be returned.
d. Replacement or resubmission of documents after the deadline is not permitted.
7. Tender Participation Qualification Notification: The results of the tender participation qualification confirmation will be notified via the "Notification of Confirmation of Qualification for General Competitive Tender Participation" (hereinafter referred to as "Confirmation Notice").
(1) Notification Date and Time: Friday, July 31, 2026, from 1:00 PM to 5:00 PM.
(2) Notification Location: Same as 6(1)c.
(3) Other: a. The Confirmation Notice will be handed directly to the applicant at the location indicated in (2) through the prescribed procedure shown at the time of application. Notification by mail or other means will not be provided.
b. Inquiries regarding confirmation results by phone, etc., will not be accepted.
8. Explanation of Reasons for Disqualification: (1) Those deemed unqualified may request an explanation of the reasons for disqualification from the City. In this case, a written request must be submitted by Friday, July 31, 2026.
(2) The written request in (1) must be submitted in person to the Contract Section, Contract Management Division, General Affairs Department, Kushiro City Hall.
(3) A response will be provided to those who request an explanation by Monday, August 3, 2026.
9. Inspection of Design Documents, etc. (1) Design documents for this work will be made available for inspection as follows:
a. Inspection Period: From 9:00 AM on Friday, July 10, 2026, to 5:00 PM on Monday, August 3, 2026.
b. Inspection Location/Method: To be downloaded from the Kushiro City website. A "Password Inquiry Application" must be submitted to the Contract Section, Contract Management Division, General Affairs Department, Kushiro City Hall, as a password is required to download design documents, etc.
(2) Questions regarding design documents must be submitted in writing using the prescribed Q&A form to the acceptance location by hand or mail.
a. Acceptance Period: Same as 6(1)b.

(3) Answers to questions will be made available for inspection as follows, only if questions are submitted under (2):
a. Inspection Period: From 10:00 AM on Wednesday, July 29, 2026, to 5:00 PM on Monday, August 3, 2026.
b. Inspection Location: Same as (1)b.
10. Tender Execution Date and Time and Location (1) Date and Time: Tuesday, August 4, 2026, at 10:00 AM.
(2) Location: WEB Conference Room, 2nd Floor, Kushiro City Hall Main Building, 7-5 Kurogane-cho, Kushiro City.
11. Low Bid Price Investigation System: A survey standard price and disqualification standard price will be set according to the "Kushiro City Construction Work Low Bid Investigation Price Setting Guidelines" and will be publicly announced after the fact.
12. Bidding Method, etc. (1) Bidders must fill in the prescribed tender form and bid amount breakdown and submit them.
(2) For the determination of the successful bid, the amount stated in the tender form, plus an amount equivalent to 10/100 of that amount (if there is a fraction of less than 1 yen, that fraction shall be rounded down), will be considered the successful bid price. Therefore, bidders shall state in their tender forms an amount equivalent to 100/110 of the estimated contract amount, regardless of whether they are taxable or non-taxable businesses for consumption tax.
(3) The number of bids shall be up to 3. However, those who have withdrawn from the first or second bid or submitted an invalid bid cannot participate in subsequent bids.
(4) If there are no bids at or below the estimated price in the third bid, a non-competitive negotiated contract will be pursued. In such cases, quotations will be requested from two or more bidders, including the bidder with the lowest bid price.
(5) If a non-competitive negotiated contract cannot be concluded, the tender will be canceled, and a new tender will be announced.
13. Invalid Bids: Bids falling under any of the following items shall be deemed invalid.
(1) Bids falling under any of the items in Article 10 of the Contract Regulations.
(2) Bids submitted by persons who do not meet the conditions specified in this announcement.
(3) Bids submitted by persons who have made false statements in their application documents.
(4) Other, as stipulated in Article 8 of the Kushiro City Construction Work, etc., Tender Instructions (hereinafter referred to as "Tender Instructions").
14. Tender Deposit: Exempted in accordance with Article 6, Item 3 of the Contract Regulations and Article 2, Section 1, Item 3, Item (a) of Chapter 2, Section 1 of the "Implementation of Kushiro City Contract Regulations" (2005, Kushiro City Notice No. 3; hereinafter referred to as "Implementation of Regulations").
15. Method of Determining Successful Bidder (1) The successful bidder will be the one who submitted the lowest bid price among those who bid within the limits of the estimated price. However, if a bid below the survey standard price under the low bid price investigation system is received, the bid will be held, and the successful bidder will be determined later. Bidders who submit bids below the disqualification standard price under the low bid price investigation system will be disqualified and cannot participate in re-bidding.
(2) If there are two or more valid bids with the lowest price, the successful bidder will be determined by drawing lots among the eligible bidders. Refusal to draw lots in this case is not permitted.
16. Announcement of Tender Results: Tender results will be published on the Kushiro City Hall website by 5:00 PM on the day of the tender. However, if a low bid price investigation is conducted, the results will be announced on the day the successful bidder is determined.
17. Submission of Contract Price Breakdown (1) The successful bidder shall promptly submit a contract price breakdown after the award.
(2) The format of the contract price breakdown is free, but it must at least clarify the quantity, unit price, amount, and costs for materials, labor, statutory welfare, safety and health, and contributions to the Construction Industry Retirement Allowance Mutual Aid System.
(3) The contract price breakdown is requested as reference material.
18. Deadline for Provisional Contract Conclusion: The deadline for concluding the provisional contract for this work shall be August 7, 2026. If the contract is not concluded by the deadline, the award will be canceled.
